HEAL ESTATE PROBLEM Buit Against the City Based on Alleged Half “Ownership of @ Closed Street, Old City Salee of the Common Lands in the Viginity of the Central Park—How the Pres- ent Suit Came About and Ali About It~ flome Curious Real Estate Remini¢- cences from the Boginning of the Present Century Up to the Present Tixe. A ourious and at the same time Interesting sult ‘was begun yesterday in the Superior Court pefore Judge Freedman. The suit involves a question of Ownership as to a strip of land 900 feet long by twenty-five feet wide, said sirlp embracing the twonty-five feet depth of the northerly front of | Seventy-eienth street, between Fourth and Fifth ay- ennes, Of course it will be seen that the value of the land in qnestion, «8 real estate 1s now held in this vicinity and with is prospective increased value, cannot be reprevented without drawing largely on (he manerative capacities of the nine digits, or, in other words, that it 1s of almost incalcu- , lable vaine, To make the matter ¢lear If & neces- gary to indulge in a bit of PREVATORY HISTORY. In 1801 the city owned abouc @ thousand acres of Jand on thus part of the isiand, whieh long had gone by the name of “common lands.” A portion of it embraced what is now Central Vark. On these Janda there was the utmost freedom of “squatter sovereignty,” and hence the name by which they are generaliy known. At tits tame this locality was remote from the commerciat centre of our embryo Metropohs, aud When the city’s present extensive growth and the great Park, with Ils destiued cor- don of palatial brown stone fronts, formed no part of the wildest imaginings of those most glowingly prophetic of the crty’s future greatuess. To encour- age settiement In cil direction the city began to sellj portions of the Jand, selling every alvernaet square and relatning possession of the remainder ‘To say Mat these Jands were SOLD FOR A SONG Js trespassing only slightly on the precincts of byperbdle, and to say that tilousands in our city descended from those who, from savings in the sale of tatlow and making bouts, and cutting hair and professional labors with the sartorial goose, made. parenases here, are riding im tue carriages to-day @nd enjoying all the gilded accessories and refine- ments of wealti—hrowa stone frouts aud lverled fervants and the first pews tn our churchesfand frout seats al the opeca aud rire Vintages of wme and rarer paintings aud foreign wavel and, in short, alt the iuxuries, aud homage and triumphs ‘hat money commands—ia only staung a simple and widenfabie fact, which though ip its swift result seeming more the spe pro- duct of wondertul en se erates teat og in, Straight. forward realty, 1s a feet nevertheless fo Which many in there days of pseudo pride tk pomposity of pre- tence are Very loth to revert. WitkLIGIG OF Ee that has brought about the wonderful pecuniary and soctal Changes just described in the interiu, brought with it other chatiges. From #elling lots the city be- came @ purchaser. In 1834 Russe! D. Miner bought of a Mr. Westbury quitea tract of land, wncluding the land referred to above—that Is, the present Seventy- ighth street, between Fourth aud Fifth avenues, é city bought this tract of Mr. MM After this Jast purchase this part of ine isiand was divided into Ms present divisions of streets and avenues, and their situations and directions laid out respectively, And now we com: to the PRRSENT BONE OF CONTENTION, Fronting tue southerly side of the tract sold by Mr. Miner was a sircet filly feet wide, In the redi- vision of the city tus street Was cut ont und Seventy-eighth street lutd eat, the northerly side of the latier street correspouding with the ‘origival etapa side of the street facing the land seid by . Miner. Under the provision of the common kw laying duwn the rule that the owner of land ordering on & street owns in fee simple the: land to he middie of the street, aud ia case of such street ving sit wp can chum all the rights of such ownership, Mr. Miner brings a suit for pay irom the city tor this hal: of Uhe former street and now constituting the nortierty frout of Seveaty-eighih street. The JROUNDS OF MR. MINER'S CLAIM * are very sunply told, aud in fact bave already been gerne explaiied. ile insists that the ctty, having hanged the situation of the sheets Irom what they Were at tie time of the sale and converted the old Street inte lots, that the ownership of half tke old Street reverts to hin. At tie the of the sale Ar. Miner execuicd a deed of release to the city, but he Dow sets up that tits deed was PROCURED BY FRAUD, find 1s, there‘ore, not binding upon him. His great effort is directed to two poiats—first, to show that common law, referred to as applying to the owner- ship of streets, and the same being vested m the owners of adjacent’ properiy, has ful) and binding joree in this case; and secend, that the deed of ree lease Was procured from hie by tread, The CITY’S POINTS OF DEFENSE are that the common law in question does not & RY to streeis in vities, and consequently tat Mr, incr has no legal title to any*pertion of the Jand embraced m Ue old street. It is atso denied that any fraud was practised im proving the deed of re- lease. ‘The earnestness with whitch tt is determined to contest these r Clatins 18 Showa Lb THE © CAGED. + Por Mr. Miner there appears Mr. Lather R. Marsh and Mr, Jolin B. Deviln, to ef the ablest real estaie lawyers in the city. Representing the city are Mr. Vanderpoel, of brown, Hail & Vanderpoel, and Me Algernon 8. Sullivan, (ese two geatiomen, for thelr Weill known abilities in contesting rms ag ttm | title to real estate, having been specially selected by Mr. O'Gorman, the Counse tue Corporation, Whose other prosslug duties prevent bis giving his Individual aitention ts the case. THE TRIAL will, doubtiesa, last several days, and, as will be #ecn, involves features of iwterest unusual tn evil sults. Very little more than the preliminaries of the trial were dnished yesterday, Jt is being tried be- fore a jury. To-day the testimony will begin to assaine an intcresting character, 99 some or the Jareest real estate owners and dealers in the city will be called Witnesses, Meantime it should have been stated above that the city i all tts sales of the luis partly embraced in this disputed strip of Jand gave Warranty deeds to the purchasers, so that the presepi owners cau in no Way be distarbed. The brunt of hattie has to be borne by the city, and with it the abiding evont, the expeuse of de @bould tbe jatter be the resuit. LHE TAY‘.OR WILL CASE. A Brief Sessiou~Corroberative Evideace Against tho Genulneness of the Will-Tie Beginning of the End. The hearing in the Taylor contested will case still continues the ailabsorbing business of the Surro- gate’s Court. RRs Testimony of Beth Vartics at the Hexriug— Aedras Binally Bownd Over tor Trial in Norwalk, where the Qridieys charge him with hav- ing stolen of! paintings, &¢., from them. On Fri- | Gay, the 6th, Andrus was examined before Justice J. ¥, Foot, at the Town Hall, Lawyer Hollieter, of Bridgeport, appeared for ihe State, and D. B. Loc! Wood, also of Brit and Miss Gridley were examined at great length, and the cros#exammation was as thorough, sharp and smart as the lawyer could make it, quiet diguity, and answered all questions positively, fearlessly ana unhesitatingly, evincing Intelligence, ana several thnes were “too much” for the counsel. ‘Their testimony was substantially as follows: Six years ago Mr. Gridley aied, leaving them 00,000, They removed from New Haven to Hart- ford, bought a house and lived in some style; sold outand moved to West Martford, where they dis obarged their coachman and hired Andrus, who was then living with W. Mrs, Gridley good naturedly referred to the story in the papers that previous to her marriage she was Mr. Gridiey’s “cook,” and denied it in toto, but said that she cooked for him afterward, and claimed that she could cook as well as most women, Miss Gridley indignentiy dented that she had ever been engaged to “iat man; that she had ever fe him $10,000 to buy dresses, or had ever made ‘im handsome presents, Messrs, Buell and McLean, of Springfeld, were examined and testiied to the manner of arrestin; Andrus. Bueli owned that he found out wher Andrus was through his brother-in-iaw, whom he told that “Mrs. Gridley had fallen neir to a fortune, and wanted Sammy to come back and help spend 1.” Sam was found in Boston, having enlisted under the name of Samuel Franklin, juduced to ac- company the detective to Hartford, and when over the State line was arrested and taken to Bridgeport. 13, @Word, answered without hesitation, telling a straightforward story; said he was bern in Connectiont; aimitted that he had served two years m the State Prison “ior @ scrape he get into,” but still “claimed to be an honest man and a gentle. man; that the Gridleys sold their stock and gave bim 310, 000 witi orders to go to New York and buy dresses for them, whici ne did, buying forty-three dress patterns and other articles; thi t they sent him again With $3,000 for same purpose investing this money in stocks, buying the Tallahas- see house, &@., was @ lie; afterwards admitied that he knew nothing of dre: ses, &c.; “conldi’t tell whe- ther the stuff Mrs. G. had en was chenilie or what it was;” that they presented him with a gold watch Worth $500—-as nice a watch as any young fellow carries around,’ which he had pawned; that he had pawned and sold jewelry. furnivure, &c., by tne orders, to raise funds; ad- mitted that four pietares, a chamber set of jurniture, crockery, &c., Were at iis mother's house, but claimed she had rg “ig them at pubhe sa.e; tuathe was engaged to be married to Miss Gridiey, and thougit 1 hard that she should “go back on him; that when he lett them ‘they all ; stood up together and made @ solemn prayer,’? pledged themselves to correspond, aud he agreed to entist ana “devote half of his pay to their snpport;’? adimitted that Miss Gridley did ot answer his jet. ter; thought her trestinent of him hard, and be- lieved that “this whole thing was a put up job.” ‘rhe exaiutnation resuited m his belng held for trial, and bonds were plaved at $1,000, seemed togive general satisiaction to the specta- Andres was taken in charge by Deputy Shoriff Theodore Searies. After the trial Mr. Graman.caused the arrest of Mrs. Gridiey for batance claime: rent. They compromised the matter, Mrs. Gridiey paying $130 Jn setiioment, and wa _— released. HEROISH OF A RAILROAD | ENGINEER. From the Ger mantown (Pa.) Tetograph, Jan. 11.) an accident that occurred on the Peansylyania Railroad, a few days ago, Enos J. Hoopes, an en | ineer, lost his life, Heroism such as Mr. iloopes H | isplayed on the occasion deserves more than a | passing notice. The facts as we have heard them re- lated, are as follows:—A car attached to a freigh train, bound west, had lost a wheel, and was being carried down a grade by the momentum of the train, pitching aud jumping over cross ties, and | making the fire fy out of the stones and tron. hiv | Hoopes was coming eastward on a train with fast freight, and as he neared ihe wrecked train he thought e saw sometiung wrong. It was ae and to see more plainly he stop. ped to the fireman’s _ side, whieh is next the ovher track, Just then the wrecked car struck his engine, breaking his leg in four | places, crushing his hip, tearing away half of one of | hus fees and knocking him, in company with the lire- men and brakeman, back into the tank. Every man upon Mr. Hoopes’ engine was lajaie The fireman and brakeman lay senseless on ie door of the tank. The conductor of the train and the other brakesmen Were On @ rear car and Lew nothing of the disaster. ‘The tram was not so muen injured ‘Was not proiptly stopped it must run into the hind end of the one next ahead, which would stop at a sta- tion less than three miles off for water, Mr. Hoopes, crushed and bleeding, dragged himself slowly and painfully over the prostrate bodies of his conirades i the throttle valve of his engine, shut of the siesm, whistled down brakes, sounded ihe summons for t conduetor aii fell back exhausted. When th stopped and the conduetor came fo Hoopes was trying to stop the flow of blood irom ms woands by tyimg up hts shattered leg, and said, “It Ig all up with Ie; do the bost you can for me.” He lingered until next day In great agony, which he bore wlth his usual bravery, and thea diod, Ja- mented by ail who knew bin. Surely the name of Enos J. Hoopes should have a prominent place tn the history of those who have herotcally died at their posts ia the conscientious diseharge of their daty.
