The bill pro- vides that “the first two” magistrates “‘appeinted” shall hold office for the term of ten years. The second or next “two”? who shall be “appointed” shall hold office for nine years, and 80 on. This implies, if it impiies anything, that the names shall be submitted to the Board in “twos,” and that their terms of office shall be defined by the order in which they shall be “appointed,” not in the order in which they are “nominated.” Of course the actof “appointing’ is only comple’ when the nominations are confirmed and the per- son’ has duly qualified by taking‘the oath of office and receiving the Mayer’s warrant. The spirit of the act doubtless means that THE BOARD SHALL ACT first upon the two first names sent in ‘by the Mayor, and that in the order of his nominations the terms of office shall be defined, But it is easy to perceive how the Aldermen may, if they have in their possession all the names at one time, reject the first two, second two, the third two and the fourth two, and, by confirming the filth or last two, assign them to the incumbency of the long term of ten years, when, in fact, the Mayor, with whom the appointing process originates, contemplated that these two last nominees should hold ofice tor the short, or six-year term. The Mayor has no power to renominate a candidate who has been once rejected; but the Aldermen are expressly empowered, at their discretion, to re- cousider the vote by which they retused to confirm a candidate, and may ‘then proceed to confirm him. It will thas be seen how, by rejecting the first four “twos” and confirming the last “two,” the Board may next proceed to reconsider the re- Jections and ultimately to confirm them all, and thus, BY A LITTLE SHARP PRACTIOR, Tegulate as they choose, by the order of confirma- tion, the terms of office of the nominees, The law requires merely that they “shall take action” on the nominations “in the order tn which the nomi- nations are made.” To refuse, by 2 vote, to con- firm is to “take action,” within the meaning of the provision of the bill, Jt will be thus seen how deli- cate a matter it will be for the Mayor to trust all | the nominations in the hands of the Board at one time, unless it can be held conclusive, as above suggested, that the “appointment” ts not complete until the Magistrate clect 18 sworn in and has is- sued to him tis warrant. Certainly he cannot ex- | ercise the functions of his efice until his oath ts re corded and his warrant issued. Of course if this is sound reasentng the two first sworn in or qualified by the Mayor will be “the two first.appointed,” and | the Mayor may thus determine Orme when the Aldermen have done their share of the business, what are the terms of the respective officials, All the provisions above referred to are contained in Sections ix and ten of the bill. THE CENTRAL PARK LABORERS. Meeting of Park Laborers in Demilt Hall Last Night—750 Men Out of Em- ployment—A Committce of 100 Men to Call on the Board of Aldermen To- Day. A meeting of the mechanics and laborers lately employed upon the Central Park and.other public works was held in Demilt Hall, Twenty-third street and Second avenue, last night. Mr. James O'Reilly opened the meeting. He said it was time to show the authorities how much the laborers lately em- ployed upon the Park were suffering from the want ot work, Mr. D. S. Griflin was calied to the chair. He said one of the pretexts for the discharge of the laborers was because the Bourd of Aldermen had Teiused to act upon the nominations for Park Commissioners, Mr. Reilly then OFFERED THE FOLLOWING RESOLUTION. Whereas the indiflerence manifested by the majority side of the last Legislature concerning all measures in ‘the interest ot the <ses, and part larty as shown by its failiny to appropriate’ until a late day the necessary funds for the improvement of the public parks, thereby causing the discharge and consequent suffering of 1,000 the mechanies and laborers employed upon the public are now idle and in want, and must so continue the Commissioners are confirmed and assume their functions. Resolved, That a committee of 100 be now a) pointed y de. t upon the Board of Aldermen and respect mand immediate action upon the names presented tor Park Commussioners, thet being in our opinion the only remedy for the exising evils and the privations under which we suffer. The laborers were supposed to bear all the cuffs from those whom they had placed in positions of power, Assemblyman PETER Woops made a few remarks, He said he had gone to see the Comptroller, the Commissioner of Public Works, &., and asked them why the laborers could not be again em- ployed. He was told that the sufficient. Seven hundred and fifty men were now deprived of their opportunities to make an honest living. He had TALKED WITH SOME OF THE ALDERMEN, but had received no satisfactory explanation of the present state of things. The workingmen had no right to compel the Board of Aldermen to confirm the nominations made by the Mayor, bat they had the right to ask that these nominations be either contirmed or rejected—one or the other. He be sustained by all the honest workingmen of the city. (Appiause.) ‘The resolutions were then adopted.
