Davenport admits that one Charles Hussey was arrested in October, 1872, for a violation of the Election laws, but denies that he “exacted trom said | Hussey unreasonable bail.” I.—That said John I. Davenport denies that he “im proverly reused to proceed with the examination of Said Hussey, ueglected to prosecute the charge against im or improperly postponed his examination until atter | the election, or thereatter neglected and refused to pros- ecute the case or proceed with the examination.” IIL.—The said John I. To the three paragraphs of this specification relative to the case of Jeremiah Keeley, the said John ] portdenmieseach and every allegation material to the ebarge made in said specification and paragraphs, CHARGE SECOND. The said John L Davenport for answer to this charge Genies that he “has vioiated his duty or that his conduct has tended to degrade the administration of justice.” SPECIFICATION FIRST. The said John I Davenport admits that during the month of October, iS71, he upon one or more occasions called at the Jackson Club, in the city of New York; but denies that he “there took’ the affidavits of one Patrick Connell alias Gallows Pat, and one Barney McGaffne complaining of a violation of the Election laws by o16 Bernar, il, then @ candidate for Alderman, and one Grogan,” or that at said time and place, or at said place at any time, deponent ever took any aiidavit of any kind or character whatsoever. SPECIFICATION SECOND, The said John I.
