10 ARKANSAS. “The: Supreme Court Decides it Has No Jurisdiction. Baxter Trinmphant, While Brooks, Met} and Yonley Take Back Seats. End of the Remarkable Quo Warranto Contest. Litrug Rock, June 4, 1878, The, Supreme Court met this morning at ten @ clock to resume the quo tarranto suit against Governor Baxter. After the usual formulary and all the Judges had been seated, Attorney General Yenley rose to make the closing argument in be- ha of the people. Replying to the chief points made by Judge Compton yesterday, he said the paper in the hands of the Court would be good at eommon law in any State. He insisted it was far from his desire to imsalt the dignity of any man, and the demand that the writ ap- plied for should be made returnable in three days was Not so intended in regard te Gevernor Baxter. The paper was not merely infermation in the nature of a quo warranto, as his Jearned opponent had declared on the day pre- vions; he had ample precedent for the form a@opted in England under George iV., and slso in the courts of New York. He was willing, if the Gourt go desired, to strike out the name of Brooks altogether and proceed in the -matter on his own responsibility. A8 TO THE, SCOPE OF POWER exercised by the Supreme Court ne said it had a general grant of power which made it a Court of general jurisdiction, and in all cases it represents 11 people of the State, who proceed by their own revercign right. The constitution says the Legis- lutae is the place for Mr. Brooks to contest his suit with Mr. Baxter, but the people had a rig it to come to this Court. The constitution Sa)8 that all contested election cases shal be tried by the Legislature, according to the mode prescribed by them; hut there is no way prescribed Where, then, should the people go if Baxter and Brooks choose to arrange among themselves the matter in dispute? Mr. Brooks could also come into Court by a vill of rights, even if the Legisla- Sure were the place, as alleged. But suppose that the Legislature happened to be democratic and the ehief contestant a republican in politics, what would be the result? Why, they would tell the contestant to ‘go hence,” and it is almost doubtful if even a proper hearing could be had. Chief Justice McClure asked the Attorney Gen- eral if ne would strike out the name of Brooks from the document sought to be filed, Atterney General Heney— Fen I will take that responsibility. The Court then ordered a recess from twelve @clock until five this evening for the purpose of consultation. Governor Baxter, I am informed after the recess to-day received telegrams from Messrs. Clayton & Dorsey, saying that they acknowledged him as Governor, and will support him, whigh seems to @ispel the idea that Senator Clayton was ever Beartily in with tne opposition clique in their attempts to oust Baxter. DECISION OF THE couRT. The Coart met again this evening, at five o’clock, and Judge Grey waz authorized to render the de- @ision for himself and associates, Chief Justice McClure only dissenting. Judge Grey said they were of opinion that upon the paper presented to the Court the writ should not issue against Gov- ernor Baxter, and that if this were regarded asa contested election case between Brooks and Bax- ter the Court had no jurisdiction. The Court was then adjourned to meet again at the November term. ‘There is a genera! expression of satisfaction at the reguit of this threatening trial. Attorney General Yonley is of course greatly disgusted, while Chief Justice McClure has to take a back seat. ‘The decision, it appears, Was doubtful up to the Bast moment. THE MODOC MISCREAN SS. After writing my report of yesterday I rode to this camp and despatched it by courier. The captives and captors remained at Appiegate’s ranch. Before night Captain Jack, mur- @erer of General Canby, and Schonchin, ‘Commissioner Meacham’s would-be murderer, were troned together and placed with the other warriors ima small building adjoining Applegate’s house, wader guard. Neither Captain Jack nor Schonchin Spoke a word. Not a muscle of Captain Jack’s face moved. Scar-faced Charley protested against the indignity in behalf of his fellow captives, mod said that none of them intended to escape even if the opportunity cffered. He ebtained but little satiefaction, and retired in dis- gust. The usual Sunaay evening services of the Warm Spring Jndians were.dispensed with; in- @tead they held a glorious war dance until mid- night. They leaped and howled about the fre, and tmduiged in other demonstrations of delight. WASHINGTON, June 4, 1873, It is said by the highest military authorities that the Modocs could not surrender as “prisoners of war” in the sense known to nations where war is @eclared in accordance with constituted forms. Not having been so received, they are not entitled to consideration as prisoners of war. The orders issued to the commanding general @irectiy after the assassination of General Canby and Rev. BEACON PARK RACES. Second Day of the Meeting st Brighton— Boston, June 4, 1873. The Spring meeting at Beacon Park, Brighton, has thus far proved as successful, financially and otherwise, ag the most sanguine could anticipate. The attendance Tuesday and to-day was quite large, and the races have been fast and interest- ing. Horsemen from New York, Philadelphia, Al- bany and other prominent cities are present in large numbers, and nothing has yet occurred to mar the success of the meeting. The second day’s races occurred this afternoon and were well con- tested, \ THE 2:88 PURSE. The first engagement was between the entries in the 2:38 class, and of the ten nominations there were seven in the race. The purse was $1,000, the bulk of which went to the winner, while the second horse received $200, and the third saved his entrance fee. The starters were :—Jesse Smith’s gray gelding Horace Greeley, G. P. Carpenter's gray gelding Marshall, M. C. Carroll's sorrel mare Highiand Maid, T. 8. Carpenter's gray gelding Billy Platter, D. Bigley’s brown mare Lady Wentworth, A. D, Webber’s bay gelding Honest Brock and M, Rader’s bay gelding Penobscot. Among the pur- chasers of pools Highland Maid was the favorite, and previous to the start the rates of betting were as follows:—Highland Maid, $35; Billy Platter, $24; Penobscot, $15; fleld, $17. The horses were in readiness to start at three o’clock, and they eame to the stand with iady Wentworth inside High- land Maid second and Horace Greeley outside. THE START. Very little delay was had in starting, and when the word was given, Honest Brock shot away with a tremendous gait, and easily out-tooted his coin- petitors, He reached the quarter in 363; seconds, with a lead of four lengths, Marshall being in close pursuit, and at the half Brock was two open lengths in advance, in 1.15. He broke on the roadside, however, and from this point con- tinued to lose his advantage. Marshal! got to the Sront near the three-quarter pole, and he continned the lead the rest of the way, winning the heat by alength in 2:34; Billy Plat ter was second, Greeley third and Highland aid at the rear. It was then stated that the Maid was too closely hitched, and had been unabie to show to Rone advantage. Second Heat.—Marshall led the lot around the turn in the second heat, and he was followed to the quarter pole by Platter, Greeley, Honest Brock, Highland Maid; in that order the quarter was father in thirty-seven and a Half seconds. At the half-mile pole Marshall was two Icngths in advance of the second horse with Greeley, Penobscot and Platter follewing be- tween the half and three-quarter. Platter passed Marshall, and after a handsome race to the score he won the heat in 2:83% ; Greeley was second and Marshall third, Third Heat.—The drivers occupied consid- erable time in_ scoring for the next heat, and Platter, Marshall and Greeley made the first turn in a bunch; at the quarter pole Platter was leading and Marshall was second, with Greeley well up in the thira place. Greeley jumped and shied considerably on the turn, and took the pole on a run. He reached the second place betoee the half was passed in 1:14%.. Platter to the Shrco-quarter pole, when Marshall lapped him. grays made an excellent race down the — home- stretch, and, after passing the distance stand Marshall was carried to @ break and Platter won the heat by nearly two lengths in 2:31%. Greeley came home third, but was set back for running and the third position was given to Lady Wenworth and fourth to Penobscot, Brock having been withdrawn after the second heat. Fourth Heat.—Marshall led the lot away in the fourth heat and was tollowed by Greeley and Platter in that order; Greeley was leading at the quarter in thirty- eight’ seconds, and alter passing the quarter pole Piatter trotted away from Mar- shall and Greeley and was an open length in ad- vance at the half-mile pole, Marshall being third, At the three-quarter pole they were all in a buncb, and as they entered the homestretch Plat- ter was well in advance. He continued to lead the rest ef the way, and won the heat by a good length in 2:34X%, Greeley second, Marshall third, Wentworth fourth and Penobscot at the rear. The race was thereupon awarded to Platter, second money to Marshall and third money to Greeley. SUMMARY. The division of the purse gave $900 to the winner, $400 to the second and $200 to the third horse. The entries were Dan Mace’s bay mare Lady Rose, J, Lovett’s brown feiaton Ken Bruno, J. Prior to the start, however, Joker be- came a favorite. 2:36 THE START, When the horses received the word Lady Ross was trottmg handsomely, and she was followed to the Senne pole by four of tke field, who were all inaheap. Young Bruno then came out into the second place on the straight side, near the inner, Passed up so rapidly with Ross that at the half he ‘was only & head and shoulders behind. After passin, the half mile in 1:14 Lady Ross broke and ‘dro ped behind, and Bruno took the lead. Third Heat,—Tirrell got the best of the send-off in the third heat, and he immediately went to the front and took the pole, Ben Starr being second, as they made the first quarter; Starr was yoked with Tirrell at the quarter pole, which was passed in thirty-six and a half seconds; at the haif mile le Starr dropped behind id gave place to Joker, who made a id wrace Reith Tirrell on straight side near the Brignton road; Bruno then came up well and was lapped on Tirrell and Joker at the three-quarter pole, Joker being in advance by the length of his nose. POURTH HEAT. Tirrell led off well tm the next heat, and was in the advance at the quarter pole, ‘which was passed in 36 seconds, Bruno being in the second place. At the half-mile pole Tirrell was good length aheas soon alterwards Bruno, Ross and Joker closed with him. They hada fine race down the roadside, and Joker placed himself in front near the three-quarter pole. From this point the race was his own, and although Tirrell followed him sharply he continued to lead to the score, win- ning the heat and race in 2:294%.
