VIRGINIA. _- TOR 4487 pester TRAGEDY. 4 Ponrenneueneenre Leen Brent Prevalence of Crime in the State—tien- ‘Tho een seer a ee ba and Its £fecte—Criminals ‘usec (From the Boston Advertwer, Nov. 17.) from Justicom—Other Criminals Discharged ‘Yesterday afternoon Coroner Wiison held a jury of ‘ansition from military to olvil authority—a degree ‘of crime has prevailed throughout the State uppre- ‘edented since the close of the war, Murder, arson on rape have bee n rife within the past few months, tit iso remarkable fact that this fearful epidemic of outrage agsumes no political caste, nor does it resent the slightest appearance of an antagonism ween the races. On the contrary were is @ beau- ful calm in the political world, consequent upon fn early assumption of the Stare’s relationship to the Union, and never bas @ more smicabie feeling existed among the negroes and whites, who were po long divided by political disseasions. ‘The only manner in which 3t can bo accounted for 4s eho total absence of law im tae communities in ‘which crime is so prevalent and the thorough incom- petency of the irou-clad officials appointed by the Ynilitary. No security is felt by the peaceably dis- while these irresponsible minions assume Bontrol of the civil power and the utmost license is ‘youchsafed to desperadoes of every ciass, most or ull of whom, strange to say, escape their merited and justly deserved punishment yc is alleged that im numerous instances Genéral Canby has, too, with singular inconsistency Yaken the most notorious criminais from the jurisdic- tion of his reconstrucved courts and turned them over for trial by military commissions, with the un- derstood determination of shielding them from jus- face. A radical police officer in the city of Richmond who delberately murdered a citizen named Kolly, Which mourred the tmdignation of all classes, ‘was under Canby's order acquitted by a singic mill- tary oificer, when, had he been tried by ajury, bis neck would have undoubtedly paid the penalty of his terrible crime. Norfolk @ few days since fur- plished a similar case, where @ policeman ia ue per- formance of duty and in defence of nis lite killed a poldier, was arrested by the civil authorities, in- @icted and about to be tried, when agam Canby in- Sorposes and turns over the criminal to a mulitary commission, but this time with the object of iusur- ing the severest penalty of the Jaw. Such high- handed partisan measures, taken im covusctiou with tue characters or the scores of adventurers ‘Who ds sheriffs, justices and constabies have been, @ppointed to enforce the law, has tended to produce ‘au unparalleled carnival of crime in this hitherto Poeacoable old Commonwealth, until latterly she bas become tue rival of North Carolina, waere an inves- tine and bioody strife wages between the Ku Kiux Snd the loyal !oaques, Ina single day intelligence of a number of affrays and murders has beea received here conclusive of this lamentable state of affairs. On Saturday last, . in Floyd county, 9 man named Trice shot in three places aud Instantly killed another named Gib- goo, Asreported it appears that in the month Of June fast Gibson avvused Trice of the commis- Bion of a most horrible crime, end on his allegation the latter was arrested, but alter a preliminary @xamination heid by three of Canby's justices he ‘Was acquitted and discharged. Gidson’s testimony @asatdto have been lmpeached successfully, and Chat i¢ was shown he was unworthy of belief. However this may be, Gibson continued to pursue Trice, evidently earnest in the justice of his accusations, whatever they may have been, never yielding an opportunity that offered of taunting and abusing him, This lasted Until saturday, when the partios again met at Cooper Valicy, in Kioyd county, when Gibson, 96 nstial, made a yerbal attack wpon ‘Trice, which that person resented by drawing a revoiver and shooting Gibson turee times, fromthe effects of Which be soon expired. ‘Trice promptiy surren- dered himself to the civil authorities ond was, for the crise of deliberate murder, beld to bali in ‘whe sum of $500 for his sppearance for trial, Many Justify Trice for chis summary deed, but tt bears ‘upon its face lawlessness and a disregard of the gecurity of the person quite at variance with all the * * usages of civilized society. The amount of atl alone for acrime Wat is not bailabie under the laws of Virginia, shows how utterly incompetent the exist ing autuorities are. Another remurkable case, the exact particulars of ‘Which are not in my possession, is the arrest in Rockingham county of Colonel &, J. Armstrong for the alleged murder of M. L. Shanks soine time last summer, This gevtleuian was arrested atthe (ime of the alleged crite, aud Was legally Wied and hon- orably acquitted by a judge and jury—the moue rescribed by ine code of Virginia. Notwithstand- this, howgver, ve was again arrested, again tried and agaln acquitted. Suv now tue military inverfere, rearrest.lum, and are, it is supposed, ‘about ro wy Lim by military coiwtmission for the offence he was twice tied of by the civil court Where is the haveas corpus? Canby laugbs at such documents as that. . On, Tharsday morning last, In the same county, ‘two negroes, respectively entitied Jona Wright and aerry Jones, the former avout seventeen years oid and the latter #'30 @ Young maa just Luli grown, be- came embroned ina difiouity Which resuited faially WoJones. Jones attacked Wright, wao with more juck than wisdom, perhaps, ran away to save him- 3ell, DUE Was overinken duu coughs by Lis Assailant, ‘Who Vigorously proceeded to beat him. Again Wright escaped and ran, still pursued; but ta time driven to extremes, ae picked up a sinall stone, which he tirew with accurate aim and great force, taking edect on Jones’ head and killing Bim In. Bieutly. Wright was arresied aud is now tn jai awalting an investigailon. It ts hardly provadic, however, thatthe milivary will luverfere im (ois case Unless Wright be discharred, aud be atterwaris dis- covered to have been u couservative “nigger,” Angther case has just been brought to my nottee In which @ miliary oficer eMected the excape of a * notortous murderer, then on Wial, from tae county Jail of New kont. fvcre were three criminais charged with the marder, some twelve montis Bince, Of a half-breed indian man and & white wo- jan with whom he was living, The mau they ied in a field a few hundred yards from the house, Which was burned 2s soon as the Woman bad been @eapaiched and watever money was within it secured. These desperadoes were Just pvt on trial, and, in consequence of repeated efforts to escape, the Sherif thougut it proper to imerease the guard, and for this purpose he consulte. the miuitary officer of the district, who himself made the appointments. In a tew days, Dowever, the sheru? discovered some of the mem- bers of the guard careless and incompetent, and he accordingly, asin duly bound, applied for their re- Dioval aad the appointment of more eMelent men, ‘This, however, the sailitary oMcer refused ty do and he peremptorny ordered ‘the game men to bo re- tained until 1 was his pleasure to disevarge them. ‘The result was not unexpected. Tbe prisoner, who ‘was the principal of the criminals, escapea and is now at jarge, witi but littie prospect of being cap- tored in the prosent orgautzation of the civil ot cisis in the State, Anotuer case of military Snter- Zerence with the due course of the iw. THE DOLAN HOMICIDE IN PHILADELPHIA, Acqulttal of the Prisoner. From the Philadelphia Ledger, Nov. A numberof the boys who were in tue crowd that followed Mr. Collins and the two ladies witi him were examined as witnesses, and they in part sustained the siatement already published as the case of the Commonwealth, Being exciuded fro the court room, and examined singly and ont of the hearing of their companions, their statoments differ- ed insome particulars, One boy alleged that tae crowd consisted of but twelve or ilftcon boys, while James Hancock, the large voy, put the niber at twenty or twenty-five, and when examined at length admitted thas the boys were jostiing Mr. Coluas snd the ladies and were noisy, put denied that he saw stones thrown, although he adwitted that he heard some of the boys say that stones were used.
