In the United States Vourt yesterday a suit for the forieiture and condemnation of thirty-four cut diamonds, four diamond rings, a quantity of gold bracelets, rings, studs, &c., was entered. It is glieged that an attempt was made to smuggle the erticles from the steamsbip Spain, but it was thwarted. No one has Jaid claim to the jewelry, but {tis thought that a man named Wilkins, a Chicago pawnbroker, is the owner. ARRESI OF THE REV. COWAN. Alleged Ingenious Attempt to Defraud JOHN the United States Treasury—Examina- tion Before a United States Commis- sioner. A peculiar case of attempt to swindle the United States Treasury was developed yesterday belore | United States Commissioner Shields. One of the defendants claims to be a minister of the Gospel, and the tacts are somewhat interesting. Rev. Jobo Cowan, who is charged with this attempt to dejraud the government out of $1,000, states that he was formerly a chaplain ip the Sixth New York heavy artillery, and resides at No. 510 Canal street, In this city. He mae an affidavit at the sugges- Vion of officials of the Treasury Ofice in this city which explains the preliminaries of this somewhat Ingenious alleged attempt at swindling. This affidavit, together with the fragment of bond, was forwarded to the Treasury Department in Washington, and subsequently a letter was re- ceived from the same quarter by Cowan, asking for farther information, to which he sent the follow- tug reply :— . No. 510 Cana STREET, New York, August 3, 1874. } DEAR S1R—I received yours of the 29th ult., in- forming me that you had received miine of the 26th ult, in relation to the destruction of $1.050 bond jo. 4,146, part of which was enclosed. You ask sor (urther evidence, setting tortn whether or not the bond in question is a United States security, Yes, a United States bond, five-cwenty coupon, of 1867, under act of Congress March 3, 1865, July 1, 1867, interest payable January and July. My reason jor not presenting the oond in ques- tion was—viz.: I was injured in the great ex- piosion at aay Point, Va,, on August 13, 1864, and soon after | recetved the oond I went to Europe to try and get well, but I got worse and was com- pelled to remain in London » 4 to June, 1874, and all the time believing that it would be all rignt when I returned to the States again. The fragment of bond in question 13 about fonr inches in length by about four in breadth. This fragment was submitted tor examination to the Superintendent of the Engraving Department at Washington, w@o reported as follows:—“I have made a careful examination of the attached rag- ment of what purports to be the remains of a #1,000 bong, No. 5,145, and which, according to the sworn statement of the Rev. Jonn Cowan, has been presentea to the Assistant Treasury office at New ork, to be redeemed as a government issue. {find tnat the work wus engraved and printed by the National Bank Note Company, of New York, and, likely, for ove of the South American states, as under the denomination counter will be ol served the top of the lettering, engraved in script, the Spanish words, ‘Presidente de la." On this report Mr. J. H. Robinson, Acting So- licttor of the ‘ireasury, sent back ail the papers to United States District Attorney Bliss, with in- stractions to prosecute the parties concerned. Assistant District Attorney Purdy took charge of the case, and under his directions al! subse- juent movements tor the capture of Cowan were aken. He suggested at the Treasury office in this eity the writing of aletter to the reverend gen- tleman asking nim to call yesterday morning With any additional evidence le might lave as to his claim. This ingenious device had its effect, Cowan turned up yesterday morning with a wit- ness named Kahce and presented an affidavit made bapa gentleman, as follows :— John Kahoe, being duiy sworn, says that in 1367 he well remembers negotiation on behalf of the Rey. John Cowan with one Hans Bahr (a German) and receiving as part payment of a debt then due the bond im question—viz., No. 5,145—veing a United States security of $1,000, a coupon bond; and that on Mr. Cowan’s return irom Europe in 1874 he had reqpeny seen the same coupon vond of said No. 5,145 in the said Rev. John Cowan’s possession. Botn parties—Rev. John Cowan and his witness, Joun Kahoe—were thereupon, to tneir great sur- rise, arrested and immediately prougnt before ‘nited States Commissioner Shields, who held them each im $5,000 bail to answer. CHARGE OF ROBBING THE UNITED STATES MAILS. A clerk in the Post Ofiice named John L. Carey ‘was yesterday brought before United States Com- missioner Shields charged with stealing letters while passing through bis hands and appropriating their contents. It 18 alleged that Carey has been @ suspected party for some time past, and that in consequence he was closely watched. On Satur- day he was seen to leave with a package, and was Jolluwed by Special Agent Sharetts and a police- man. They permitted him to proceed to the cor- her of Thirty-nintn street and second avenue, where he was arrested. Upon bis person were found 540 letters, unopened, together with $50 in Money. For the past two or three days a number of letter boxes in the neighborhood of Broadway and Bond street have been broken open and rifled of their contents. Postmaster James at once placed the subject in the bands of Superintendent Wailing, who instructed the police force throughout the city to keep & sharp lookout upon all the letter boxes. On Sunday night, at about ten o'clock, two men, acting suspiciously, were watched by Oficer Wan- att, of the Tweuty-ninth precinet. A man named Habel, a Chicago thief, who was caught opening a letter box corner of Third venue and kighteenth street last April, was con- victed and sent for thiee years to the Albany Pent- tenuary, Edwards stands a jair chance of keeping that gentleman company very soon. Mr. James gives due credit to Officer Wannasi for his vigilance, and proposes to Make application to the Commissioners ior permission to pay the officer the reward of $250 authorized by the government for the discovery of such cases upon the arrest snd conviction of the tnie!. IMPORTANT DECISION REGARD- ING PARTY WALLS. Am action was recently brought in the Equity Term of the Court of Common Pleas, before Judge Larremore, by Peter Daly vs. William H. Grind- Jey, to restrain the latter from breaking through a party wall to obtain the use of a fue constructed therein. As will be seen, the questions involved are of special importance to adjoining owners. When the matter was before the Court the point atissue was strongly contested by ex-Judge Car- ozo and Thomas H. Hawley on behalf of the progecutor, and by Messrs. Barrett, Redfield & Hill for the defendant. Judge Larremore gave a judgment yesterday for the plaintid, in the toliow- ing concise but comprehensive opinion:—‘*fhe wall between the houses Nos, 325 and 328 Henry street was constructed partly on each adjoining Jot im the year 1831, ior the common support of both buiidings, and has been so used Jor over twenty years. Morange submit- ted to the Supreme Court, General Term, charges against Richard B. Kelly witha view to distraining him. The latter, therefore, applied to Supreme Court, Chambers, lor an order restraining Mr. Mo- fange irom circulating the charges against him, he having caused, as alleged, 3,000 copies of such charge to be printed. Judge Donohue yesterday gave a decision upon thts application, embodying the same in the 1ouowing opinion:—“Application 1s now pending to punish th» respondent for acts alleged to be improper, and the applicant having resented the papers on such application, being afiidavit, it 18 alleged, 18 now circulating copies in that proceeding, and the respondent asks the protection of the Court pending the motion tuat the applicant be restrained from making use of this proceeding to injure him untu he is neard on that motion. he applicant claims that the Court cannot make tue order except on complaint filed. W. Lovatt, in the Court o1 Common Pleas, on the ground of cruel treatment. The ciild of these parties, a boy two years old, was brought yesterday beiore Judge J. ¥. Daly, on a writ of habeas corpus sued out by Mrs. Lovatt’s counsel, Mr. Morris S. Wise, with @ view to recover custody of the child, The moving aMidavits represent the husband as being an unfit person to have care of the child, he being addicted, as alleged, to drink, and when under the infuence of liquors being very violent. Among the atti- davits is one by Y. Thomas Carroll, No. 460 Sixth street, who states that on one occasion when Dr. Lovatt was intoxi- cated he entered his wife's bedroom and threatened to shoot her, crying ont, ‘Me have Indian bieod tu my veins—me shoot—me kill,!’ which threat Mr. Curroll avers he prevented beiug executed, Mrs. Lovatt’s counsel stated that last March she was obligea to leave her home, taking the child with her to her parents’ residence, in Brooklyn; that the foliowing day her husband calied upoa her to induce her to return; that she refused to do so, and that then he took tne child out, under pretence o1 getting it peaches, and carried 1t off to New York. Mr. F. F, Vanderveer, counsel for the defendant, read numerous amidavits on the other side, contra- dicting every materia! allegation in the complaint, and representing the doctor to be a gentleman of sober and perfectly correct and proper habits. ‘The deieuce also represenis that all the trouble was caused by some Of the wife's relatives alienat- ing her from her husband. Sou; Our readers will recollect that about the 18th of July last one Robert G. Watson, who, with his Jam- ily, was boarding at the Occidental Hotel, in the Bowery, in this city, was arrested by Detectives #ampson and Fariey for having given to his Tand- lord a $1,000 United States five-twenty registered bond, in keeping or @s security for his board bil, he being at the time in arrears forthe same. The keeper of the hotel sent the bond to the Treasury Department, where one of the endorsements was pronounced a forgery. Moreover, the number of this bond corresponded to the number of a regis tered bond which had been issued to a mun by the name of Robertson, of Indiana, and who about a year previously had been robbed. His name had been doubtless removed by some chemical process, and the name of Robert G. Watson inserted, this piae- ing the party ina bad fx. After his arrest he was taken before United States Commissioner Osborn for examination, who held him to ball in the sum of $10,000, being unable to obtain which he was committed to jail. ‘This Robert G. Watson is an oid offender, and is passing under an assumed name. His real name is Thomas 8. Cassidy, and he formerly held some position in the navy, from which he was dismissed for some irregularity, He afterwards turned up in s new role, for while boarding in the city of Brooklyn in 1866 he stole from Ann M. Leonard some United States bonds Vajued at $1,000, was arrested and indicted in 1867, under his true name, Thomas 8. Cassiay; but from some unexplained cause he was not tried unttt April, 1668, when he was found gullty and wentenced to State Prison at Sing sing for five years, from which, it 1s satd, he was for some rea- son released. After he came out he assumed an- other name—whether that of Robert G. Watson or not it is difficult 10 say, as such men readily change their names when desirous of covering up their crimes. This same culprit procured a check from J. Oisco & Son for & small amount about two years ago, under the name of P. Co. and by the usual means substitute: on the face of the check the amount of $7,000, and deposited it in one of the banks of Washington, D. C. His next move was to draw against this deposit. The manner of Cassid, groused suspicion, He was put off for a shor’ time. Meanwhile the cashier of the Washington bank telegraphed to New York, and the check was Pronounced to be a forgery. Cassidy in the mean- while “smelt a rat,” and ieft tor parts unknown. Ails parents live in Washington, and are satd to be quite respectable, 1t has also been rumored that he ig the individual who escaped from the volice in Buffalo, where he was arrested on a similar charge.
