Excitement at the Yorkville Police Court—Jo- sephine Disappears Mysteriously—The Lawyers Have « Tilt—The Case Set for Next Saturday. tone ‘The Yorkville Police Court was densely crowded yesterday morning with an audience such as gener- ‘ally crams the Court of General Sessions on the occasion of some murder tral. The object of the attendance of such a number of people, so unusual wo this Court, was to near the expected developments to be brought forth in the examination of the Fisk Abel case. . At balf-past ten o’clook, the hour decided for the examination to begin, Justice Bixby said he was ready to proceed with the examination. Colonel FELLOWS, Assistant District Attorney, who, with Mr. John McKeon, appeared for Mrs. Mansfield, asked His Honor for the bail bond given by the defeadant for his reappearance for trial, and, having read It, be made a motion to have the papers in the case immediately sent to the Court ot General Sessions, He explained the grounds on which he made this motion to ve as follows:— ‘That Justice Bixby having taken a bona for the appearance of the defendant Fisk at the General Sessions — for trial, this Court had no further jurisdiction over the case. The bond was, besides, waxen because there existed in the mind of the Court a probable cause to believe that the defendant was guilty of the crime _Amputed to him. and the strongest reason why the case should not be tried befure his Honor Justice Bixby was that if in an examination before him Mr, Fisk should be cleared of the charge against him and discharged he couid be rearrested on a bench ‘warrant from the Court of General Sessions.
