UNITED STATES DISTRICT COURT. “Who Navigation Laws of the United States —Important Decisions of Judge Bene- dict—The Astoria Ferry Company Claiming Not to be Subject to the Law of Congress. 4 The United States vs. The Steamboat Sunswick, &c,—The following decisions have been rendered by Judge Benedict in actions against the steam- boat Sunswick, of the Astoria and New York Ferry, instituted by the government for the recovery of penalties incurred through non-compliance with the navigation laws of the United States, the ‘veasel having been used upon the ferry mentioned, ‘without previous inspection, under the act of Feb- ruary 2%, 1871, without a United States license, ander the act of February 15, 1793. The defence rested chiefly upon the ground that, ander the provision of the constitution limiting the power of Congress to the regulation of commerce mong the several States, vessels engaged in navi- _ ‘wating waters within the boundary of a single State were relicved from the statutory requirements of the United States navigation laws. ‘The Court in this instance holds otherwise. The decisions are es follows :— ‘This is a proceeding in rem, against the steam- -boat Sunswick to enforce against that vessel a lia- ‘bility for $500, under the provisions of the act of Congress entitled ‘‘An Act to provide for the better -gecurity of life on board of vessels propelled in ‘whole or in part by steam, and for other purposes,” . February 1871, ‘The charge is that the boat was engaged in navi- ting public navigable waters of the United Btates, to wit, the harbor and bay of New York, ‘without having her boiler inspected as required by ‘tne eleventh section of the statute above re- red to. ‘The defence is that the boat is not shown to be subject to be inspected under the laws of the United States, but was engaged in the purey internal ‘commerce of the State of New York; that the vessel had failed to comply with the section of the statute referred to is conceded, and it cannot be disputed that she is a vessel within the description given ‘Dy the act of vessels to which the law is declared ‘to be applicable. By the express words of the fifty-elghth section of the act its provisions are made certs to ever, fearyboah, and by section 41 all steamers “navi- ting the iakea, 8, inlets, sounds, rivers, har- ra or other navigable waters of the United States, where such waters are common highways of com- merce or open to general or competitive naviga- tion” are made suvfect to the provisions of the act, and, must, upon the evidence, be held subject to the act, aithough, notwithstanding its broad lan- guage, it considered inoperative as against @ vessel oxoluaively engaged in purely internal commerce. The evidence shows that at the time complained of the Sunwick was a steam ferryboat, as one of the ferryboats employe to operate the Astoria ferry, and ran between Astoria, a place -on Long Island, to the foot of Ninety-sccond street, place on New York Island, carrying passengers and freight. It also appears in evidence that the Astoria ferry is @ public ferry, established by in my opinion she daw, and & common _ tlioroughfare, open all, and used for the transport- ing of ail agers and freight which cross the East River at that point. About two months ago a young man, giving his name as O. M. Barnard, opened an account at the Franklin Savings Bank, and deposited at various times three certified checks on various banks of this city, amounting in the aggregate to $5,000, On this deposit, it is alleged, he drew at different times the sum of $3,400, leaving & balance to his credit of $1,600. The Franklin Bank deposited the checks with the West Side Bank, who sent them to the Clearing House, when they were dis- covered to have been raised from small checks, amounting in the gate to some $75. The checks were returned to the West Side Bank, with the above information, and by them to the Franklin. A description of Barnard being given to Detective McConnell, of the Twen- tieth precinct, he kept a sharp look out for him, and was rewarded yesterday morning by seeing him passing through Thirty-ninth street, be- tween Eighth and Ninth avenues, and took him in custody. On the way to the station house the prisoner broke from the officer and attempted to make his escape, but was recaptured. He was conyeycd before Justice Ledwith, at Jefferson Mar- ket, yesterday afternoon, and denied the charge, but was held for examination.
