THE STATE CAPITAL. ‘Local Improvement Bill and the Rivalries for Péwer—The Difficulty Explained—Eighth Avenve Railroad Fare—Ezra Cor- nell and the College Boys— Senate Business. ALBANY, May 13, 1873. ‘Tae Committee on Cities of the Assembly held a Meeting this afternoon, and gave a hearing on the Local Improvement bill, which was called for fur- . Sher consideration the other day from the Senate. ‘There was a great hullaballoo about the passage of the bill by the House, and a great deal of talk about it that was not, as stated in the HERALD at Ghe time, justified by the facts of the case. What weally caused the rumpus was the fright ef Comptrolier Green that, if this bill ‘Was allowed to become a law, Commissioner ‘Van Nort would have certain powers which he coveted. The pill was thoroughly ex- weaned in allits aspects by Mr. John H. Strahan to 6 committee to-day in & way that dispelled all ‘the sensational reports that were made about it ‘@t the start. He contended that the bill wasa Jair and just measure and a necessity to the city, ‘and that’a bill similar to it had been drawn up at The request of Mr. Greeu and advocated by Mr, Hawkins. The torm of proceeding in the levying ‘of assessments, he said, had been changed by the mew charter and had left the city in A RATHER PECULIAR FIX as far as making assessments was concerned. By one section of itit was provided that no assess- ments for repairing could be made and the power had been taken from the Comptroller of making assessments for work already done. The billunder consideration covered the defect. He argued be- sides that the charter virtually prevented taxpay- ers from deciding for themselves what pavemen’ ‘they preferred, if they wanted patent pavements, and yet he contended that one of the best pave- ments inthe city was a patent one in South Fifth avenue. There was, he sald, a law passed in 1872 which created a commission to make contracts for city improvements and that in pursuance of the authority vested in them the commission had acted. Their authority was limited to ninety days and they gave certificates for all work done under their direction and some certiticates were given after their allot.ed term had ended. HONEST CONTRACTORS ‘who had done work and Aelnuy according to their contracts were thus, in many instances, debarred from receiving the pay really due them, for the reason that, a8 matters now stand, the Comptrolier an only pay for work done under tdirection of Bome head of department whose certificate can be shown ior the work performed, and yet the previous power ol the Comptroller had not been transferred to any head of depart- Ment by the charter. Many parties who had just claims, honestly done, could therefore not be paid unless tre bill under consideration was passed. It willbe seen that it was tnis particnlar Bituation of affairs that gave rise to the suspicions that the bill was intended simply to cover claims of no account. THE COLLEGE LAND SCRIP AND CORNELIL. There is aonsiderable talk to-day over the speech of Mr, McGuire in relation to the college land scrip grant and Ezra Cernell’s transactions therewith, and itis prarenis that an tye aaa will Ld had. ‘The friends of Mr. Cornell, it is said, will ask for an investigation, but there are no indications as yet that they will move early in the matter. McGuire asserts that the charges he makes can not be dis- Eyes: and he chalienges any mar te show that he facts and figures he cited mm his speech are not borne out by the official regords of the State. It is highly probable that the bfil which was the indirect eause of the alleged exposé will not be heard of again this session. | >< ~ tH® BROOKLYN CHARTER. When the Brooklyn Charter bill was announced from the Senate, with amendments, Mr. Worth moved that the bill be laid on the table, and that the amendments be printed immediately. He said $i rur-commitice Qf the Senate had taken this bi charge, and had made a large humber of amend- Ments, the purport and effect of which the House Knew nothing. ‘This was, he said, a very important bill. It was the first time in nineteen years the charter of Brooklyn had been amended, and he thonght it was eminently pope that the Brookiyn delegation, at least, should kuow what these mendinents were. Mr. Pierson said he under- stood that the amendments referred to were not material ones. They were simply pet eras ones. He deprecated any delay on this bill at this time. He thought it would be lar better to com- mit the billto a conference committee. The mo- tion to lay the bill on the table and print was car- ried—66 to 9. BILLS PASSED IN THE SENATE. The Senate consumed the entire day session in the third reading and passage of bills. Ameng the important ones passed were bills to in€orporate the New York Society for the Suppression of Vice; ‘to provide for the care of Washington’s headquar- ‘ters at Newburg; for the improvement oi Hudson River, between Coxsackie and bea] amending the Bleecker Street and Fulton Ferry Railroad bill, and ‘to incorporate the Financial and Cotton Press Com- pany of New York. BILLS REJECTED. A bill to amend the act for the formation of companies for mining, manufacturing and chemi: purposes, which was understood to be in the interest of news associations in New York, was defeated. A bill to make the District Attorneyship a salaried office, and giv- ing the District Attorney a salary two-thirds as Jarge as that of the Judge in each Court, was also jost by @ vote—8 yeas to 18 nays. The antipathy to this bill was such that it is a wonder it ever at- tained a third reading, for not only was it deieated in the ordinary way by this vote, but, being killea and buried, it was denied the ordinary courtesy of @ renewal by resurrection, being refused a recon- agideration by a vote of 6 to 20. Aneffort is to be made to-morrow to get Mr. Blessing’s bill in relation to THE EIGHTH AVENUE RAILROAD defore the Committee of the Whole of the Senate. It has been smothered in general orders for over a month. The company, it is said, are trying to keep m getting before the committee. The company they are willing to have an amendment made to the bill that the fare shall be reduced to five cents when all the avenue is graded. This implies that the avenue should be graded beyond 160th street, which will be an accomplished fact probably about twenty years from now. The workingmen ‘who travel on the road are opposed to any such amendment, and want the bill passed as it stands. The report of the Joint Committee on THE CONSTITUTIONAL AMENDMENTS recommending that the spevial session be dispensed with, and that the Senate proceed at once to con- sider the amendments, was received and agreed to gnd the amendments were made a special order for to-morrow night. SAD ACCIDENT AT HONESDALE, PA. Ca rieeatt ESR TD Port Jexvis, N. Y., May 13, 1873. Honesdale, Pa., was on Saturday evening the @cene of a terrible casualty. A new sewer trench that was being dug had been left by the workmen im arather unprotected condition, and a number of Uttle girls were running through it, playing hide @ndseek. While thus engaged a large portion of ‘one side of the trench caved in, burying beneath it two ofthe children, one named McLean ant the other Maunfish. A brother of the McLean girl gwaw the accident, and ran home at once and told his father. ‘The latter hastened to fi» and, seeing the fingers of one SF the” chicos’ freking “out above the surface, he at once commenced digging with his hands to uncover her jace. In a remarkably Drief time he succeeded in clearing the dirt away from her face, and was rejoiced to tind that bis daughter, after being exposed to the air, showed signs of life. She was extricated trom the dirt and goon regained consciousness. When her face was uncovered first it was as biack as a negro’s. The brother of the girl, woen he gave the alarm, aid not know there was another child buried with his sister. This fact was not known until the res- cued child was able to speak, when she at once re- vealed it. Three or four men at once procured shovels and commenced digging for the other Uttle girl <A large crowd had assembled by this time and the wildest excitement prevailed. At was several minutes beiore the body of the un- fortunate little one was uncovered. It wasin a sitting posture, with the head crushed forward on the knees. The littie girl had evidently been in- Stantly killed by the great weight that was upon her, She was badly injured internally. Like the McLean child, her face was black. The mother and sisters of the child were in the Crowd when her body was jound and their cries were heartrending. The father is an industrious German, a machinist, and had that day moved into the village. He did not know of the fate of his ehild antil he came into the crowd on his way home trom work. The trench had been pronounced un- safe, and the workmen were themselves afraid of tts caving in upon them. ANOTHER BRIDGE SMASH. An Accident on the Boonton Branch of the Delaware, Lackawanna and West- ern Rallroad. A damaging accident occurred about one o'clock gesterday morning on the Boonton branch of the Delaware, Lackawanna and Western Raliroad, mear the Barclay street depot, at Paterson, A short distance from this station Was @ 136 foot sin- gie span wooden truss bridge, which crossed the Morris Canal at an angie of about forty-live de- grees, About one o'clock yesterday morning a train heavily joaded with pig tron approached this bridge at pretty good speed, and just before reach- ing it one of the cars ran off the track.
