NEW YORK HERALD, TUESDAY. MARCH 14, 1871— "POEIMICAT BURGLARS. {FINANCIAL IND COMMERCIAL. “Thompson, the Daring Eighth"Ward Burglar, \Convicted—Judge Bedford Sends Him to the State Prison for Fifteen ‘Years—Brady, alias Morrison, the Burglar With “Influence,” Sent to the State Prison for Five Years. ‘The preceedin7s In the GeneralSeasions yesterday ‘wereiinteresting and furnish additional assurance ‘so this community that the authorities are deter- mined to bring notorious offenders to justice. In one instance Judge Bedford sent & man, who was clearly. guilty of entering and robbing an inhabited -awelling house in the night time, to Sing Sing for ‘fifteen years, and in another promptly sentenced @ .Motorious professional “cracksman,’’ who was con- victed of participating in an extensive burglary of a »ptore in Union square, to the State Prison for the full term. In the progress of the trial it came out that \Powerfai political influence was exerted to dissuade ‘the prosecuting ofilcers from pushing the case; but the earnestness exhibited by District Attorney Fel- lows im prosecuting Brady aad: tne prompt way in ywhich Jadge Sedford disposed of him show that no tmfuence cun prevent these fatthfal oficials from \performing their duty. BURGLARY. James Thompson was the first, prisoner disposed vot yesterday by the City Judge. The prisoner was charged with burglartously entering the dwelling mouse of William Whittingham, No, 6 East Ninth wstreet,on the night of the 24th of; February. The ‘burglar effected an entrance by opening the front door of the house by false keys, and succeeded in carrying away silks and overcoats valued at $2,500. ‘Most of the property was recevered after the arrest of Thompson, who was not caught upon the pre- mises. Oficer Brady, however, succeeded in arrest- dug Thompson while passing through Spring street @t five o'clock In the morning with a basket in his possession. ‘The officer stopped and questioned him, and Thompson, knowing that the evidences of his guilt were on his person, ran away. He was fol- Jowed and captured; and when the basket was ex- amined at the station house it was found to contain ‘the proeeeds of the burglary. Judge Bedford, vefore passing sentence, asked ‘Thompson. bow long he had been out of State Prison The ex-convict promptly answered, ‘I was sent there for grand larceny and came out ten montns ago.”’ Fis Honor said:—‘-Oiicer Brady gives you a ‘very bad reputation—that he caught fou at five o'clock in the morning, soon after you entered and webbed a respectable dwell ing house, with false keys and burglars’ implements upon you. You belong to ® gang of prefessional burglars, black and white, and aS reak eee by, sending you to the State AN aaTENS BURGLARY IN UNION SQUARE. The next.case called by Assistant District Attorney Fellows was a charge of burglary preferred against James W. Brady, alias Morrison. It appeared from whe testimony that very early on Sunday morning, December 18 tne estabitshment of Joseph Gaul, No. 21 Union aquare, was burgiariously entered and about $8,000 wor:h of opera glasses and optical pal The prin- witness for the peeple was Charles F. Lempke, an employé of Mr. Gaul, who, bout halfpast nine o’clock on Sunday morn- ing, when crossing Union square and approach- mg. the store, saw Brady leave the area of the premises and communicate with a man in a carriage near by. The prisoner was not arrested then, ior he ran away, but Lempke gave a description of him which reaulted in his speedy arrest. On the Tues- day following the clerk went to the od headquatters and prom} aes yee Lempke went into the store of bis euaployer he soon discovered that a burglary was committed, an entrance tiphire, been effected by breaking the fanlight over the door and by removing the locks frem the inaide. The witness positively identified Beary ea but ane ntly contradicted by a young , Who was in the window = door to enero th the crime was p rated, bi hs one point she swore that Brady wore a hat, while she said that bee = ham she saw had a cap on at the time he remisés, yet she could not positively iz vas, dy. The defence was an alibi, three esses swearing that Brady was at Petn’s saloon, in West Houston street, from mid- night on the Saturday in question until between nine and ten o’clock Sunday morning playing cards, dringing aud rafiling for turkeys. POLITICAL “INFLUENCE” IN COURT. Mr, Howe, in his closing remarks to the jary, inti- Peg! rity the pros ing officer was influenced yy certain “influence” in vigorously seeking for the sanenen of Brady. Colonel Fellows Ae feed inernuation in an elo- that politieal in- jnent strain, plai juence, sought to be Txereised yy not ides than one hundred pérsons, was zealously brought to bear upon him to secure Brady's suecnaree: § and the crowded state of the court room was sui"icient proof to show the interest taken in the accused. fuences” contd have operated In that particular case he (Mr. Fellows) would have been consenting to the discharge of the prisoner upon his own recog- nizances. He urged the trialon because he feared that ine cause uf public justice might be thwarted if it were long delayed. Mr. Fellows, in an able argu- ment upon the evidence, claimed that the prosecu- cution proved most clearly the guilt of the prisoner. THE JUDGE'S CHARGE. Judge Bedford delivered an exceedingly able ana Jucid charge. ae tak upon a number of pro- es offered by the couusel for the prisoner, his jonor proceeded to state the evi:ence in an impar- tial manner, concluding by saying that no man could be convicted before him on general principles. Altbough he did pot shrink from the performance of his duty after a party was convicted, yet untila man was found gulity it was his duty to see that the accused hac fair play. He (Judge Bedford) aid not care whether a manu on trial was the worst burglar and murderer in the worid—if prisoners were even as bad as Forrester, the aileged murderer of Na- than—so long as he (the City Judge) was on the bench he would have fair play, and must stand or Tail upon the evidence. THE VERDICT. The jury deliberated upon tne case for over an hour, and, being unable to agree upon a verdict, re- turned te the court reom tor iurther instructions. The foreman said that there were eleven tor convic- tion. His Honor prompuy interrapted the juror by asking if they desired further insiruction. ‘The question was asked whether the identity of the risoher—the fact that he was seen at the premises— Hy established the crime of burglary against him? ‘The City Judge replied that it was for them to say whether the prisoner was there for burglarious rposes. wy Alter receiving the required information the jury repatred to their room Jer further consultation, and in @ lew moments re-entered the court room and rendered 8 verdict of *guilty.” ANOTHER INDICTMENT AGAINST BRADY. Colonel Fellows, in moving for sentence, said that he had another indictment against Brady tor bur- glary, in which Josepn B. Lewis, forwhom an at- tachment was issued 1p the morning, is the witness. He found it extremely difficult to get the case on for trial. What influences the prisover might have exerted for jaca of staving off the cause of Justice he ellows) did net know, but he knew that ‘Sraay ‘was guilty and that the defence inter- posed was asham. As soon as the verdict was recorded and tho mer had answered the usual questions, Jud, Barone called Captain Petty to the stand and mi some edit ney respecting the prisoner. The Captain said that he had known Braay between five and seven years; never Knew bim to do @ day’s work during that me, and has always been looked upon bye thoge who know him as a Professionwl burglar ovis counsel sald that the reason why he was ar- Teated was because of his reputation. Although Brady was fashionably dressed and evidently umd more than ordinary smartness, his physiog- would readily agsare a good judge of charac- tert it he was a bad fellow. It was curious to no- tice the intense anxtety exhibited by a@ host of “friends,” who filied the court room just before the sentence was pronounced. They unconsciousiy sprang to their feet and leaned forward to hear every word Uitered by counsel and the Judge. All of them ‘were well d , Wore ehining beavers and flashy jewelry, and seemed to be thunderstruck atthe stern manner of the prosecuting officer and the prompt- ness with which Judge ford disposed of their fes- tive. companion, bs “* $HE SENTENCE. \ jnage “Beatord, in passing sentence ‘upon the » said:—I do not think pee ‘y have erred irine: the rendition of their verdict, and fav many cor. MONEY MORE ACTIVE. ‘The money market was rather more active towards the close of banking hours, but without change in Tates, which varied from four to five per cent, ac cording to the collaterais offered, loans.on govern- ment securities being mate almost without excep- tion at four per cent. In our.analysis.of Saturday’s bank statement @ sentence, incompleted, should have stated that ‘the loss in surplus reserve was over $2,750,000.” One er two other clerical errors this morning must have corrected themselves from the context. Commercial paper was steady at 6.07 per cent, and unaffected by the announcement of the suspen- sion of Messrs. Converse, Blagden & Co., whose em- barrassment is attributed. to heavy advances made to the now bankrupt Mystic Woollen Mills, and ‘Whose Mabilities are estimated to be within $200,000. Foreign. exchange was quiet on the basis of 1005¢ 100% for prime bankers’ sixty-day sterling and 110} @ 110% for sight bills, GOLD DULL—111%¢ A 111%. The Gold Room was quiet and devold of specula- tive hfe. The London quetation came provokingly steady, and the political horizon was vainly scru- tinized for influences likely to affect the course of the market, which stood at 111% a 111% nearly the entire day. The changes rung upon these two figures are shown in the table:— 2P.M. The In the gola Joan market the rates “Tangea from 4 per cent for carrying to flat for borrowing. The operations of the Gould Exchange Bank were as Tollows:— THE NEW LOAN. Up to last Saturday the subscriptions to the new loan reached $7,600,000. To-day a number of addi- tenal subscriptions were announced in Washington, making the total nearly $10,000,000. Mail advices trom Europe are now awaited to learn the manner in which the loan was received on the other side of the Allan, GOVERNMENTS STRONG. ‘The,governmient list was strong, under a dispost- tion to discount the effects of the large purchase to be made by the Secretary of the Treasury next Wednesday, when the least amount taken will be $2,000,000, such being the figure already advertised, ‘The final street prices were:—United States currency sixes, 114a 1143; do, sixes, 1881, registered, 11534 115%; do. do., coupon, 115% a 115%; do. five-twen- ties, registered, May and November, 112a 112%; do. do., 1862, coupon, 4o., 112% a 112%; do. do., 1864, do. do., 112 & 11234; do. do., 1865, do. do., 112 a 112%; do. do., registered, January and July, 110% a 111; do. do., 1865, coupon, do., 110% a 111; do. do., 1867, do. do,, 111 a 11134; do. do., 1868, do. do., 111K a 111%; do. ten-forties, registered, 1085 a 108%; do. do., coupon, 108% 2-109. Ohio and Mississippi was perhaps the most active feature of the day, and also the most unsettled. Opening at 48%, it jumped to 49%, settled gradually aown to 47%, jumped to 49%, and left off finally im the vicinity of 483,. Western Union was feverish and fluctuated between 56% and 54%. Afresh “bull”? movement in Union Pacific appears to be on the cards now that the- company have the signature of Secretary Boutwell over a virtual promise, conveyed in the shape of a message to the financial agents in this city, that he will not demand payment of the interest, as was in- umated he would in face of the spirit, though per- hapa not the letter, of the recent law passed by Congress. The government also has commenced paying fifty per cent in cash of transportation. Harlem and Erie pre- sented an interesting contrast, the former going up to 137 and the latter declining to 20. The reports of railway earnings tor the first week in March show an increase of $323 in Milwaukee and St. Paul, and an increase of $6,431 in Marietta ana Cincin- nati. Union Pacific for the month of February shows a decrease of $194,370, and Central Pacific an increase of $86,909. The sudden decline in prices at the close was attributed to a further reduction in freightg to Chicago, owing to the rivalry of the trunk lines, rates being lowered 33 1-3 per cent from those just prevalling.
