Cochran vs. Gotterald et al.—Allowance to defend- ants of $25, SUMMARY OF LAW CASES. On the application of Josiah Richards and John Liv- Ingston to vacate an election of directors of the Erie Railroad Company held July 13, 1875, and on which ar- gument was had sume time in Supreme Court, Cham- bers, Judge Westbrook’s decision thereon was yester- day filed in the County Clerk's office, The motion to vacate was denied. Suit was brought by the Commercial Advertiser against the city for $1,044, payment for advertising in 1873 and 1874, after the new charter was passed. The answer set up that the appropriation was exhausted, except the sum of $7 27, betore the liability ‘was incurred. Motion was’ made on plainui’s behalf for judgment, on the ground that the answer was frivolous. The case of the Mutual Gas. light Company was cited, in which the city was held liable, though the appropriation was exhausted. ly his decision yesterday Judge Donohue says the gas company’s case does not cover this case, and he denies the motion on the ground that in the case cited the tuswer did not show that the appropriation was ex- gausted before the liability was incurred, while iu this tase that fact was set up clearly. Samuel H. Millurd, the owner of the 1,850 unstamped cigars seized by Captain Kennoch, of the United States Becret Service, on September 8, appeared before United States Commissioner Osborn yesterday and gave $3,000 ‘bai! to appear for examination on Tuesday next. TOMBS POLICE COURT. Before Judge Morgan. ALLLEGED FORGERY. Frederick R. Brady was accused of appropriating a check for $150, velonging to Alexander R. Chisholm, of No. 52 Broadway, by whom he was employed as a confidential clerk; and forging thereon the indorse- ment of H. De'Muerin, the editor of the Messager Franco-Amerciaine, to whom the check Was made paya- ble. This occurred on October 31, 1873, The check was drawn on the National Bank of the State of New York, where Mr. Chisholm kept his deposits, and when Brady presented it tor payment it was cashed without hesitation, the officials of the bank knowing him well, Immodiately after Brady left for parts unkuown, and, although search waz made for him by the police, he managed to elude them until Friday, when he was arrested .Mr. Chis- holin has since ‘discovered that Brady had stolen various amounts, aggregating $800, Justice Morgan sommitted him for trial. WASHINGTON PLACE POLICE COURT. Before Judge Wandell. JOHNSON'S PASS. On Friday evening James Johnson, in company with a lady, presented at Booth's Theatre a pass, which was pronounced aforgery. He was locked up for the night and brought before Judge Wandell yes- terduy. The young lady who accompanied him to the theatre testified that she had given Johnson the pass, and that a man uamed Smith had given it to her. Johnson was discharged. THE ASSAULT ON OFFICER DENNISON. Michael Gaifey, who was shot on the night of the 22d of August by Officer Dennison, of the spectal ser- vice squad, on the corner of Sixteenth street and Tenth avenue, and who was taken to Bellevue Hospital three weeks ago in a critical condition, was arraigned yester- fay on a charge of assaulting Officer Dennison. Gaffney stated in evidence that Officer Dennison was drunk when he came into the place where he was, and while he und bis friend Hannon were drinking at the bar Dennison caine in, dressed in eitizen’s clothes, and, knocking up against them, said, ‘Count me in’ on ‘this rackot,"? Hannon answered ‘that he had not money enough to treat him, and then Dennison slapped Hannon in the face, whereupon Hannon struck back at Dennison, A scuffle ensued, and Gaffney interfered in behalf of his frieud, when Dennison pulled out a revolver and shot both him and Hannon. Gailney was held in $1,000 to answer. FIFTY-SEVENTH STREET COURT. Before Judge Bixby. KILLED BY A BLAST. Cornelius Sullivan and Florence Sullivan were charged with setting offa blast on Fourth avenue and 122d street which, it was alleged, was not properly covered. A stone that ascended from said blast en- tered a room of premises No. 55 West 123d street, and killed a child named Alice Shedden. The accused were remanded to await the action of the Coroner. FINED POR PURCHASING FROM A MINOR. George Sachs, a dealer in articles of second hand, at No, 366 West Fifty-second street, has been in the habit for some time past of buying lead pipe and old copper from Donald Thompson, sixteen years of age, of No. 347 West Fifty-second street. He was arrested for violating the Jaw relating to minors, and was fined at this court $25 for the offence. THE CASE OF BELLA JONES, ‘The adjourned inquest in the case of Bella Jones, the young woman who committed suicide in a cell of the Mercer street station house, was resumed yesterday be- fore Coroner Fickhoff, Several witnesses were exam- ined, and although their testimony key uniformly wenttoshow that the unfortunate youhg woman was brutally treated the Coroner’s jury, after an absence of about halfan hour, returned with the following verdict :— “We find that Bella Jones, of No. 166 Thompson street, tame to her death by committing suicide by hanging herself in her cell tn the Fifteenth precinct station house, on the morning of the 3d of September; and farther, we censure Officer William J.
