Smith vs. Charles D, Fox.—In October, 1870, the plainti® alloges that he lensed from defendant the premises 175 Thompson street for eighteen months, he agreeing to pay $1,200 for the firet six months and $1,300 for the balance of the period, the rent to pe paid monthly in advance. The plaintiif entered on possession and sub-let a portion of the premises. On the 16th of May procecdings were Anatiitited against him before Juige Quinn to disposses him, ‘On account of noz-payment of rent. The case was brought to trina! and yudment given for the defendant, and dispossession warrant Jesued. After the warrant hai!’ been fasned the do- fendant consented to accept the arrearsof rent due with costs of suit. Tho acceptance of this money by the defendant the | plainti insists was a watver of the warrant, The defendant claimed that. there was no such waiver, and upen W's undertaking to cont fummate the proceedings for dispossession an applica- tion was mace for temporary injunction to this court, which Was granted.
