~L— THE COURTS. The Synagogue Bnal Jeshurun---Or- thodoxy Versus Reform. THE BIRDSALL SLANDER SUIT. New York and Montreal Rail- way—Receiver Appointed, THE COUNTERFECE STAMP CASE, David Lawson, Charles Borus, Frank Albert, August Hoch and William Barrett, against whom & charge was preferrea recently of having run the brig Mary Cbilton out of the harbor of St. Andreas, Were brought to this port from Havana yesterday on the steamer Georgia, in charge of Officers Denbert and Barclay, who brought them before Commissioner Shields, They stated that they did not intend to steal the vessel, but had run her out of the harbor while drunk, and after- ‘Ward abandoned her in the Guif of Mexica, being unable to navigate her. Tney were held Jor an examination in default of $2,000 bail each. THE SYNAGOGUE BNAI JESHURUN. A question of pregnant interest to the Hebrew communities of the city and throughout ‘the country generally is now in litigation im our courts. The point at issue is raised between the orthodox Jews of the congregation of the Thirty- fourth street symagogue and the reform element of the same, brought into collision by tne action of the latter in an attempt, as alleged, to break down the barriers which have heretolore inter- Yened in the separation of th xes during di- Vine Worship in the synagogues wherever ortho- oxy has yet a feothold. The time-honored cus- tom contended for by the orthodox Jews, and for which they claim divine authority, of the sep- Syation of the sexes during worsbip in the syna- g@ogue, is sought to be overthrown by the yeformers of the congregation Baal Jeshurun, or Yather by the trustees of the congregation, who, im their corporate authority, claim the right to “change the interior character of the church edt- fee in accordance with the wishes. of the major- ity of congregation,’ and that they, the trus- tees, “have the exclusive right to apply the church funds for the making of such alterations 6 they deem most desirable and expedient.” The orthodox members look upon the claim as an assertion of undue authority, not vested in the trustees; and looking on it as the small wedge by ‘which their orthodox principles on the all-im- portant point, the separation of the sexes during Givme worship, shail be set at nought, and pro- Iniacuons mingling of the sexes, the pont sought for by the reiormers, shall be allowed, nave formed a #olid iront to repel the innovation. ‘nt In the Court of Com- » & religious corporation city, Moses Strassburger make a temporary injunction permanent enjotn- ing the congregation through Strassburger and other trustees of the congregation Bual Jeshurun, co-delendants, from permitting the omiscuons assemblage of the sexes dur- Jog divine worship 1% said synagogue, and from depriving the plaintif® of the peaceable and lawfal use, occupation and enjoyment of his W In the synagogue according to the terms of in contract by which he purchased it, and from us applying and employing the and Moneys of the said corporation tp carrying into effect, in whole or in any of the uplawiul, unconstitatioual, irreli 8 and irregular acts embodied in a resojution adopted at @meeting neid by said congregation on the 16un of May fast, ko, When the case came up yesterday before Judge Larremore the court room was princi pied by the orthodox and the refoim Jews of the congregation, Who iistened with great interest to counsel om elther side as they presented to the Ovart the points at issue, particularly the argu- ment of Mr. Goodhart, of counsel for the piaintut, ‘who Cited at great length from the Talmud and the Bible authorities in support of his orthouox client, while nis listeners recognized in him—out- ide Of the case—one O! the most radical of the zefor! |. As far as the ‘threatened action of the trustees with to their appropriation of the churco funds went, he claimed that all the 1 author itres on the subjeot—the-tormal decisions oi the State courts—nhave been overruled by a statute passed by the |: it latare of the State, Marci 29, 1875, Which declares that the trastees cannot in any Manner change or apply the charch prop- for any other purpose than in accer with tne rules and Soyer eb rights and disci of the denomination fur the good of whic Corporation was organized. Mr. Townsend Claimed on this point that the *tatute referred to did not do away with the a cisions of the courts, and that the decision made Larned was made after the passage of conclusion, that the trostees bad nig! the church edifice im accordance with the wisues of the ma- jority of the congregation, ana to apply the church funds in effecting such alterations aa they —— proper. ir a@ protracted session listening tothe ar- gument of counsel the Court touk tue papers aud Teserved its decision.
