The Opering of Madison and Berrian Avenues — Highly Important Legal Opinion—The Law in Reference to ‘the Opening of Highways— Rights of Citizens and Ir- remediable Corrupt Legislation, On December 27, 1869, a writ of injunction was wasued by Judge Tappan, of the Supreme Court, re- Sstrainiag the commissioners of the Madison avenue improvement, in the town of West Farms, West- onester county, from proceeding with the improve- Ment,"and at the same time an injunction was served upon the Receiver of Taxes restraining nim from collecting the moneys due as taxes aud as- gessments for the improvement on Madison and Berrian avenues. ‘fhe matter subsequently came before Justice Jo- sepn F. There are two fatal objections to this writ, irre- spective of the errors alleged to be reviewed and corrected by the writ. First, the relator has no standing in court to prosecute this writ; he 1s simply @ resident and taxpayer of ¢he town of West Farts, and has no concera with the questions pre- sented except as 4 citizen and a person habie to be taxed. Y., 318.) ‘The second objection to the writ is, that 1t removes the record of more than one road opened by the Legislature under alferent laws aid by diferent commissioners and passed at different times.
