YORK HERALD, MONDAY, AUGUST “49, 187%-WiTH SUPPLEMENT. = BRAZIL AND THE BANDA ORIENTAL, huperialist Diplomatic Complications with tho People and Power of the Argentine Union. Dom Petiro’s Cabinet Reply to the Note on Post- Bellum Treaty Making—Territorial Occupa- tion and the Claims of tho Royalties— Paraguay’s Position on the West Bank of the Paraguay River—The Garden of Eden in America. Tho following special correspondence to the HERALD, dated tn Rio Janeiro, supplies’ the lates$ details of the position of affairs as it exists from the Brazilian capital to tho heart of the Banda Oriental and on the banks of the Paraguay River. The National Situation—Diplomatic and Territorial, Rio JanerRo, July 2, 1872. The Brazilian note of June 20, in reply to the Argentine one-of April 27, has just been published. In its calm and moderate language it is in .com- Plete contrast to the spiteful tone of that of the Argentine Minister of Foreign Affairs, which, with oruel irony, the Brazilian government has pub- lished textually in thename issue of the Gazette. After clearing the way ofa number of side argu- ments, with which the La Plata note abounded, the Brazilian Minister of Foreign Affairs sets forth THR REAL. 183UE, disembarrassed of all disguises; shows that it is not @ question as to whether Brazil could or could not, after all the ends of the war had been at- tained, after a preliminary treaty of peace had been made with the provisional government, after two years had passed in fruitless attempts at friendly negotiation, and after the Argentine nego- tlator had put forward, as a sine qua non of the negotiation, pretensions peremptorily rejected by the other two allies, justifiably negotiate separately with Paraguay definite treatics strictly respecting the principles laid down in the treaty of alliance, but that it really is whether Brazil and tho Orientat Republic are bound to : FOROR PARAGUAY to surrender its claims to the west side of the River Paraguay, without allowing Paraguay to produce ita titles, and without allowing to the alliea any power whatever to judge of the validity of the Argentino claims to the Chaco Territory. BSSENTIALS OF THE TREATY, The provisional treaty of peace with Paraguay, dated June 20, 1870, as the note shows, reserved to Paraguay the right of proposing modificationa to the bounds indicated in the treaty of alliance of May 1, 1865, entered into for the purposes of the war against Lopez, the following words of the pro- visional troaty of peace being clear:—Reserving for tho definito adjustments with the permanent aper Lanteriis | government those modifications in said treaty (of May 1, 1865) which the Paraguayan government may propose in the interests of the republic.” On the 27th of December, 1870, tn explanatory notes relating to the Argentine occupation of the Chaco, thon just effected, the Argentine government ex- pressly acknowledged the PARAGUAYAN RIGHT to propose those modifications in regard to the Chaco bounds, saying :— The Argentine government susfained a short time ago, in dissensions with the répresentative of His Imperial Majesty of Brazil, that the victory does not give to the allied nations the right of themselves to impose their limits as indicated in the treaty of May 1, 1865. My government believes now, aa it believed then, that the bounds must be discussed with the government established in Para- ‘uay, and that their settlement should be made, in he treaties to be celebrated, after the contractin: parties have produced the titles on which cach relies. The Argentine News to hand at Rio is of little moment, The Indian raid reached within twenty miles of Rosario, and was. successful, an Argentine force, in superior num bers, fleeing disgracefully in an engagement, Many settlers have been killed, and many carried off with large flocks, The news caused a row in the Argen- tine Congress, the representatives and galleries joining in denunciations of the Minister of War, is colleagues attempted a defence, but vainly, and @ motion requiring explanations was pactees Bus instead of appearing personally, @ Presidential mes- sage Was sent to say that all the necessary infor- mation had already been given, and that in futare it would be better to reo explanations in writing, and not personally, .This caused further roar and cries for the resignation of the Ministers of War and Foreign Affairs were made, but it seems they will not do 80, JEFTERSON MARKET. SE An Old Woman Cheated—Panel Robe bory—A Boozy Gentleman Appeals from the Decision of the Court. Justice Cox presided at this Court yesterday and disposed of the watch returns with his usual de- spatch, There was alarge array of prisoners, as is usual on Sunday mornings, the majority, in fact allexcept two, being for intoxication and dia- orderly conduct. Robert Johnson, of 327 Spring street, wont with Miss Kate Grant to her residence and drank some lager beer with her. After leaving he found that he was minus $50, He, therefore, had Kate arrested, Sle was committed to answer at the General Sessions. Jane Martin, an elderly lady, on Friday went into the fish store of Robert Sandiford, 312 Eighth avenue, to get a $50 bilichanged. Sandiford gave her five $1 bills, Mrs, Martin, being near sighted, and not thinking that Sand{ford, whom ‘she knew, would cheat ier, went home. Her daughter looked at the money and found she had only five dollars, i grntcs en beeps pili Rene serrated the court squad, and was arraignes Cox.” He was, locked up for trial in defwult of $600 ball. Of course he dented the charge. A dapper individual, enee like a dry goods clerk, was arraigned for intoxication. Dapper im- dividual, holding on fast by the ralling—“I was not drunk and am not drunk.” Judge—Are you not? Argentine republic does not resolve the question of bounds; it takes by the Bly of victory what it belicves its own, but is ready to return’ it should Paraguay prornoe, better proofs than ours when the question of right is treatng of, But . COMPARE THESE PROFESSIONS with what ocourred when the plentpotentiaries met afterwards, towards the end of 1871, at Asun- cion, to conclude the definite treaty of peace and bounds. Then, when the question of the bounds was about to be taken up, the Argentine plenipo- tentiary demanded, as the sine qua non prelimi- nary, the agsent of the other two to the following EXTRAVAGANT PRETENSIONS} ‘That the discussions and stipulations posterfor to the treaty of May 1, 1865, merely acknowledge the right of Paraguay Propose modifications or to produce titles to sald bounds; and meee That the nation which is affected by the posite requirements of Pi ay the exclusive judge of heir justice an misaibility. That the other alli enecs which may ar ré without title infervene in the differ. ay arse, for the | Ciating them, and still less for eo tread of appre- he Purp if Te- solving them. That not even under t! \ ge! ct of the ees of Paraguay, can the other allies meddle in the question to ans, the other ally to yield Sealine its wish recognition or concessions.of of a single inch of the limits established in the treaty of alllance; that if any one of the allies cannot obtain from Paraguay recognition of the limita to which that ally considers itself entitled, the others cannot treat on any of the matters em- braced by the treaty; that such refusal by Para- aay will, of right, replace things as they were fore any preliminary agreement of peace; that if such a situation be produced, the allies must agreo upon the most fitting means for putting an end to it, upon the basis of vhe full vigor of the treaty of alliance and of the most complete “solidarity” between all the allies, The Braztlian and Oriental plenipotentiaries at once REFUSED TO ADMIT such pretensions to tie their hands and gag them, denying to the others any right to judge o: the value of claims which their government might be called on to support by FORCR OF ARMS. Thereon the Argentine envoy left' Asuncion, first intimating to the Paraguayan government not to proceed further with the Rs Nadie upon the other matters of the definite treaties. Of this haughty intimation neither the Brazilian nor the Paraguayan negotiator would take cognizance; and, acting on his instructions, the Brazilian pleni- potentiary separately completed definite treaties with Paraguay within the terms of the treaty of alliance. ‘The note of the Brazillan government reminds the Argentine government that nothing PREVENTS ITS negotiating similar separate treatics with Para- guay—treaties which would still remain under the conjunct guarantee of the alliance; that {ts allies have never questioned Its claims to the Chaco, but that if they are to be called on to maintain those claims with armed hands they must be ALLOWED TO JUDGE of the validity of those clainis in the light of the respective titles produced by the Confederation and raguay, and te more so that the claims of Bolivia 0 & 'arge portion of the disputed territory were expressly saved by & protoco] attached to the treaty of alliance. The Chaco boundary, says the Bazillan note, is the ONLY OBSTACLE which remains between the Argentine and the Paraguayan governments. It is one in which the other allies have no concern. Let the two govern- ments settle it between them and enter into treatie: and then allcanbe placed under the guarantee oi the alliance, to which Brazil still adheres frankly and entirely. Such are the principal points of the diplomatic note, the immense length of which prevents sum- marizing. To the Rio public it has given GENERAL SATISFACTION, for its extreme moderation of language and con- ciilatory tone induce the hope that resort to arms may be avoided, nothing being said in it of a nature to offend the irritable pride of the Argentines, not @ threat being insinuated, while its argumentation is close, logical and well supported with documental prools. BOLIVIAN INTERESTS, In connection with this Chaco question, there 13 no longer doubt on the determination of Bolivia TO ENFORCE HER CLAIMS upon the northern part of the Chaco, The last mails from that country have brought us the official decrees of March 30, by which its government has created the Chaco Department, has declared Vainza its capital, and hae ie a Governor and fur- nished him with a 6 armed force. Besides this, it is known to me, through official sources, that the Bolivian government has mobilized FOUR THOUSAND MILITIA in the neighboring departments, with the declared object of supporting its authority in the new department against the Argentines, who have occupied the Chaco, should the reclamattons of the Bolivian Minister, now coming OM, not be attended to by the Argentine government. To use the oficial language in relation to the question, “Tho! n'Bolvians know not how to protest, they know how to act.” MENICAN ENTERPRISE IN EAST BOLIVIA.
