Sears et al. vs, The Seamer Scotta et. at.—Jadg- ment was rendered in this case yesterday, It ap- pears that the Berkshire, & sailing vessel owned by the ibellants, and the Scotia came into collision at and the Berkshire was injured. The collision hap} ned at night. The District Court dismissed the libel and the case came on appeal before the Circuit Court. While it is true that our navi- gation laws are tn astrict technical sense Municipal, because we have no power to legisiate for other na- ons, nor to enforce our iaws beyond our Own juris- diction, they are iu their nature and scope, and as I think in their design, for the benefit of man- kind, The safety of human life and property on the highway of nature Is of international concern. ‘If the government of this people have adopted a rule to promote such safety, tt is because It is wise and best to that énd, and so our courts must declare. For this people and for our own courts it 1s the rule of right reason, Whether we can enforce it upon the ple of other nations or not. It being wise and st, we can and do send out our navy and our mer- cantle marine charged with the duty to observe it, because it tends to secure the worthy pur; for which it is enacted. True, we can subject no others to its pressure as a law to them, by it ls @ narrow and technical view to say that it 1s Iike the na | subjects of Peace bey are plainly only intend to operate within our immediate jur! eqiotion. The business it regulates is as extensi the limits the seas, and there are numerous rights of person and property which we recognize as governed by law, and which wili be enforced and protected by our courts 1n whatever part of the ‘world they originate or are invaded, And sending out our navy and marine instructed by our statute, it is ge) unworthy to say, although these rules for servation of life and property are eminently flited to benefit all mankind, are expe- dient and advantageous as guides to our private in- tercourse with other veanels they. go not ec aay to regard them toward any but vesser nation, it is a more honorable and worthy lan- guage to say, if you disregard them, and 108 1s thereby caused, you shall not have astanding in our courts. Duffy, the Nototious First Ward Fighter, Sent to the State Prison for Attempting to Kill a Policeman—Remarks of Mr. Howe and Assistant District Attorney Fellows—Su- perintendent Jourdan in at the Last Act of the Drama. Before Recorder Hackett. ‘The proceedings in this court to-day were of ‘unusual interest and importance. Assistant District Attorneys Tweed and Fellows appeared for the pro- gecuiion. After disposing of a few unimportant cases, My, Fellows moved on the tial of Patrick Duffy, against whom there were two indictments for felonious assault _ battery, serintenga a ted to kill two police officers, Superjntendent Jourdgs, who, of course, took f desh incerdet In thid ihatier since the occurrence, was in attendance to see that the prosecuting officers and the Recorder were not misled by any statements that might be made in ex- tenuation of the aggravated and anwarrantabie as- sault committed upon two members of the police force of which he 1s the vigilant and efficient chief, Indeed, 1t is a common occurrence for Superintend- ent Jourdan to “turn up’? tn the General Sessions when any noted criminal is to be placed at the bar, thereby materially aiding in the prompt and vigor- ous administration of criminal justice in this city and county. Mr. Wm. F. Howe, the counsel for the prisoner, said:—In this case tne defendant, Patrick Dufly, has been indicted for an assauit with intent to kill David W. Dyckman, who was at the time of the assault and is now a member o! the Metropolitan Police. Mr. Superintendent Jourdan has, on behalf of the police, ‘watched this case from the time of the arrest of the accused until the present moment, and has, I be- eve, given to the learned District Attorney reasons why the prosecution m this case, a8 in all others of that nature, should be energetic. Iam free to say, after carefully perusing the papers, that to interpose a defence would not inure to the benefit of the ac- eused, but would be a waste of time. I desire, in pects dart Md plea of guilty, simply to state to the court that Duty, bad as he may be in public estima- am ig not without some bright spots in his char- acter. Mr. Howe went on to say that Duffy served bravely through the war under Colonel “Billy” Wilson (who was in court), had endured hardships which bad shattered his constitution, and w! had sow left him, according to the siatement of the physician, in the last stage of consumption, ‘the accused desired the counsel to state that he regretied the attack which was made upon the officer and the alarm that had been raised in the community oy the commission of the offen In conclusion, Mr. Howe hoped, in view of the mitigating circumstances he had enumerated, the Court would inflict the lowest penalty which could be imposed for the offence to which Duffy pleaded guilty. Assistant District Attorney Fellows said that it ‘was his duty to call the attention of his Honor to the facts of this case. Au officer, while in the discharge of his duty attempting to arrest a person for a dis- turbance in Broadway, was approached from behind by the prisoner, and struck a blow on the neck, near @ Vilal point, with a weapon which might have pro- duced death, He drew out the blade and imme- diately repeated the blow; but providentially the biade of the knife broke, so that the life of the officer ‘Was spared. The facts surrounding this case called for the exercise of the stern justice with which his Honor was clothed. Mr. Howe urged in eloquent terms the service which Duffy rendered his counwy during the war in mitigation of punishment, Recorder Hackett, in passing sentence, observed that the prisoner pleaded gutity to an assault with intent to kill. He read the statement of the occur- rence in the newspapers, and the remarks of the Dis- trict Attorney corrovoratec the account. In the ex- ercise of what he (the Kecorder) believed to be his duty, he sentenced Duffy to the State Prison for the period of nine years and six months at hard labor. The indictment to which he Rleeded guilty charged him with assaulting David W. Dyckman, of the Eighth precinct, on the 2d inst., at the corner of Houston street and Broadway, while arresting James Casey for being drunk and disorderly, BROOKLYN COURTS. COUT OF SESSIONS. M. ‘The Wall etreet markets continue exceedingly duil, There was a light attendance of brokers at the Stock Pxchange and Long Room to-day, and transactions were confined to a few of the leading speculative shares, THE CURRENCY BILL, The revised form of the Currency bill of Mr. Gar- field having elicited many inquiries as to its present features, a special from Washington gives the foliow- ing information;— Section one provides for the issue of ninety-five mitions of dollars national bank notes. Section two cancels forty-five and one-half milijona of three per cent certificates and thirty-nine and one- Balf millions of greenbacks, Section three, wnich was the tenth section of the original bili, takes twenty-five millions of national bank notes from the States having an excess, and distributes it through the Western and Southern States; but this is not to be done till the ninety-five mitlious have been issued. Section four allows a bank tn @ State having an excess to remove to @ State in deficiency, taking with it its capital, circulation, &c. THE BANK STATEMENT. ‘The weekly statement of the associated banks Is unfavorable, in showing a loss of about three and a half millions of reserve, although as the deposits are down about five and a half millions the surplus re+ serve falls off only about two mullions, The loss in specie is two and a half millions, reflecting the heavy payments of cusioms this week and the ex- port of specie. GOLD STBADY AND HEAVY. rhe gold market was heavy, with all the sales at 113% and 113%. ‘whe declining tendency of the pi mium is due to the expected hea¥Y paytheut of coin interest by the government within the interval to July 1, and to the large increase in the cotton re- cepts, which are over seven hundred thousand bales In excess of the recelpts up to this time last year. The exports of cotton so far are nearly six hundred thousand bales greater than last year. M. + 10085 Loss $30,000—A Bookkeeper Arrested on Suspicion. ‘The four story brick building, owned by Mra, Cox, and situated at the corner of Fulton and Nas- sau streets, Brooklyn, was discovered to be on fire at half-past two o'clock yesterday morning. The alarm was promptly responded to by the Fire Department and the conflagration extinguished. The first floor was occupied as a grocery store by James H. Eble, and the other part of the house was employed for the storage of furniture and was leased for that pu pose by John J, Werner. The damage to the butldin 1s $5,000; Mr. Ehle’s loss on stock amounts to $5,001 insured for $10,000 in the umbla Insurance Com- pany. Mr. Werner, the principal loser, estimates his joss in valuable furniture at $20,000, The stock was in- sured for $25,000 among the Lafayette, Common- wealth, Williamsburg City, Germania, Fireman's Trust and Imperial Companies, On the third story, where the fire was discovered was found a large quantity of oil, varnish and tut pentine, straw mattresses and other highly miam- mable material, heaped upjin such a manner as to leave but little doube_as to the incendiaty origin of the conflagration.
