Habeas Corpus—Discharge of a Soldicr— Scene in the Court House. was brought before Judge Blatchford, in the United States District Court, on a writ of habeas corpus. South- had enlisted, on the ground that he was not twenty-one years of age. Scarcely had he got to the door of the Court room, on his way out of the building, when Deputy Marshal Dowley presented to him a warrant for his arrest ona charge of perjury. The father of defendant, a respe: able looking man, ‘made an effort to make way for his fon, ‘The father dnd the Marshal got into an altercation, aud young Southerton, who nad gone some distaucé down tne stairs, returned, and came to his father’s as- sistance. The readers of the Henaup will remember that a suit was brought in the Superior Court by Mrs. Avery D. Put- nam to recover damages from the Broaaway and Seventh Avenue Railroad Company for the death of her husband, killed on one of the company’s cars, as she al- leged, through the negligence of the conductor and driver of the ear in, not putting the murderer off when requested b; Putnam. It will be remembered that His Honor Recorder Hackett postponed passing the sentence of death upon William J. Sharkey, who.was convieted of murder in the first degree in shooting Robert Dunn, till vesterday. This was done in order to affora the prisoner's counsel time to prepare to argue a motion for a new trial. An early hour was fixed for the argument, so that the room vofthe General Sessions was not uncomfortably crowded, Sharkey occupied a seat beside his counsel, Messrs. Beach and Brooke.
