Tho United States vse Lilienthal.—In this case there had been a verdict for the governmext, con- demping about $100,000 worth of tobacco, on the ground that the revenue had suffered: much loss in Consequence of imputed irregularities alleged to buye been practised by the firm of Litientnal & Co., wita respect to the payment of taxes on the tobacco, Mr. George 7. James Biggart, a Deputy United States Marehal, was tried yesterday on the charge of having com- mitted am assault with intent to kill, the viotum being Jonn Ruthington, a newsboy. It appeared that on the morning of the 26th of October last the defeadant undertook to arrest wa illicit distiller near tue Fulton terry, when tne latter escaped froay him acd ran up the street. Biggart, to frighten the fugitive, fired several shots at him, but ne escaped without injury. One of the sbots, however, took efiect tn one of Ruthington’s legs. Yesterday the returns of the semi-annual exam- Imation of the students of the College of the City of New York were read to the various clagses, who ‘Were assembled 10 the chapel. In a few preliminary remarks the President stated that many would, probably, be surprised at their non-advancement; but, notwithstanding all that, he was determinea to do his duty and turn all luzy or incompetent stu- dents trom the college if he possibly could. Out of thirty-cignt members of the Senior Class only thirty-three weve allowed to continue ther course. ‘Thisis almost unparaiieled in the history ot this college and shows the high standard re- quired, The stumbling block of these was astron- omy, as all the detlotenctes were in that subject. The Juniors, forty-seven In number, were sadly thinned, only thirty-nine passing.
