Tenure of Office of District Court Clerks. Execution Against Tweed Upon the Judgment in the Six Million Dollar Suit. - A suit, the result of which will, doubtless, be watched with no little interest, was commenced yesterday, before Judge Van Hoesen, in the Court of Common Pleas. The cuit is one brought by ex Sherif Brennan to recover a portion of his fees as Sherif during part of the year 1872. The compiaint states that furimg the months of January, February, March, April, May, June, July, August and September of the gear 1812 Mr. Brennan was Sheriff of the county New York, and that his advances and foes during the months named amounted mthe aggregate to the sum Of $52,868 68; that his bil for this amount was duly audited and allowed by the Board of Supervisors, and that payment was refused by the Comptroller, He Seeks judyment, therefore, against the city for the sum stated, with interest, The answer denies that the plaintiff performed all the services set forth in the complaint, and alleges that his bills wore false; it further states that the Plaintiff! in bis report to the Secretary of state for the nine months in question reports 20,201 convictions, but now falsely claims to have re- ported 23,974 convictions, upon which be seeks to re- cover a percentage of fifty cenison each conviction. There is a further allegation that his report ant bill claiming twelve and # half cents each on 29,980 police court convictions was wholly unfounded, for the rea- sou that be never made any such report The bill for conveying 18,881 prisoners, at $1 75a head, to other prisons than State Irison, and amounting 10 $31,641 71, is alieged to be fals because he really conveyed only 1,700 prisoners. He charges for conveyance of 1,500 pass court prisoners to prisons otler than State Prison, and the answer says he never performed such service atall, For the overcharge the cily sets up a counter claim for $40,508 25, overcharges in 1871, The complaint further specities March 81, 1871, he fled 8,941 convictions al courts, which were not reported, and that {oI ter ending June 80 he claimed for 9,704 pol convictions, which he did not report, and so on, Mr, Brennan puts in a reply to the counter claim denying eacn and al! of the ailegations in the counter claim, A strong pot for the de ence 1s thas the Sheriff enum- erated in bis totaix removals to yrisov for woich the law does not provide him any céinpsusation, as they are made by the police. ‘The tlrst witness called was Mr. Yparks, Clerk of the courts of Oyer and Termiver sAd General Sessions, wlio produced a record of convictions in Oyer and Ter- Diner and General sessions, Mr. Strahan objected to the evidence on the ground that under the statute the judgment of the Supervisors was tinal and conciusive; that they were a jadicial boy, and that no Court bad the power to go into side issues as to whether they had the proper gures before them when auditing Judge Van Hoesen overruled the objection, holding ‘that the city was not to ve prejudiced by any excess of authority by the Supervisors, Mr. Sparks testified that in 1871 the convictions in both courts for which the sentences were less than Stare Prison were:—Penitectiary, 197 males and 19 fe- to City Prison, 5 boys and 1 girl; to the House of Refuge, 82 boys and 1 girl; in thas! year 485 males and 31 females were sent to State Prison; jim 1872, 446 males and 27 Jemales were sent to State Prison; to the Penitentiary, 249 males and 35 females, and trans- ferred froin’ City Prison, 19 boys and 2-girlg, and 1 | yeep wo the House of Refuge; these figures did not, include convictions where sentences were suspeuded, Messrs. Itis provabie the trial will occupy two or threo anys at for the quarter ending police DISTRICT COURT CLERKS, ‘The question as to whether the term of the clerks of the ten district courts who held office prior to the 1st of January last expired at that time was argued at length yesterday im the General Term of the Court of Commow Picas, A quo warrauto suit was brought in order to adjudicate the case. John J. Healey, Jr., was ppoiuted clerk of the Eighth District Court under the act of 1872, and on the Ist of January last Henry Leask was appointed in bis place, It 18 claimed by Healey that his appomtment under the act reterred to ‘was for six years. On the other band, it is insisted that he was entitled to hold office oniy during the re- maining part of the term of Judge Kane, by whom he ‘Was appomted. The Court took the papers, reserving 1s decision. EXECUTION. AGAINST TWEED. Mr. Wheeler H. Peckham placed in the hands of the Sheriff of this county yesterday an execution against the property of Willian M. Tweed. The amount which the execution calls for is $6,052 19, with interest from the date of entry of judgment. William Clarendon, who said he lives at No, 420 East Seventeenth street, waa charged with burglary.
