Rhodes, one of the eight bidders for the contract to print the City Record, awarded last year, was dissatisfied with the rejection of his ‘bid, which was the lowest, while Martin B. Brown, whose bid was the second highest, obtained the contract. Mr. Rhodes took active steps to break the contract, The matter came before Judge Pratt, in Sapreme Court, Chambers, last July op an order granted to plaintiff's counsel, Mr. Richard O’Gorman, commanding Mayor Havemeyer, Com- muasioner Van Nort and Mr. EB. D. Smith, constituting the Board of the City Record; Comp- troller Green and the said Martin B. Brown to show cause why they sbonid not be enjoined from carrying out the contract. It them ap- peared by the answer submitted that Brown's was the only tender which complied with the requirements of the statute. A rejoinder was ‘made on behalf of Rhodes that his tender substan- tially complied with the statute and Iiteraliy with the advertisement for bids and was the same as In ‘the previous year, and that no imtimation had been conveyed to him that anything else was re- quired, The case was then left with the Court. Benjamin Griffin vs. John De Wilde and F. B, Betts.—Tnis action is brought upon a promissory note for $530, which the defendant Wilde made for the purpose of assisting the other defendant, Betts, sued as indorser, and by him sold to the Plaintif. The plaintiff testified that he purchased the note tor $500 upon the representation of Bett that it was good and given in @ real estate transaction and without fur- ther inquiry, while Betts acknowledges that he represented it to be good and did not say any He about its being an accommodation note. ‘De Wilde states that he gave it to Betts that he might get it discounted upon the promise that he ‘would protect it, and that he never received any part of the proceeds. Dofendant’s counsel claimed ‘that such @ note as the one in question was void in tts inception, that the plaintiff was not a tond Jide holder, not having put himself on inquiry as o the circumstances of its making, and thatin @ny case he had no standing in Court by reason of ‘the usurious transaction to which he was a party, ‘moving for a dismissal of une complaint on these ounds, which was denied. Judge Gross charged the jury that if they were satisfied that the note ‘was made by De Wilde and delivered 1o Betts that jhe might raise money ob it for his (Betts’) benefit, ‘and that the plainti! dict must ve rendered in favor of the plaintif for its face with interest. Verdict in favor of plaintif for $544 13, lahon. Jadicial Rebuke to Jurors. At the opening of a jury trial case on Wednesday in the Marine Court a judicial lesson was read to jurors, which it would seem strange should be necessary were It not for the frequent evidences of the “ways that are dark” so often pursued by jurors. A jury being sworn in the case referred ‘to, Judge Spaulding (presiding) said :—‘Gentlemen of the jury, before this cage 1s iuitiated | wish to wemind you of the precise nature of your oath, It is, that you shall try all cases brought before you ‘strictly according to the evidence. The reason I ‘make this remark is this—as member of your ‘body, who also acted as a juror here yester- day, after his discharge from the case, in a con- versation had with the Court touching the case, I ‘was Jed to believe from what he said that he ch to pass upon the testimony in view of his own ex: perience and trom what he knew about matters and things {n general ratner than from tne lacts as yset forth in the testimony. COURT OF GENERAL SESSIONS, A Felonious Assault. Before Judge Sutherland, In this court yesterday Jonn F, Casey was found Guilty of an assault with intent to do bodily harm to Michael Benner on the 15th of August. It ap peared from the evidence tnat the defendant and five or six young men, who were laborers on the public works, went into the lager beer saloon of the complainant, and because he refused to give them beer without first receiving pay for it a quarrel ensued, the resuit of which was that Ben- ner was attacked and stabbed in the arm wi knife. Moulton made @ “statement” to the jury, the substance of which was that he saw & mag run out of the store with the cloth and pass tt to another man who dropped it on a dry goods box near the store. The men ran away and he (Moulton) was returning to the store with the property when he was selzed | by Mr, Lebmaire and those who ran out of the | store. The jury could not agree upon @ verdict and were discharged at a late hour. Willam McManus was tried and convicted of altempting to steal a silver watch irom the person } of Christian Daniel, on the night of the gth of August. He was sent to the State Prison for two years and six months. Acquittal. Stephen Brown was placed on trial charged with Stealing, on the 8th of August, $1,200 In money, | belonging to Peter Vedder. It seemed from the evidence that the complainant and the prisoner were colored waiters at Mr. Smith’s hotel, on Cen- tral avenue, and that at the time Vedder missed his money there was another waiter in the room. ‘AS there was no legal proof against the aceused the Judge directed the jury to render a verdict of not guilty. JEFFERSON MAREET POLIO COURT. Swindling Saulsbury. Before Judge Murray. Henry J. Saulsbury, who was arrested by Officer Slevin, of the Fifteenth precinct, on Wednesday morning, Was arraigned at the above court yester- day. Moses Kendall, clerk in the employ of Adam Partridge, No, 107 West street, testified that on the 18th of September Saulsbury called and bought from him vwo gallons of brandy, and tendered in pay- Ment a check on the Butchers’ and Drovers’ Bank for $75. This check was signed Mitchell & Bowen, As Saulsbury was supposed to be employed by Mitchell & Bowen, a frm Ser red at No, 436 Broome street, and for whom he was in the habit of making purchases, the check was accepted and Saulsbury received $65 tn change. It was subse- quently discovered that Mitchell & Bowen had no account at the Butchers’ and Drovers’ Bank, and that the signature to the check was a forgery. Judge Murray held him in $3,000 bail to answer. FIFTY-SEVENTH STREET POLIOE COURT. A Woman in Men’s Clothing. Before Judge Smith, A young woman, named Antonie Suleska, a na- tive of Bohemia, was found perambulating Third avenue, on Wednesday evening, in men’s clothing, and was locked up. Severe Treatment of Prisoners. The discipline exercised over their prisoners by the keepers of the prison attached to this Court is 80 harsh that it has become a matter of comment, and it is for the purpose of calling the attention of the Commissioners of Charities and Correction and the public that reference is made to it here, Some time ago the practice of ADS | food from being given to prisoners by outside friends ‘was referred to m the public prints, and it was discontinued to some extent. All they ask for is the privilege of walking in the prison room for an hour or halfan hour daily, and the room being a large one and suf- ficiently secure there is no reason why prisoners should not be accorded that privilege. Cromie, of the mounted squad, whose case has been under examination for some time for his brutal assault on Michael Ham- mill, as already fully referred to in the HeRaLp, ‘was held for trial on the charge yesterday at tis Court by Juage Sherwood, His Honor wished to send the case to the Special Sessions, but the prisoner's counsel obiected, and on motion it was sent to the General Sessions. Democrat.] From West Chester there comes to us the fol- lowing sad story of @ well meaning hen:—A man by the name of Lot Fithian, of that place, had been the owner of a hen that, to all appearance, was just like others of her tribe, except that she jad ceased to perform the iunctions of a well behaved madam chicken—she didn’t lay any eggs. This was all the more singular when it was observed that she did not show a disposition to “chuck.” The hen seemed to thrive and ate well, but it was evident she had something on her mind. She seemed weighed down with grief of some un- discharged duty. A few days ago Mr. Fithian killed the chicken, and on ‘dissecting her dis- covered twenty-eight full sized, well shaped ones, the only difference between them and marketable eggs being that they were minus the hard sheil. The cause of the poor hen’s despondency was now expiained. She had done her duty, had prepared her eggs for delivery, but owing tO some obstruc- tion nature refused to perform her share of the work. What would have been the ultimate con- sequences of this had the hen been allowed to live on we are not prepared to say; but it certainly ts & strange (reak o! nature, the-similitude of which we have never before heard of.
