In the case of Owen Byrne vs. Edward Homlein and others, previously reported, Judge Pratt yes- terday rendered the following decision: — The evidence herein satisfies me that Carr was authorized to collect the mortgage prior to Sep- tember 9, 1869. For that purpose ‘he commenced & suit to foreclose the mortgage in the name of the art Of the District Attorney, announced that; e would not object ww the discharge of the jury, Judge Brady finally reluctantly discharged them. When askea how the jary stood, the fourth juror, @ German, told the reporter of the HERALD that they stood eleven for acquittal and one for convictiow, and that was the | Vote when they rook the firs? ballot. Roberts pressed ex-Mayor Hall's hands cagerly and thanked him heartily for the result, While the jury were out Roberts seemed to be confident of an acquittal. A HORRIBLE TRIPLE MURDER. The Murder in an Indiana Cabin—A Woman and Two Children Killed te Conceal Crime. The Cincinnati Gazette-ot Thursday has fall de tails of the fearful and bloody tragedy at Law- renceburg, Ind.,on Monday, by which a woman and her children were sacrificed owing to the licentiousness of @ flend or flends, who have no¢ as yet been identified. The woman, Mrs, William T. Bradley, lived in & cabin with her children avout two miles from the town, and had been alone with them since Feb- Tuary, when her husband went to an adjacent county to work. There is no house near except that occupied by @ neighbor, 800 yards distant. The last seen of the family alive was on Monday evening, but the facts show that the murderer entered the house during the night, and, after outraging the mother, killed her with an axe, and then, to prevent two little girls, Eliza Jane, aged eleven, and Rosanna, aged nine years, from betraying him, they were also despatched. The report says :— , The same instrument was used on ai The mother seemed to have struggled against her fate with her babe in her arms, & little girl sevem months old. The brute did not kill the iniant, bag its head bears marks of his violence, or of wounds received otherwise in the struggle. On the lef side ofits forehead ts a gash nearly an mch out but not deep. The right side of its head is also cut and its face and eyes are bruised, until last nig Ms ieatures were scarcely discernable. Its eyes are blackened ahd swollen until they are closed. ‘The only member of the ere te les escaped un- hurt is James, a little boy nearly four years oid, who must have bidden under the beds or other- Wise have escaped the axe of the murderer. The murders seem to huve been committed eart; on Monday night. The victims were all clotl when jound, showing that it was not alter the! had gone to bed. ft does not seem possiblé that could have been done on Tuesday morning, be- cause Mr. Strahley’s man was ploughing corn in the field very near the house all day. He observed the boy James often during the day. He followed him a good deal in the fleid, and was crying and crying “‘Mamma,’ but the man did not Yhink it unusual.” The boy is Dot as bright as chile dren usually are at his age, and cangot say anything beyond a very few simple words. There can be | no question but that, in the hands of this plaintiff, | the mortgage has been paid off and satisfied. The | detendant Hobe, being desirous of aiding the | owners of the equity of redemption, advanced the money to them to pay off the mortgage, and agreed with them to take and hold it as security for the money go advanced, The money was advanced by Hobe on'the faith of this agreement.
