An oficial representing the District Attorney opposed the revival unless peni- tence and absolution done and granted was done and extended at the Star Chamber confessional. As will be seen from the subdjoined report of the preliminary proceedings Commissioner. Shields, befere whom it was absolutely necessary @eadnitiate some prosecution in the case, demurred to this wecret investigation, and, after hearing some of the points presented, particularly Assistant District Attorney McKay’s application for the Star Chamber hearing, strenuously set his face against It, and, as Commissioner of the Court, peremptortly ordered the investigation, ifit should, under such circumstances, be proceeded with at all, to be conducted in the usual way in open Court. This case appears to be one of those well known in connection with the alleged whiskey frauds of 1866, so often referred to and detailed at length in the columns of the HERALD. Motion was made, en limine, by Mr. De Kay, As- sistant District Attorney, to the Court, to hold the inquiry in private, on the ground that the publica- tion of the facts, 80 far as they have come te the knowledge of the government, would be prema- ture, and might injure several respectable citizens, There are some parties againet whom warrants have been issued in connection with the above or a similar charge, but their names are withheld from the public journals, as they have not yet been ar- Tested, Commissioner, however, decided that the case, ifproceeded with before him, must be held im open Court and in the presence of the repre- sentatives of ‘the press, as in all public prosecu- tions, one of which this really was, THE CHARGE. The defendant, Lewig Samuels, 1s charged in the United States Courts conspiring with others to defraud the government, in 1866, outof the payment of the duty on ten barrels of spirits manufactured at a distillery in Eighth street, in this city. Bi DeKay, Assistant District Attorney, said:—In this case it seems to me that it would be right and proper that the NAMES OF THE DEFENDANTS Tamed in the affidavits should got be exposed in the meyer or journals of New York city until something has been brought against them, Now there is only the simple aifidavit of one man, and that is not sufficient to justify the giving to the public at large all the names of those persons who may be brought up or mentioned in this case, and therefore he asked that there be no reporting of this case until there was something established it the parties accused. eCommissioner—I am placed in this position, I have to hold an open Court. I sit here oF ine nd I cannot, therefore, exclude reporters yublic journals, Bekay--Severai prominent citizens may be vo much injured by the publication of the facts set forth, and it Seger to me but just to them that nothing should be published until evidence is proved against them. The Commissioner—I sit here holding open Court, and if the examination goes on I cannot exclude the reporters. Mr. DeKay said :—There are some persons men- tioned in the afidavit against whom, possibly, nothing may be proved. Mr. Rollins, of counse) for defence, said that it would be better if there was no publication or ‘the facts until the evidence was in. The Commissioner—It would be well tf, in the ex- amination, the names of parties against whom no evidence is adduced should not be published; but if the case goes on in open Court | cannot help it, and cannot exclude the reporters. Mr. Harland observed that it both sides desired it there wus nothing to prevent the Commissioner from holding the Court in secret. The Commissioner—If the examination is pro- ceeded witn I cannot exclude the reporters from being present. At this stage of the proceedings a consultation ‘was held between the counsel engaged in the case, after which Mr. Pierrepont said he would ask an adjourn- ment ofthis case. Ue had understood that there ‘would be a meeting probably to-day, not to oc- re ad a a length of time. The District Atl has since told him that this case would Noccapy @ great length of time, would be pressed on and would take several days in its in- vestigation. The District Attorney Knew some- thing of his (Mr. Pierrepont’'s) ‘engagements, which made it not quite possible for him to go on for a whole day. ‘He would, therefore, ask an ad- journment until Friday at three o’clock, if that Suited all the parties. Mr. DeKay replied that he had no desire to basten the case unnecessarily. Rollins & Harland. THE BIENVILLE INVESTIGATION. Further Proceedings Ycesterday—The Evidence of Two More Stevedores— The Man Who Found the Matches— Expected Arrival of Captain Maury. The investigation of the loss by fire, on August 15, of the Pacific Mail Steamship Company's steamer Bienville was continued yesterday at No. 23 Pine street before State Inspectors Boole, Hill and Mershon. The evidence throughout was partly corroborative of that of Cummings, Howlder and Goldwater of the day previous, and the only im- portant point ofinformation was that which made manifest the position in which the lucifer matches Se: deposited and by whom they were discov- Charlies Hall, a stevedore, employed by the Pacific Mail Steamship Company, was the first witness ex- amined yesterday. His testimony was similar to ‘that of Patrick Cummings on the day previous. Witness gave testimony to the fact that, as far as he Knew, no matches were to be found stowed away in ‘the alter pi of the Bienville, where he = stationed, bat there might have been some in forward hold, the part where it was customary to place them. He saw about twenty odd cases of matches on the dock for shipment, but could mot say that they were put on board the steamer; nor had he any reason to bhe- lieve or suppose they were there after the steamer had sailed. He was certain that matches ‘were generally stowed in the fore part of the ship, but he did not see that done in this case. It was sometimes @ part of his employment to assist in stowing powder in the company’s steam vessels, but there was none of that material for the Bien: ville on the trip in question. The remainder of witness’ evidence referred to the respective post- tions of the different kinds of material on board, and in this respect was merely a corroboration of the evidence of Cummings on the day previous. Cases of kerosene oil were piled above the beef and pork; an ordinary plank of wood separated both materials. All the cargo in the hold he believed to be perfectly secure. John Kennedy was then examined. He was a Stevedore employed by the Pacific Mail Steamship Company; he helped to stow away the cargo of the Bienville in the lower forward hgld; instructions ‘were received from the upper deck in’ regard to the details of their work; witness distinctly remem- bered that the kerosene of! was piled in cases above the beef and pork, abaft of which were bar- rels of lard and tallow ; barreis of oil were placed on top of the cases of machinery ; there were about twenty cases of matches, which were put next to the oil and on top of the beef; some bales of waste cotton were lying near; this’ was in the forward pa the boxes 0 ches might have been ig- nited y& coming. in contact fgidenty with any Bcavy, material. At this) part of Kennedy's testimony—which seemed to the inspectors the most reliavle evi- dence yet given, that the matches were on board and in. dangerous position--a telegram was re- ceived from the Pacific Mail Steamship Company that Captain Slaves, formerly of the Bienville, now of tae boean Queen, would arrive in this city by the latter steamehip about the 20th inst.
