| THE COURTS. Irregularities of Police, Magistrates—Further Strictures by Judge Donohue, The Fianagan-Angel District Justice- ship Controversy. During the present month only Chambers of the Supreme Court will be held and the special terms of the Superior Court and Court of Common Pleas, Judge Westbrook will preside at Supreme Court, Chambers, Judge Curtis at Special Term of the Superior Court and Judge Robinson at Special ‘Term of the Common Pieas. There will be a session of the Superior Court, General Term, on Monday Jor giving decisions, FILING RECORDS OF CONVICTION. —+—__—_. The case of George Donovan, who was fined $10 by Police Justice Morgan jor applying an opprobri- ous epithet toa policeman and then committed to the Tombs in delauit of $1,000 bail, was again before Judge Donohue in Supreme Court, Cham- bers, yesterday. His counsel had asked his dis+ charge on iabeas corpus yesterday, and & postponement was had at the request of Mr. Dana, the Assistant Diswict Attorney, to enable the Police Justice to make @ further return if he desired. Mr. Dana yesterday said that Justice Morgun uad sent him a communi- cation, in which he asserted that the law did not require a record of conviction to be filed with the Clerk of the General Sessions, and he wished to be informed by Judge Donohue whether it was neces- sary. Mr. Dana said he had told Justice Morgan it ‘Was not necessary to return the record to the Ses- sions, but that Ne should nimself keep a record, both for his own and tue prisoner's protection. ‘There was no record of the conviction in this case, and if His Honor thought it was necessary, Mr. Daua said ne would like him to so state for the in- formation of police magistrates. Judge Donohue—Don't you think so ? Mr, Dana—I do. Prisoner’s Counsel—The statute expressly re- quires it. Judge Donohue—I don’t very well see what pro- tection there can be lor the defendant unless a record is Kept. He might be committed over Again on an old offence. 1 think it 18 a careless Way for justices to do their work and amounts to ross negligence, though I don’t think it was a Wanton offence in this ca: The prisoner was discharged, THE TENTH DISTRICT JUDGESHIP. An action, it will be remembered, was com- menced some time ago to oust Judge Flanagan from the office of Justice of the Tenth District Court tn this city, to which he was elected at the last November election. Though the suit was * Drought by the Attorney General and is in the na- ture ofa quo warranto proceeding, the real party instituting the proceedings 1s James R. Angel, hia competitor for the position. The original com- plaint simply set iorth irregularities in the elec- tion; that it was premature, and that it was car- ried on under the forms prescribed for Westchester county instead of under the laws relating to New York county. A motion was made yesterday in Supreme Court, Chambers, before Judge Dononue, founded mainly on the afiidavit of one Videto, to amend the complaint by alleging actual fraud in the election. It Seuss irom the papers read on the Mvtion that Judge Flanagan received a majority of all the votes cast and that the Board of County Canvassers awarded to him a certificate of elec- tion, and that he has siuce periormed the du- ties of his office and drawn his salary, although Meanwhile first having to sue and obtain judg- ment bejore the Comptroller would pay him. The singularity about this proceeding now is that Mr. Angel, the deieated caudidate, not only claims that Jadge Flanagan was elected a year in ad- vance, but claims still further that if the Court should decide against him, that then he should have leave to set up traud on the ground ot re- peating. Judge Flanagan indignantly denies that aby repeating was carried on on bis part, but al- leges that Angel did have repeaters young for4 him, and thus reduced his (Flanagan’s) majority. Rebecca S, Totten has brought suit against Richard totven for divorce, and yesterday there was presented to Judge Donohue, in Supreme Court, Chambers, a petition for alimony and coun- sel fee, The complaint and petition merely set up @ marriage and abandonment, without giving any statement of the form of marriage, which, how- ever, her counsel stated was of the Brinckley pat- tern, Tne defendant denied any marriage, and averred that she was hired as a servant in his house at $20 @ month, and after some months was Paid off to her satisiaction, and after a brier ab- sence again returned on the same terms. She was retained aiter the term jor which she was hired at her own request, and went with him to his mother’s, at Bound Brook, N. J, While there ‘he found her one night in his bed, and ordered her to quit the house, for which she entered a complaint, giving her name as Kebecca L. Turock- morton. Motion was made by ber couasel, Mr. Peter Mitchell, for leave to put in answering Papers to establish the marriage, and to explain the papers on the other side, which Judge Dono- hue refused, hoiding that the allegation as to there having been a marriage was fully met in the resent case, and that sucu new allidavits might used in another motion for alimony, COURT OF SPECIAL SESsIons. Before Judges Flammer, Wtterbourg and Smith. Among the cases of assault und battery at the Sessions yesterday was one of a peculiar cuaracter, in which John Peppér and Join Fitzgerald were ‘the principals. From the evidence in the case it appeared that Fitzgerald, who is a laborer, went home and there found Pepper in company with a strange young woman in wis apartments. Mrs, Fitzgerald was lying 1 the middle of the floor with an empty brandy bottle clutched resolutely in her Jett hand. Mr. Fitzgerald was very much aston- ished at the presence of strange people in his room and ordered them out. The semale got out with much expedition, but the man was rather tardy, and when Mr. Fitzgerald attempted to assist him he was hammered on the nose with great eifect, as his two black eyes yesterday attested, Pepper, ‘who is from Massachusetts, was sentenced to the City Prison for thirty days. Sheep and Dog Stealing. Andrew Johnsun and Thomas Smith, two boys, ‘were sent to the Island for five months each for stealing a lamb. John McCallough was sent to tne City Prison for thirty days for stealing a Newfound- land pup; and Jack Mooney got five montis for ‘whipping his mother. TOMBS POLICE COURT. A Dishonest Porter. Before Judge Flammer, Albert Ratter, a German, who has been employed by several firms on Broadway lately as a porter, ‘Was arraigned at the Tombs yesterday. In each of the places in which he has been employed he has been guilty of tmeving; but it was not until yesterday that the detectives succeeded in gather- ing evidence of his guilt. When the officers searched Rutter’s house they found thirty-six pawn tickets, which investigation proved were for some of the goods the prisoner had stolen. His aifferent robberies amount to about $2,500, but dates can only be xed Jor about $700 worth, Rut- ter was held in detault of $2,000 bail to answer at . the General Sessions. Inviting Dishonesty. Daniel Kennedy, of No. 18 Varick street, yester- day charged Annie Foster, a disreputable female, ‘Whom he had taken to his tudgings, with having stolen his watch and tobacco box, in all to the ‘value of $200, Annie was locked up.
