-full ventilation of the facts In the coarts, THE COURTS. John Morrissey as Receiver in Lot- tery Litigations. A Suit That Was Not Dili- gently Prosecuted. The Whole Matter Sent Out of Court. It is not very long ago when the policy business in this city assumed proportions of large magnitude, ‘This was in those royal times when the policy business Stood in highor favor bore than it does at present, and when tho field of operations embraced the popular lottery companies of all tho Southern States, of which Kentucky was central in interest. The supposition was, and the hypothesis seems to’be well substantiated by subaequent proceedings in the courts, that the con trot of the business afforded very iarge profits to tho chief managers, having their headquarters in this city. As is likely to happen in any business arrangements, a dispute, Lowever, it appears, aroso as to tho division of tho profits, which led to litigation and toa pretty Prominent in the series of litigations was a euit brought by Henry Colton against Jokn Morrissey. This suit was set down for trial yesterday in Supreme Court Circuit, before Judge Donohue. The appear- ance of the suit on the calendar excited great curiosity in the minds of many as to its paturo, the supposition of a good many being that it wes a suit growing cither oat of gambling or political transactions, in which jolut associations Mr. Morrissey has during the past few years been largely engaged. It turned out, however, to be a suit following tho appointment by Judge Bar. tard, in 1869, of Mr. Morrissey as receiver of tho lottery business of C, H. Murray & Co. Tho complaint sets forth that the plaintiff sued for the benefit uf all other parties who will come in and coutribute toward the ex- pense of the action, and then goes on to state that on the 1th day of Deceember, 1869, Morrissey was up- intod receiver of the estato and business of O. IL lurray & Co., and of all the rights and traochises in an action Drought by Zachariuh EF. Simmous aguinst tbe Plaintiff and other defendants; that be was appoiuted feeeiver npon the application of said Sunmons; tuat Morrissey accepted tho appointment aud entered pon tho duties of his office us receiver of the estate of C. H. Murray & Co. ; that tho ostate was very vala- bie, being worth soi $500,000, und that ihe lottery business was prodtable, being ‘worth jor the year pre- teding 1860 $400,000; thas tho business was divided Into 120 shares, of which plaintiff, on the 1th of De- cember, 1869, owned twelve shares; that the delend- Ant, in Violation of his trust and duty, fraudulently Combined aud conspired with Zachariah E. Simmons nd Charles Murray and other delenduuts in the alore- Mentioned action to deprive plaintiff of Lis shares; that he offtercu ail the business of the firm of C,H Murray & Co, for sule at the lobby of the Hollman House early in the morning of the 17th ot December, 1869, without adverusing tho sale, without any public Botice and without notice to the plaintifl, and he- loro the summons in said action hud been served on bis plaintill, who was one of the defendants tn the Hon iu which Morrissey had been appointed receiver; thus the property and business was sold to William L. Simmons, a brother of the plaintiff in sutd action, for 000; that Morrissey failed to report the offer of Yule to the Court, and ‘to consummate this fraudulent tale executed a transier of the ttle of the property ow H, Murray & Co, to the said Witham L. Sim- that the price of said business was grossly Inagoquate; that some of the purchase mouey was tonveried to defendant’s own use; that by such sale ike property bas been placed beyond tue reach of the luinutl; that the sale was afterward declared void and | elendant’s receivership set aside, Whereiore he claws judginent for $100,000 damuges on the ground that the tale to >immous Was fraudulent and iNegal, Mr. Morrissey, in bis answer, lirst deuies generaliy. In continuing, he sdys that be has since discovered that his appointment as receiver was void, but that be acted in good taith, The property soid had as an Appurienunce the business of Murray & Co. 1n tho saie ofleery tickets, or polivy shps uf wagers, in viola- tion of the statute and tu traud of the law of this Stuie. He denies the conspiracy, or that plainti! owned Iwelve shares, or that the business was valuable, be- eause the business had been s0 conducted by Colon and others that it ceased io be profitable. Lhe high- ast offer bho got was $25,000, and he thought it Quwise to delay by adverusing lest the property should depreciate, Ho reported the sale to Coury and thereupon an order was inade approving it, bat was Allerward vacated, Messre, H. F, Pultg and spcue Emot appeared for the plainti(, and Messrs. H. M. Whitehead and Wiliam 4. Beach represeutod the detendaut. “As the cass was salled « brief discussion cusused between coupsel. Mr. Bench asked a distiissal of the complaint tor waut of proper diligeuce in prosecuting the suit. ‘The plum wis counsel undertook to show that there had not been any luck of proper diligeuce, although coniessing that they were nos ready for trial tnen. ‘Therr explana hon was not deemed sutistactory, and Judge Dovohue At once granted the motion mae en the compiaint.
