HOLDEN'S IMPEACHMENT. Hatements of Two of the Men Who Were Hanged and Beaten. Rateron, N. C., Feb, 1, 1871. The Court of linpeachiment met at twelve M., and the proceedings were opened with the usual pro- elamations of “Oyez! O yez! Oyez! All persons are commanded to keep silence on pain of tmpri- sonment while the Senate is sitting as a court on articles of Impeachment against W. W. Holden, Gov- ernor of North Carolina.” ‘This was pronounced by Mr. J. J. Robertson, doorkeeper, with a full and elear intonation of voice, that immediately com- manded the attention of the lobbies and galleries, ‘The attendance was thin in the front gallery usually eecenpied Ly ladies, but the side galleries—that par- ticularly on the left—were thronged with an eager crowd of spectators. On the left the dark element prevatled—that galiery was literally packed ; ana the lobbies underneath were filled with witnesses, spectators, &c. The proceedings opened by a CHALLENG: on the part of the defence against Senator Edwards, of Granville, who lad been admitted since the organization of the court. They contended that the Senator not having been present in the begin- Bing bad now no right to participate in the proceed- ings 0: the conrt, quoting the constivation of North Carolina as their authority, They denied there was any precedent in the case, and claimed the Senator Rad no right to vote as a member of the Court of Impeaciment, Governor Graham, for the prosecu- fion, answered, and proved conclusively that, as a menber of the Senate, Mr. Edwards was not only entitled, but it became his duty as a Senator to par- tetpate in the proceedings of the court. It was a duty he owed to bis constituents, and one he could mot conveniently shirk. The Senate consti- tated the Court of Impeachment, whether any member was absent or present, on any particular day, and the iight of challenge was inadmissible. The dofence then reverted to their former argument, quoting manager Ben But- Jer—an authority by no means popular or reliable ta this court, Tue diMculty in the matter consisted princtpaily in the fact thas Senator Edwards isa conservative Senator who successfully contested the seat of a radical, The latter was unseated and Ed- wards was admitted, making the censervative side of the House two over the required two-thirds ma- jority toconvict, Judge Merrimon, for the prose- oution, made quite a lengthy and able argument, quottng English and American authorities to show that the right of challenge against a Senator as a member ot the Court of Impeachment was not ad- mussible. The Chief Justice, at the close of the ar- guments, decided that we objection of the delence ‘was not well taken, and that the Senator was cleariy entitled to act as a member of the Court of Impeach- ment; whereupon Mr. Edwards was called to the clerk's desk and sworn. ‘The Governor's RESPO! to the eighth articie of impeachment was then pre- sented by the counsel for tie defeuce, It was quiie brief and consisted ina general denial of the alle- gations coutained ii that article, particularly that recently made in changing the name of *Neathery’’ for “Kerry,” Which was termed the new allegation, On moon of the managers the Court of Impeach- aneut tien took a recess in order to obtain jrom ie House of Representatives a REVLICATION, which was agreed to. At the expiration of that time tbe managers reappeared and fled their repil- cation, Which was in substance a reaverment of their sormer one, which stated that notwithstanding the Governor's respose he was guilty of high crimes and misdemeanors, Tne 18SU6 BEING NOW JOINED the Senators were resworu, and tie court was at jast actually ready to proceed with the real business before tem. ‘The witnesses for the prosecution are all ready, and to-werrow, after the opening speech by Mr. Sparrow, chairman of the managers, the ex- amination will commence. At two P. M. the Court adjourned. THE WITNESSES. The hotels and boarding houses of the city are Mlied with witnesses, boun lor prosecution and de- fence. At the yarborough House are quartered nearly ali the leading citizens of Laswell county who were arresicd aud imprisoned by the bandit Kirk. Among them | notice Mr, Samuel P. Hail, Judge Garr, Ur. Yancy, Messrs, Grinitn, Wiley, Jones, Bowe and others. Mostof kirk and Bergen’s victins are here, and in order tat the pubiic might have a iore- taste through the columns of the HanaLp of the evi- dence on Holden’s impeachment trial I interviewed, er rather beld a preliminary examiuation oi seve- ral. Thereupou Wiley prepared to st, and struck at the men rizht and lett with his fists, Knocking three down; but with the aid of ence rails he was soen overpowered. Bergen was an arrant coward, buy a tyrant, who gloated over the tortures of his victims, and the more tntense the latter the more flerce his joy. Mur- ray is a young man, of respectavie lamily, residing in Alamance county. He was arrested among nearly one hundred others in the same county by Bergen His statement is as follows:—I Was lying in a tent a the camp as a prisoner one might avout eleven o'clock, when Bergen came to the door with a lignt and sald, “Murray, is that your? 1 said “Yes, it’s me.” He then went away and remained absent About five minutes, when he returned without any light and seizing me by the feet he said, “Murray, get up and ceme out here.” I asked, “Can | put on my shoes?"? # “No, you won't Want shoes long,” he repiled. I soon decame unconscious, and when I next regained my seuses I wassitting on theground leaning against the tree. ‘Two men and Bergen were there with their pistols in thetr hands, I almost re- grotted I had not died, as I feared they would in subject me to the same ierrible ordeal, ers gen ordered me to get up, but L was unable and one of the men assisted me. The evidence clearly showed that my father died in this elty pos- wessed of at least $0,000 personal property, and the Surrogate decided that 1 was entitled to it; but by Feason of litigation by the Gardners and their family connections, the Graits and others, in other courts, over which, of course, the Surrogate las no control, Thave been kept out of my rightful property. Al- though my father has been dead within a few days of iwo years, and he is known and proved to have been worth some $60,000, to Which the Surrogate says { am entitled, the lamentable and outrageous fact stands out that theugh by his will, ef which [ am sole devisee and executrix, be gives me all his property, I have not yet received one cent of it. My father’s will of which J speak 1s entirely in his ewn handwriting, irom beginning to end, and is on file in the Surrogate’s ofice of New York. I would not trouble you witi this letter were it not for the fact that I may be dajured in certain quarters by the Statement that Ihave actually recovered much of the very property which 1 am now seeking to secure.
