RAPID TRANSIT. CAN THE PRESENT comCsSION BE SUPER SEDED?—THE SECTION UPON WHICH LAW- ‘YERS DIFFER—ALFRED ¥. LOZIER'S PLAN, No session of the Commission was held yesterday, Saturday being the day the members set apart for the transaction of their own business. The engin¢ers, how- aver, were busily employed all day in examining plans, making calculations, &c., preparatory to reporting their views as to the best plan of construction. Mr. Mott, with President Courtright, of the Greenwich Street Ele- vated Railroad, spent a portion of the day in an exami- nation of proposed routes. Mr. Alfred E, Lozter, No. 85 Wall street, has presented a plan which he describes tn his letter accompanying iv as follows: I proj to construct a road as per accompanying ¥ and drawings, on cast iron columns, fourteen foet Ben. sunk four feet into the earth, resting upon granite | biockS, pile or ballast, to be fifteen inches in diameter at their base, cighteen feet in length, including capitals, to be surmounted by a cast or composite iron bed plate sixteen fect long, three feet wide and one foot deep, to be supported at its ends and centre by ornamental iron bracket work, and also to rest on the capitals of the col- ‘amns—the longitudinal spans from column to colurnn to be double wrought tron beams, with a steel sixteen pound ra#t clainped in a groove at the top, the spans not to be under twenty-tive nor over thirty feet in length, tat street crossings, where they are to conform to tho width of the streets over which they pass and their strength increased by truss rods, The gauge of the road Bot to be over four feet and reduced tw three feet if found practical for the successful operation of a seven foot car body, as the narrowness of the gauge will ma- terially contribute to the solidity and durability of the structure, I will erect as per drawing « wrought iron arch from the extrome ends of the bed plate for the sup port of the telegraph wires. I will also have, as per drawing, a wrought iron bulwark as high car windows as a proventive against accident on the road and frightening of horses on the street, the same to be surmounted by an ornamental cresting ten inches high, to join on to and harmoniously blend into the ornamental iron work that supports the arch. The Btructure to be placed in tbe centre of the avenue, and as our principal avenues are sixty in width from curb to curb, and as the structure only measures eleven | feot two and a half inches from extreme outsides ot col- ‘umns, there will be left on each side of structure, be- tween column and curb, a drive way twenty-four feet four and three-quarter inches in width, a street about as wide as Fulton street on each side of the structure, while at the same time teams can pass in any direction between the columns. You wifl, by referring to the ground plan, see that this structure will not be as detrimental to travel with vebicles as the present surface tracks. When the lower end of the avenue is reached and the structure m necessarily traverse narfow streets occupied by stores, warehouses, &c., 1 would place one line of the columns on the sidewalks, the other just outside the curb, which } would be leas obstruction to travel than a seven foot car claiming absolute right of way on tho surface track in the centre of a narrow street. My ESTIMATES THE COST per mile, double track, at $180,000; and, with full equip ments, $241,000 per mile. The advocates of rapid transit seem to be alarmed at the prospect of the Commission being unable to agree upon the route in time to have it officially proclaimed before the sixty days named in the law, and conse- quently fear the dissolution of the Commission. Some persons construe section 4 to mean that it is only pecessary for them to name the route within sixty days, and that the subsequent proceedings to confirm their selection can be had later. Among these, it is under- stood, is Mr. G. P. Lowery, counsel of the Gilbert Ele- vated Railroad, and ex-Judge Emmet, The former gentleman’s opinion is that of an interested advocate; but Judge Emmet’s is an opinion asked for by the Commission. It is understood that his opinion is merely a verbal one, consequently his reasons for making it bave not transpired. Section 4, upon which ‘the difference of opinion exists, reads as follows :- Said Commissioners shall, within thirty da such organization, determine upon the ‘necessity of such steam railway or railway nd if they find such railway or railways to be necessary in suc! ball, within sixty days after such organi and determine” the route or routes for such s way or railways, and the said Commissioners s the exclusive power to locate the route or routes of such railway or railways, over, under, through or across the Streets, avenues, places or lands in such tounty, except “Broadway and Fifth avenue, below Fifty-ninth street, and Fourth avenue, above Forty- second street, in the city of New York,” and except such portions of streets and avenues as are legally designated for the main line of or occupied by an vated or undergroand railway in actual operation, and except such as are contained in pnblic parks or occupied by buildings belonging to such county or to this Bate, or to the United States, and excepi that portion of the city of Buffalo lying between Michigan and Main streets, and to provide tor the connection or june- tion with any other railway or bridge, provided’ that the consent of the owners of one-half in value of the property bounded on and the consent also of the local authorities having the control of that portion of a street or highway apon which itis proposed to-con- struct or operate such railway or ratlways be first obtained, or, im case the consent of such perty owners cannot be obtained, that the determination of three Commissioners, —_ap- pala by the General Term of the Supreme ourt in the district of the proposed construction given after a due hearing of all parties interested and con- firmed by the Court, that such railway or railways ‘ought to be constructed or operated be taken in lieu of the consent of such property owner: By Mr. Roosevelt, whose views were given in yester- @ay’s Hernan, and others, the term “fix and deter- . Mine” is construed to mean a final selection after all formalities of the law to acquire the right of way have deen complied with. If such be the epirit of the law GRAVE DOUBTS EXIST as to the ability of the Commission to comply with the act within the time specified in the act. In the event of their failure it is claimed their tunctions under the act cease. The Citizens’ Rapid Transit Association, it seems, are not satisfied with the progress made by the Commission, and their officers propose to convene the association within a few days to take action, looking to the aid of the Commission or t supersedure by another commission, which it is asserted can be raised under the first section of the act.
