10 "PERRY'S rs THIRD, * TRIAL, FINANCIAL AND COMMER CT, THE MURDERED, yigiT WATCHMAN. Bcoond Dar, Proseedinge~ ‘Testimony for the Pyeseoution--Hayes’ Dying Declara- tion, “Ea Porry Shot Me,” TUESDAY, 3S 12—6 P. hk} By resolution sfopte?, cms ‘otning the ‘Stock Ex- change decided to adjourn over Good Friday. As the day te not a légal holiday the banks and private panking hougés will be under the necessity of re maining open w meet sight drafts, notes and like paper, FURTHER DBCLINE IN GOLD. The gold movement has been a failure, and the price to-night is back among the quotations which 80 long prevailed in the monotonous dulness which followed the great ‘‘break” from 120, ‘The causes on which the advance was predicated were so purely artificial that the clique found it impossi- ble to take the gold which was Mowing in to them from all quarters. ‘The outside dealers who knew the intentions of the clique, and who had loaded up with them when the price started last week from 112, were the sellers to-day; and as foreign exchange also became weak and declined the gold market gave way to 1125, at which it was rather firmly held through purchases by those who had the courage to sell short at the high prices of the day before, and when the clique, to sustain them- Selves, were bidding wildly for vast sums, The transactions at tha Clearing House to-day were over @ bundred militons, There was no very great out- side enthusiasm whe gold started to go up. The clique did oll the excitement and gesticuiation among themselves. Hence upon the collapse to-day all the markets became dull, and Wall street bids fatr to re- lapse into the monotonous dulness which prevailed Just before the gold movement was started, The course of the market is shown in the table:. ‘The third tial of Miwin Perry for th mnrder of ‘Thomas Heyes, night watchman at Harbeox's stores, Furmea virect, Brooklyn, Was continued in tne Kings cpunty Court of Oyer and Termizer yesterday mora@ag, Judge Barnard and Associate Justices Weomnees and Johnson presiding. The court room ‘Swan densely crowded asupon the previous day. Mr. Charles 8. Spencer conducted the case for the ‘efence ana District Attorney Morris and his assist ‘ant, ex-Judge Moore, appeared for the prosecution. A jury Saving been secured on Monday, Mr. Morris, ‘after the opening of the court yesterday, proceeded ‘to open'the case‘for the people, telling how Hayes, alter being shot in the archway of Harbeck’s stores, @baggered out, got aboard of a car and rode (0 Ful- ‘ton -ferry. The conductor and driver saw him near ‘ghe “archway, ana heard him say that he had Scaig poe and ips Edward Perry had shot 8 came up, and to them he re- Ses the assertion. He was taken in the car to , and while on the way, fearing that he die, he requested the gonductor to take bis rt ress, which he rave as No. 252 South Second ‘street, B.D. When he got to the Fulton rerry he was-unadie to stand, and was assisted ito a car- Tiage and thence taken to the York street polic: pa, He was asked the particulars in regara to the affair, as to who had shot him, &c., when he replied “Edwin Perry.”? The officers took him to the hospital, Where be died almost immediately after entering. On. the way to the nospital he reiterated that Edwin Perry was the man who had shot him. Shortly after ‘the shot was fired @ man was seen going towards Montague street irom Harbeck’s arciway, Where whe Bhooting took place, on a slow trot. He went as far as Roberts’ archway, turned down and that was the last seen of him for a few moments, as the prose- cution claimed, Mr. Morris exhibited a diagram showing the location of Harbeck’s and Roberts’ Blores, and continued his remarks. Tne engineer of ‘the flour mull in that vicinity while standing in frout establishment saw this party as he passed down the archway. No one swore positively that ‘the party seen there was Perry; but they described the size of the man and the coat worn by him, just such a one as Perry had on the next morno- ing. The prosecution claimed that Perry passed gown the archway w the dock and thence out to the Wall street ferry. He was next seen at twelve minutes before seven o'clock by officer McDermott about 125 feet from the jerry house. The oficer looked at his watch at that time for the rea- son that it was his relieving time, and that he was, ‘therefore, enabled to specifically see the hour. then went to Kernan’s liquor swore corner of State and Farman streets, called out Wiliam McCormack aud stated that he lad had some trou- ‘bie with some Iriends; that they had Dred upon him nd tbat he haa fired back. He wanted McCor- mack to go to bis wife and get $100 from her; but as MoUormack expressed doubt #8 to whether Mrs, Perry would give him the money the prisoner gave hun’a note written upon a leaf torn from a@ note book. McUormack took the note Wo Mrs. Perry, who took @ car going in the direction of where her husband said he wouid meet her. Dia wict Attorney Morris then related how the prisoner was seen by other partes afterwards and finaily crossed to New York, where he was last seen that night in Catharine street. At the close of Mr. Mor- rly’ remarks the examination of the witnesses for the people was couimenced, TESTIMONY KOR THE PEOPLE. Dr. Henry McManus, of the Brooklyn City Hosp!- tal, who made the post-mortem examination of Hayes’ boay, was the first witness calied, He stated that death was caused by Internal hemor- rhage, produced by the bullet wound, ‘Thomas Delaney, the conductor of the car in which Hayes, after being shot, rode to the Fulton ferry, Sestided that few minutes after seven o'clock on the evening of tue 235th of December, he heard a pistol shot while about twenty feet from the arch- Way of Hardeck’s stores; immediately thereafter he Saw Hayes, who said something. What did he say? ir, Spencer objected, on the ground that the state- ment Was not in the form of a dying declaration. ato Larnara overruled the objection, Excep- m note Witness replied that Hayes exclaimed, “I am shot; Ea Perry sbot me.” He got off the car and found Hayes aoout five {eet from the archway coming to- wards him; Hayes goton the car and then asked ‘Witness to take him to @ doctor; on the way to Ful- ton ferry he said to Delaney, ‘For fear of me dying, will you take my number?" and gave his residence 8 no 252 Soutu Second street; when they arrived at the ferry Hayes, who was scarcely able to waik, ‘was taken in charge by Some parties, aad that was ‘the last witness saw of him. Dr. McManus was recalled, with reference to the Dadi taken from Hayes’ body, aud stated that the one produced in court resembied that which he nad ex- 13% 12% Holders of gold paid 5, 634 and 6 per cent to have their balances carried over. The aggregate amount of exports (exclusive of specie) from the port of New York to foreign ports for the week ending April 12, 1870, was $3,213,107, MONEY MORE ACTIVE. The effect of the bad bank statement of Saturday has not been entirely overcome. Although the banks are freely lending to good customers and dis- counting prime paper the rate on call was firmer to- day and @ great deal of new basiness was trans- acted at seven percent. ‘The general rate was six per cent, but the exceptions at five were fewer and confined almost exclusively to the leading govern- ment dealers, No essentlal change was reported in discounts. FOREIGN EXCHANGE DECLINED, The advance tn gold yesterday induced large sales of bonds, the bills drawn against which weaxencd exchange, which declined to 108% 9109 for sixty days sterling, although the nominal quotation for prime was 109}{, ‘The little business of the day was atthe figures first quoted. The range of rates was as follows:—Sterling, sixty days, commercial, 10834 a 10834; good to prime bankers’, 10874 @ 109%; short sight, 109'¢{at100%¢; Paris, sixty days, 5.2234 w 6.18%; short sight, 5.1734 0 5.1654; Antwerp, 5.22)¢ @ 5.18%; Switzerland, 5.2234 85.18%; Hamburg, 8534 @ 3574; Amsterdam, 40) a 40%; Frankfort, 401 a 4055; Bremen, 775 @ 783¢; Prussian thalers, 705¢ a 71. GOVERNMENTS STEADY, The government market was steady, the decline in gold to-day ving been seemingly discounted in the quotations for bonds last night, while prices of five-twenties in London were better by an eighth to & Guarter per cent upon the reaction here in gold tus forenoon. The Assistant Treasurer in this city will receive proposals to-morrow for the sale of one milhon of five-twenties to the government. Lous Demar, officer McDermott, Andrew Moon and William McCormack were then examined, the most important part of tne latter witness’ testimony being in relation to the request made by Perry that Witness would go to Perry’s wife and get $100 from her for prisoner. William Crowell, officer Alfred Smith, Wiliam Ennis, Mary Masop, Thomas Clatr, Thomas Norton, officer Matthew Kelihan and Charles Colby were not examined. The stock market was heavy in earlier dealings, in sympathy with the decline in gold, but was rallied later in the day, when it became extremely dull. Prices were forced up on light transactions in such a Way as to suggest fictitious purchases or ‘washes,’’ which is the final resort of desperate speculators. Buyers are still too few to keep the market up natu- Tally. The cliques own all the principal stocks, and are periectiy willing to sell to the street. The directors of Pittsburg have declared a dividend of two and a half per cent, payable the 25th Instant, the books closing‘the 16th. Rock Island was steady, if not strong, on a showing of $14,764 increase In the earnings for the first week in April. The ‘shorts,’? who were deceived into selling St. Paul, sought to cover to-day and put the price to 6034. The “ring” are anxious to get thoir stock back again. The earnings of the roaa continue to fall off. The decrease for the first week in April 18 $8,948, which is better, how- ever, than last week.
