On the reassembling of the Court of Oyer ana Yerminer yesterday morning, Judge Barrett on tbe bench, no cases were ready for trial. Moses Ehrich, indicted for receiving @ portion of the bonds recentiy stolen from the Adams Express Company, Was airaigned tor trial, but the trial ‘was postponed to a week from Wednesdey. Other cases were also set down for tri, when, there being no further business, the Court adjourned till to-morrow. It was announced yesterday in the Supreme Court, General Term, that owing to the absence of Judge Westbrook at Albany, who was on the bench at the time of the argument of the appeal trom the order refusing to discharge Willlam M. Tweed on a writ of habeas corpus, that the de- cision in the case could not be given then, as pre- | viously announced. As soon as Judge Westbrook | tomes to the city the decision will be given. Meantime the promised dectsions in cases argued At the January Term were postponed on account of the non-attendance, from illness, of Judge Davis. When the Police Commissioners took steps to prevent Adolf Neuendorf trom giving theatrical entertainments on Sunday nights he applied to Chief Justice Daly, holding Special Term of the Court of Common Pieas, for an injunction against the Police Commissioners, restraining them from iteriering with bis giving theatrical entertain- ments on Sunday. Judge Daly decided in favor of the Police Commissioners, An appeal, on de- mnurrer, was taken from this decision to the Genere al Term, when the case came up tor argument yesterday betore Judges Loew, Larremore and J. F. Daly. About the same line of argument was made on both sides as at Special Term. Mr. Henry Wehle, on behalf of the appellant, Insisted that the act of 1860, entitled “An act to | preserve the public peace and order on the first day or the week, commonly called Sunday,” and by which the Police Commissioners claimed a right to prevent theatrical exhioitions on Sunday even- ings, 1s unconstitutional. He cited various author- {ties upon this pot, and laid special emphasis on | the fact that the subject matter of the act 1s not expressed by the title, The only object of the » he contenved, w as to prontoiy theatrical per- jormances on Sunday, the probibition of some- thing that had been formeriy permitted, Tnere Was, he further contended, in the title no intima. tion that the statate Was designed to accomplish “ an object. Mr. A. On the 4th of July, 1872, there was a violent rain | storm in the city. The result of it was that the | ewer in 120th street became filled with sand to such an extent as to force back vhe sewage Andrew Smith, atthe corner of 129th street and Broadway, which be used for storing hardware, oils and paints. Mr, Smith brought suit against the city for damages, which resuited in dismissal of the Complaint on the ground that the city, not having been notilied of any delect 1p the sewer prior to the overtiow, could not be Charged with Regligence. An appeal was taken from this jadg- ment and the case argued at great length vester- day in this Court. It was insisted for the plainud’ that it was the duty of the city to keep the sewers in good order and repair; that it 1s lable for damages arising from omission of such duty, and that notice to the city o1 the defective coudition of the sewers is not necessary to fix ite liability tor damages, On the other hand it was argued’ that to enabie the plaintit® to recover he must show either that there was some inherent delecy in tue | sewer, caused by tts faulty construction, or that the sewer, though properly covstructea, had been yerilited’ by the city to’ become so stopped up before the overflow as to be the direct cause thereof, and that notice, either active or construc. tive, must have been brought home to the city prior tu the accident. On this ground it was plain that the appeal should de dismissed. The Court took the papers, reserving its decision. SUPREME COURT—CIRCUIT—PART 3. Before Judge Donohue. LUMBER FOR THE DOCK COMMISSION. James Bigier & Co., lumber dealers of Newburg, have brought a suit against the city for $66,127, balance claimed to be due for lumber furnished to tne Dock Commissioners, The trial was begun yesterday. The deience iy that the contract was @ fraudulent one, and that the quality of the lumber did nét come pe to the specifications of tne contract. The trial will probably occupy a day or two.
