Howard, a despatel agent on the Hud- fon Kiver Railroad, deposed that James M. Fuller called Rebecca J. Kellogg his wite on the train, on the date set forth above, and, from thei familar manner toward each other, supposed that such was the jact. Fanny Combes, one of the deponents above, the defence claims, Was dismissed on account of im- pudence aud pad conduct, and the statements made against the detendani’s chastity are entirely untrue. Mr: Farveil, who had lived with the defendant as domestic for seven years, and who had been livin ont for forty years past, deposed that the statemen of Fanny Combes is false in every respect; she had seen tie compiainant abuse and strike his wife and heard hum cail her names which are unlit for publir cauion; she, never knew “s MEANEN OK MORE TYRANNICAL MAN.” Edward Keliogg and his brother, Samuel P., aged respectively eighicen and fiieen years, "made lavits in beualfoftheir mother, They believed Combes to be @ bad woman and that their fat had caused these proceedings to be instituted against Fuller because he has #0 often Inierlered to prevent their father from striking her. Layton, ex-detective, testified that he had been employed tn the interest of Mr. Kellogg to watch whe defendant and Fuller for the purpose of garniug evidence against her, but he nad never been zbie to detect anything improper or unduly familiar beoween them.
