After the transaction of considerable routine busi- mess yesterday, Mr. Howe called the attention of His Honor to the case of Michael Hays, who was charged with a murder said to have been committed 4m the Fourth ward fifteen years ago. ‘The case has been on the-calendar several times and postponed to enabie the prosecution to secure the attendance of the principal witness, Lewis C. Rochester, who, it was claimed, made this charge for blackmailing Barpose: poses. The counsel said he was anxious to have client tried, but it was evident that Rochester would never appear. Assistant District Attorney Fellows said that Rochester appeared in the Office on Tuesday in a etate of beastly intoxication and promised to at- tend on Monday, but he failed to appear.
