10 BROOKLYN CITY. THE COURTS. UNITED STATES CIRCUIT COURT. Jurors Must be More Particular, Before Judge Benedict, At the commencement of the October term or the @ircuit Court on Wednesday last, when the panel of petit jurors was called, it was discovered that many who had been summoned had failed #0 attend. Judge Benedict requested that a lietof the delin- quents should be made out, and yesterday morning ‘wo of their number appeared before him and fijed affidavits settiug forta that they had beeu prevented dy sickness from attending. Judge Benedict remarked, after reading the am- @avits, that many gentlemen were in the habit of habiiually disregarding @ summons to serve aa jurors and doubtiess dia so in ignorance of the fact summons from a United one ment, at the discretion of the judge. Tne offence amounted to contempt of court, and as i bad lauierly become of very common occurrence he shonid avail himself of the first’ opportunity to Make such an example aa woud serve to ceter that a Jailure to obey such ‘States court coula be pumsned by fae and impr others from abseuting themselves, Tie cases be- fore him would have been very severely dealt with, #8 they had been served personally, bat for the aim- dayite and otuer evidence that sickness bad been the cause of their non-atteudance, They were dis- inissed with a caution to be sure and be in attend. ance Lo-day, PUM COURT OF OVER AND TERMENER. Opening of the October Term. Before Judge Gilbert’ and Associate Justices. The Circuit Court of Oyer and Terminer opened at ten o’elock yesterday morning, with Judges Gilbert and Troy aud Justices Hoyt and Voorhees on the bench. Among the cases to be tried are four for alieged murder, Before the opening of the court Owen Hand, who ts held on a charge of causing the doith of a man named O'Donnell, in the gas house, & short time since, was brought down from the Ray- mond street jail. He was accompanied by a young man uamed Robert Berry, who, it is alleged, played ® prominent part in the riotous proceedings at the corner of Johnson and Navy streets, where a man mamed Donnegan lost his life. The court room was crowded with gentlemen of the jegal profession, and others who had been sum- moned to act as grand and petit jurors. ‘The folowing genuemen were empaneiled to act as Grand Jurors:—Wiham H. Douglass, foreman; Nathan D. Adams, Charles W. Remington, Edwin A. stucdwell, Richard F. Brown, Charles H, South, Alexauder liager, Josep Merril, George H. Lewis, James Sullivan, A. L. Scott, E. B. Simpgon B, Ane drews, Sereno E, Todd, William H. Edwards, 8. 8, Davis, Joun G. Burley, H. D. Mathews and George A. Waterbur, ert, in bis charge to the jury, stated t ere no special cases to which it was necessary that he should call their attention, a3 a grand jury bad been in session for nearly @ mont and tie calendar was almost cleared. He then instructed them in relation to the manner of pro- ceeding to business and the proportion ot their num- ber required to form a quorum. He then said there ‘Was a class of cases to which he thought it was his duty to cali their attention, They were aware that eeveral years ago the jaw was altered, and parties rosecuted were allowed to testify in their own ehalf, This nad caused tne crime of perjury to become a very common one, and it had led to a largo number of divorces being granted both ia this and other jcounties, He understood that some cases of that kina would be presented before them, and he believed they would be derelict in the performance ef their duty if all such were not thoroughly inves- Migaved. He concluded by ordering their attention to the offe. ces named in the statutes as those over Which they had cognizance. Owen and Was arraigned on a chatge of causing the death of a fellow workman, named O’Donnell, dn the gas house, a short time since. He pleaded not guilty and bis trial was set down for next Monday. Rovert Berry, & respectable looking young man, pleaded not guilty to a charge of causing the death of James Donnegan, on the corner of Jonnson and Navy streets, in May last, His trial was eet down for next Tharsday, The first trial of the term will commence to-day, + as which time a colored man pamed Francis Drake Will be tried for homicide alleged to have been com- mitted at Crow Hill during the early part of last + apeng.
