In the United States Circuit Court yesterday, before Judge Benedict, Simon Donaw and Christopher Flood were put om trial for alleged conspiracy to defraud the goverament out of the tax on a quantity of whiskey manufactured at the Spring Valley distillery, Rockland county, This case Was tried in a preceding term of the Court, when the jury disagreed, cight being for acquittal and four for conviction. On the present trial, which will Jast some days, the District Attorney prosecutes, and the defence isconducted by Mr. Thomas Harland. It looks ag if the case of Woodhull, Claflin and Blood, ‘who are indicted in the United States Circuit Court for sending obscéne publications through the mails, were to de postponed for an indefinite time. so as to enable the ‘Distrlet Attorney to produce in Court the indictment Againgt, the three parties aboye nained, and which in- dictment he tailed to bring in for the reasons stated on ‘the motion fo qtash made by dctentants’ counsel. Joha B. Simmons, who ts charged with the murder of \N. B. A Brace of Murderers Arraigned in the Court of Oyer and Terminer at White Plains. In the Court of Oyer and Terminer yesterday at White Plains, Westchester county, Judge Joseph F. Barnard presiding, Mathew Fitzgerald, the Yonkers wife strangler, and Lawrence Erhardt, who killed John Morrison at Melrose a few weeks ago, were arraigned, the Grand Jury having indicted beth for wilful murder.
