Barr, of Broad street, A motion was made by Juage Curtis, Larr's counsel, before Judge Spencer, in the Court of Common Pieas, to vacate the order Of arrest previously issued against Barr, at the suit of Van Saun & Co, A number of afMluavits were submited, which, while exonerating Barr, charged Van Saun with fraud, and amdavits in dental were Produced by the couusel of the latter. ‘The ‘Weiglit of evidence was against Van Saun & Co. and in favor of Barr. Judge Spencer took the papers, but has not as yet rendered a decision tn the case. In the meantime both part.es, by their counsel, have been actively engaged in preparing for the legal con- test. Mr. Stevens, Barr's attorney, retused to tell us who the Joun Wiliams was making the am. davit, and the notary dia not know, except that he Was tntroduced by Stevens: and os there are forty- two men of that name in this year’s directory it seemed aimost impossibie to track him out. But tis trouole has been happily Gisposed of by the frauk admission of Joseph Dows u he never Knew any such person, As to the other witnesses, Kutger Teal, B. C. Bradman and Andrew J. Wightman, produced by said Barr, every ove of them owned up at once that their affidavits were faise, and gave our attorney atidavits stating how their afliuavits were oviained and in which Ubey state that they would never have signed the @Midavits respectively is they bad koown tnat they contained any such statements. Our attorney found Josepn Dows in Philadelphia on Wednesday, and tue following is the resuit:— PHILADEPHIA, March 22, 1870. Dian Sims—Have just found Dows. He cidims to have been master of the whaling ship Ganges many Years ago, and also to have owned several trading Vessels, In 1843 he came to California, and when the goid excitement broke out he tried his luck in mining and made some $7,000.
