THE TWEED SUIT AS A PRECEDENT Upom the order to show cause, granted on Thursday by Judge Westbrook, helaing Supreme Court, Ohambers, why a stay of proceedings should not ve granted relative to the orders nade respectively by Judges Davis, Donohue and Bar- Tett, Inregard to the $6,000,000 suit against Wil- liam M. ‘tweed, and whieh was set down tor argu- ment yesterday, it was generally anticipated that another interesting chapter would be furnisned in the lively Litigation growing out of this new suit against tue ex-Boss. ‘There was a crowded court room und gebera) expectation of an ani- mated forensic set-to in the legal arena, Tue hour fixed upon tor tbe argument was eleven A. M., but at this time none of the great legal luminartes so brilliantly conspicuous in these legal tournaments putin an appearance. Donovan sued out a writ of hubeas corpus and also.a writ Ol certiorar: to review the Surrogate’s decree, and, upon motion jade to quash both writs, Judge Westbrook yes- ferday reudered the foilowing decision dismiss- Ing the writs :— There has been no appeal from the Surrogate flecree as the statute allows. The clear Inteut of the statute was to permit a revicw only by ap- pealandin the mode prescribed. This writ can- bot be issued to review tus adjuaication of the Surrogate, tt is true that counsel argu wb is directed wo we order of A isonment, and pot to the tinal de- cree; but itis equally true that the point made by the relator is that the imprisonment is wrong because the original decree is wrong. In the Court of General Sessions yesterday, Robert Morris, who, on the 17th of July, stole $7 from tue pecket of William Hogan, while sitting upon a stoop im Madison avenue, pleaded guilty to larceny troim the person. His Honor imposed a severe penalty, sentencing Morris to the State Prison for five years.
