Kemp vs. Nash.—In 1869, the defendant, being the owner of a lot of land on Fifth avenue, thirty feet . from Fiftieth street, and intending to built a house on it, agreed with Miss Livermore to build a party wall, which should stand two inehes on his and fourteen inches on her lot, be agreeing to bear tne ‘whole expense o! the wall. He built the wall and he house at the same time, placing bis fropt wall at the centre point-of the party wall, In 1871 Miss Livermore sold to Mr. Kemp, who now insists that in tront Mr. Nash can only use the two inches of the wall standing upon his own ground, and demands tuat the deiendant shall cut ix inches of his front wall, and upon ir. , reius ng Mr. Kemp commenced cutting it nimseil, woer he was stopped by an injunction from the Court. It was stated that there is no such person, and the motion was to change the award to Thomas Loughran or to unknown owners, Mr. Andrews, Assistant Corporation Counsel, opposed the motion on the ground—first, that the sourteen days’ notice Requlrs, by statute nad not been given, and sec- ond, that the Court had no jurisdiction, Judge Lawrence reserved his decision. Nathaniel Frost, a retired United States navy chaplain, took a room at tne plaintif’s house and there died, meantime having deposited with the defendants the bonds in question, Mrs. Morey claimed the bonds on an order purporting to have been given by the deceased chaplain. The point Bt issue Was whether this order was a forgery or Dot, this being the claim set up by the deience. Qvite a number of experts in writing were ex- amined. ‘The jury considered the document a forgery and On motion gave a verdict for the de- fendante. Modan leit with them 10,000 cigars. On a dark and stormy night in October some 25,000 cigars were stolen irom the place, including those of Mr. Mouan. Suit was brought to recover tne value of the cigars. Tne claim oi negligence was set up on the ground that no private watcnman was kept at their »lace; butit was suown that this was not the custom among warehonsemen. Before Judge Spaulding, August Wies ct al. vs. Uharles sulzer.—This action was brought to recover $665 58 upon a promissory note made by one Conrad Kerass to the order of the detendant, Sulzer, ana by him tn- forsed so that Kerass could obtain a toan of money of $1,000 from Messrs. Lassing, Wies & Co,, bank- er-, in Chatham street. Upon the maturity of the note the same Was not pald, and this action was brought to enlorce payment. The trial came on yesterday before Judge Spaulding, and the same de/ence was made by the indorser Suizer. ‘There was a confict of evidence as to whether the $50 was paid to one Bernard, a broker, for his services in procuring the extension o! time tor Miteen days or whetier the money went into the pockets of the plaintiffs for the same purpose. After an able summing up by counsel for their respective clients and an able charge irom the Court, the jury found a verdict in favor of the defendant Suizer, releasing him from lability a6 indorser. Before Judges Wandell, Morgan and sixby. James Gillen and John Perazzo were charged at this Court yesterday with placking live chickens. Officer Bradley swore that one chicken was alive during the plucking process, and lived for twenty minutes after it was thrown aside. Gillen and Perazzo both swore that they had pterced the chickens through the brain before beginning to pluck them, and that they died about three min- utes aiter the piercing. The Court accepted the Otticer’s story and sentenced Gillen to ten days in the City Prison, and Perazzo to one month on the basi» Run Over. On the 28th of May Henry Palmer ran over and seriously injured John Downs at pier No, 1 North River. Since that time Downs has been in the hospital under treatment for a broken ankle and bruised side, He appeared yesteruay against Palmer, who was remanded for sentence until Saturday, when, if a satisfactory agreement is not made, he will be sentenced. For some time past the Dry Dock and East Broadway Railroad have lost a great deal of prop- erty, consisting of oil, metal, &c. Tne Superin- tendent of the company iniormed Captain Murphy, of the Eleventh precinct, and he placed the case in the hands of Officers O'Connor and Sullivan. These oficers at once went to work to unearth the mystery, ‘They made a number ot inquiries among the employés, and on Wednesday Ofticer O'Connor was informed by Lawrence Quinlan, one of the workmen in the company’s shop, that another workman named John Hayward brought a can of oil to his (Quinlan’s) house on the 24th of April last ana asked him to keep it for him. The can of oil was identified by one of the clerks named Thomas M. Francis, who yesterday made a complaint against Hayward betore Judge Kasmire. Hayward admitted stealing the oil-and was held to answer at special sessions, A Car Driver Arrested. A Woman named Riker Wishatzki was knocked down yesterday afternoon by one of the East Broadway cars, the brake striking her on the head and inflicting dangerous wonna. She was taken to Bellevue Hospital, The driver of the car, James Connolly, was arrested by Officer Martin, of the Seventh prec.nct, Judge Kasmire held him in $2,000 batt vo answer. ‘nomas Slud, Kate Slattery and Bridget Burke, the three pickpockets who were arrested Wednes- day uiternoon by Special Officers Maloney and Wood, oi the Seventh precinct, were arraigned before Judge Kasmire yesterday morning and held 1n $2,000 bail each Lo answer at General Sessions. A young man, pamed Henry Dale, was charged by Valentine Kech with attempting to obtain goods under talse pretences, On Wednesday aiter- noon, it is alleged, Dale went into Mr. Kech’s place of business, No. 126 Thompson street, and said he had been sent by Mr. Henry Bopp, of No. 83 Mott street, lor three galions of branay. Mr. Kech said he would send the brandy to Mr, Bopp by one of bis own men. Betore Judge Sherwood. * Lawrence Connolly, of Sixty-seventn street, be- tween Madison and Fiftn avenues, was charged ‘with committing an assault on his wife, Mary, who was kicked by him and so severely injured that her Temoval to Bellevue Hospital became necessary. Connolly was held to await the result of his wile’s injuries. Grand. Larceny. Gertrude Sterling, of No. 131 West Fifty-sixth street, charged Mary Murphy with stealing from her a seal skin jacket and camel’s hair shawl, both ot in default of $1,000 bail. On Wednesday afternoon a disturbance was Third avenues, by the interference of some Irish laborers with others of a different nationality who were employed on a new building. George Eagle- hardt, the contractor, was badly beaten and bitten by one Jeremiah Murphy, who was arrested by Roundsman Webb, of the Nineteenth precinct, Johu Shields interiered with the roundsman and was arrested by OMcer Gerrity. Subsequenty OmMcer Cromie, of the mounted squad, arrested one Terence Mulligan, and in doing so clubbed | him pretty badly. Before Judge D&niels and Associate Judges. The case of Captain A. W. H. Gill, ex-Deputy Tax Col.ector, who is indicted on the charge of having embezzled city moneys, was called for trial yester- day morning. Distinct Attorney Winslow was ready to proceed, but Mr. Tracy, for the defence, asked for 8 postponement, on the gronnd that he was then engaged inthe trial of the Sixth ward election fraud case, In the City Court. Mr. Tracy also said that ex-Coillector Badeau was a material witness for the deience, and Mr. Badeau was coa- fined to his house by iliness. The defence could NOt proceed to trial in his absence. Mr. Winslow said tuat if the Court adjourned he would like it to adjoura until some day next week. Judge Daniels repiied that he would have to ad- Journ the Court unrii July, After some jurther discussion the trial was post- poned until July. The counsel, in the meanwhile, will agree upon some day in that month for the trial to proceed, OITY OOURT, The Election Fraud Case. Before Jadge Reynolds, The trial of Alderman James Dunne and John J. Campbell on the charge of frauds at the ballot box in the Sixth ward, in 1871, was continued yester- day morning. Counsel for defence objected to the appearance of Mr. E. W. Gileert for the people in conjunction with S, W. Morris, but Messrs. Gilbert and Morris showed their authority and were allowed to go on. There was considerable testi- mony taken yesterday similar to that adduced on the trial of the inspectors of election some time since. The particulars of the frauds io the Sixth ward have been published and republished and have got to be an old, old story. Dunne and Camp- bell were poll clerks, and the charge is that they stuffed the bailot boxes and wrote the names of mythical voters on the poll lists. ‘Tne trial will possibly continue several days yet. , COUNTY OOURT, The Law’s Delays in Brooklyn. Before Judge Moore, Some time in January or February last eight or nine workingmen, according to affidavits sub- mitted yesterday, employed at the Columbia Flour Milla, Atlantic Docks, Brooklyn, sued Thomas R. Gordon, the lessee of the mills, for balances of wages due them, ranging in sums of $30 and up- wards, and amounting in all toa little over $500. Gordon evaded the service of the summons as long as possible, and then, when forced into court, at Jast, resisted the trials on one pretext or another, ‘uutil Judge Morse tinally tried the cases and ren- dered judgment foreach of the plaintiffs im the amount ciaimed. Costs were paid, executions issued and returned unsatisfied.
