Ho’ Dodwell, the Wife Murderer, Pleads Guilty of Murder in the Second Degree Sent to the State Prison for Life. “'TWEED'S ANSWER IN THE CITY SUIT Invoking the United-States- Courts in Oppo- sition to Rapid Transit. A Wife’s Liability for Her Hus- band’s Board. The trial of James Dodwell, charged with tho murder of his wife, Mary Dodwel), at the tenement house No, 413 Eust Ninth street, on the 27th of May last, was yesterday brought toa very sudden and unexpected close. Recorder Hackett took his seat on the bench promptly as eleven o'clock. In anticipation of further developments in what promised to ve a very curious and interesting case—the dark deed itself being buried in mystery, the court room was densely crowded aud the Proceediugs were awaited with considerable anxiety. The prisoner occupied bis accustomed seat beside his , seemingly indiflerent to all surroundings, No friends were neur to cheer him, ‘and, indeed, be appeared to be deserted by ail save his advocate, Botore uny witnesses were called bir. Howe, the prisoner and lis son-in-law entered into an earnest Conversation, while Axsistunt District Attorney Bell, who conduc.ed the ‘prosecutivn on the part of the people, intimated the Recorder Ubat there was 4 probability of the cuse coming to an end, as be Uuderstuod the prisoner Was going Wo plead uilty to the charge of murder in the second degree, wally Mr. Howe addressed the Recorder amid tho Breatest silence. He said that when he first took Shurge of the case he examined it with great care and Miluuteness, and accordingly prepared What he cou- sidered @ perfect defence. Since, however, the de- Yelopments maue on the part of the prosecution dur- ing the last few days he was forced frankly to coniess ‘that he was unable to present a satisiactory explavation Of the unfurtunate occurrence. Although he was per- fectly sutistied that the prisoner, Dodwell, bad ever displayed any act of premeditation in reference to we murder of his wife, yet there Were sutliciently embar- Tussing surroundings 1p the case that might, pervaps, \nduce the jury to Lind a verdict of guilty of murder in the tirst degree. Under these circumstances be bad Advised the prisoner to plead guiliy of murder in the Beound degree, aud it How only remained for bim to tender that pica to the Court. Assistant Vistrict Attorney Bell said that while he w: Falisticd that the d 1 woman had died trom wounds received on the =7ih of May. xt the bands of ber busband, ana that the prosecution bad produced Suilicient evidence Lo warrant toem in going to the jury aud asking ior a verdict of guilty in ihe tirst de- gree, he Was also satisiied that the ill-treatment which the prisoner had given thy deceused and the threats be bad used toward her were done while he was under the influence of liquor. Under sucn circumstances be mught well hesitate betore shortening the days of the ublortunate prisoner—a mati who bad alwa 5 borne a Jair eburavter, except in regard to wis relations with bis wile, His hie ut most could not be prolonged many years, and he (Mr. Bell) felt he did bis duty to the public in accepting tbe plea of murder in the sec oud degree. Recorder Hackett, addressing the prisoner, then Baid:—The reasons and motives which pave induced your counsel to offer this plea in your bewall meet With my eulire coucurrence; and, Laving in V.ew that the genUeman who appears for you 18 most earnest wud Most sincere in the detence ol criminuls inwrusted to his charge, either assigned by the Court or by per) sonal retaiuer, and well knowing that he bas dove everything for you that could be done in the trial of this case, my Own impress.on 18 that upon the evi- dence produged—and I do nov know how tar it would be embarrassed by the prools Whick would’ be oilered And by the argumens of ecunsel—there would be sul- ficient tor this jury to conyict you of the churge of murder in the iirst degree. Th2 revsons assigned by the District Agtoruey tor inducmg him, iu tultlung bis Bulemn duiy to the people, lo accept this plea are quite mm accord with my own views and I think entirel/ fustily tim in bis act. ‘Lhe sentence ot the Court is tuat you be continued in the State Prison at hard iabor the term of your vataral life. The prisoner was then removed, VHE CITY SUIL AGAINST TWEED, In the original suit brought by the city against Wil- tam M. In an inquest taken in a case in the Marine Court yesterday, before Chief Justice Shea anda jury, two questions of public interest wero disposed of—one being the limtt of a married woman’s liability for board furnished to her and her husband, and the other the limit of a city marshai’s authority. It appeared by the testimon gin the case that Mr. Carlos R, Bellows, some time since the keeper of a boarding house in West Forty-tirst street, let a room, with board, to a Mr. and Mrs. Lawrence, the wife making the engagement on the part of herself and basband, and both living in the house together. When they leit they owed Mr. Bel- lows a balance of $240, for which he retained the trunks of both busband and wile, The wife, on the ground that she could wot bo hel lable. for any part of the bill, and thet, therefore, Bellows had no legal len on her tranks, commenced a suit against bun for the recovery of their possession. This suit, which wes one 1p replevin, Was commenced in the Court of Com- mon Pleas, The necessary order to take the property and deliver it to the gietaur was given into the bande of Ciy Marshal J. W. ‘Thompson for execution, aud the property was taken by bim and delivered (o Mrs. Lawrence, (he claimant. Mr, Bellows, trom whom the property bad been thus taken, then commenced a suit epee the Marshal tor the recovery of the value of the property, and this is the suit disposed of yester- day. When testimony had been putin showing the engagement for board, and that it was furnished to the busbend and wite together, the Chief Justice at once ruled that, under the circumstances, the husband was alone tiable for the amount of the board bill; that the boarding house keeper had no hen on the wie’s property tor payment, and on this ground there could be no recovery against the Marshal, Counsel for plarmtiff then raised the que tion that, though the Marshal might not be liable on that ground, be was liable tora trespass, he having executed an order of repicvin, issued from the Court of Common Pleas, for which he had no authority, This point the Court held to be well taken, the law muting the authority of muarshals to the exocution of writs issuing from the civil district courts. As damages re- sulting trom this unsuthorized exerctso of authority on the part ot the Marshal, the plaintu proved he lost somo of his best boarders, and the jury assessed the amountat $40. ‘The Court, in chargig ‘the jury, told them a public olficer sould bs held lable for the cousequences Of his ignorauce us much as a physician, IMPORTANT COMMERCIAL SUIT. A suit of unusual importance to the commercial por- tion of the communtiy, and which has been on trial for two days past before Judge McAdam anda jury in Purt 1 of the Marine Court, was concluded yesterday. Both parties to the action were prominent business men of the city, and tho case bas been tought with great persistency by Mr, E. P, Wilder, on the part of the plaintiff, and Mr. Abraham Wakeman, formerly gpliector of this port, on the part of the dofendant. ie delendant had tulied and compromised with Lis creditors under the two-thirds act tor forty cents on the dollar. By this comprom.se plaintifts retused to be bound and sued to recuver the whole valanve duc them, on the ground that the credit was given defend. | ant on @ false overestimate and representation as to his solvency a short time betore his assignment These alieged misrepresentations consisted principally in the statement that he owed only about $25,000 and had stock amounting to $80,000, but which be believed would realize $60,000, besides other assets, The as- signee found but between $50,000 and $60,000 in assets in all, and this detendant explained by saying bis esti- mate was but a rough ove and that it was made in good faith and in no sense to deceive, that they wero stated in incidental conversations with plainufl ana not with a view to obtain eredit from hun, they having had long dealings together, und that he was torced to make ub assignment by some of his persistent credit- ors, In his charge to the jury, which was very full, Judge McAdum told them the suit had been brought by W. H, Cromwell & Co, to recover from George L, Burr $1,866 52 for goods vold and delivered by them to him’ between September 8 1875, and De- cember 29, 1875, and that the suit bad been brought in the form of eceit, and not on a simple contract, ou the eround that the debt had been contracted by means: of false and extravagant statements made by him, by which his financial condition . was greatly overrated, aud that such representations were made with a design to get possession of the goods without paying lor them. In a long explanation of the law ol commer- cial misrepresentations the Judge quoted the opinion of Judge Pratt, in which ne says:— “To constitute fraud ip such cases there must be an intention to cheat; at least, there must be intention to do an act the necessary result of which will be tocheat and defraud another, Bat itis clear that such intep- tion Is not necessarily inferable from the fact that a man ip good credit, going on with regular business, makes his usual purchases for the purpose of continu: ing that business after he is made aware that bis prop- erty 1s not sufficient to pay hisdebts, It 1s not truud- uleut in him to make reasonable efforts to retrieve his fortune and to extricate himsel! from bis embarrass. menis.’’ Judge McAdam concluded as follows :—**rhis. question is one for you to determine exclusively, Frazd 18 @ question ‘of fact for the — detormiva- tion ot a jury, and their verdict or a Tule is conclusive upon that question. Dispose of this case as business men, feurlessly and without sym- pathy. It the defendant is guilty 1 is your duty to convict him by your verdict, If he iw innocent he ought wo go tree from the imputation of fraud, and it iy Your duty to find in bis favor. Let justice be vindi- ented by your verdict, whatever tlie consequences may be to either of the parties, ‘The jury, utter a brief deliberation, brought in a ver- dict tor defendant, and bis friends present congratu- lated him on the vindication of bis commercial charace re COURT CALENDARS—THIS DAY. Aiter considerable time being spent in this way the petition was roferred to the Committee on Streets. Alderman Morris presented a resolution, which was passed unanimousiy, requesting the Board of Appor- Honment to appropriate $3,000 to pay expenses of some 600 policeman who leave lor the Philadelphia Ex- position today.
