Tuary, 1868, one Sweeney, now dead, visited the store of defendants, whotesale grocers, and offered +o sell them by sample some Ceylon coiec, which was de citvea; he then said he wanted to purchase some teas, for which he wouk! give them cofee in ex- change, and to this they consented, ordering a larger amount of coffee thun the tea which they had sold, but deciining to deliver the tea until the coffee w. brought to thelr store, Sweeney being a stranger to them. Shortly atter 4 coffe came to nand, Sweeney accompanying K, and presenting a bill of the plaintim for the goods giving credit for the ten; defondants then gave to Sweeney a check to plata- tte order for the om@lance, and the tea wag taken away on the samo cart that brought the coffee.
