Mary Bloodgood vs. Sarah Wison.—The defend- antin this action was arrested on a civil warrant Jor wilfully and maliciously injuring plaintiffs pro- perty to the amount of seventy-five doilars. A day or two after plaintiff called on defendant and demanded her property, which Was ‘thereupon restored to her, with the ex- ception of the dress in question, which defendant refused to defiver up until a claim which she had against the plaintiff was satisfied. But even if they had this.ac- lion could not be maintained against the wife alone. ‘The husband 1s a necessary pai y, for the wife can mot be sued alone for a tort committed by her. (Code, sec. 1i4; 9 Wend. 235,) Both are chargeable for a wrong done by the wife, and both must be joined as defendants. (2 E. D. Smith, 91; Reeves Dour Rel., 4%; 2 Hilt., 179.) In such @ cise the husband may be arresied, and after judgment his wife may be charged ™ execution with him. (Solomon vs, Wass, 2 Hilt. 179, and cases there cited.) Taylor vs. Henry Burr.—This acuon was brought by the plaintiff, a private detective, against she defendant to recover an alleged balance due to him for services tn procuring testimony to enable one Mary Town to procure a divorce from her hus- band, Joseph Town, in an action in the Supreme #ourt, the said Mary Town being the daughter-in- Jaw of the defendant in this action. ‘The plaintift was sworn in his own behalf and tes- ed chat he was introduced to the defendant by A. ke, an express agent of Adams & Co., at his rorner of Broadway and Spring street, and at e interview the defendant employed him to pro- cure the necessary evidence and agreed to pay him ‘the sum of $1 id that he furnished the evidence aud Mre. POLICE INTELLIGENCE, ALLEGED BURGLARY.—On Friday Martha Holman detected a German named George L. Schultz in the room of Charies A. Gunsi, No. 221 Sixth avenue, which he had entered by forcing off the door bolt. It is charged that he was detected in the act of steal- ing $150 worth of clothing. The prisoner was com- mitted for trial, in default of $1, bail, by Justice Dodge yesterday. ROBBING A POLICEMAN.—OMcer McKenna, of the Fourth precinct, yesterday alternoon found Cathar- ine Dwyer in the City Hall Park in a helpless state of intoxication and proceeded to take her to tne Tombs Police Court. He first, however, took charge ef abagin her possession containing a draft for £125, thirty-seven pieces of British coin, three pas- sage tickets for Liverpool, two breastpins, a pair of earrings, and altogether of the value of $977 61, and transferred the same to one of the hind his coat, While he was helping Catharine to her feet he felt @ clutch at his tail coat pocket, and, tura- ing round, caught a young man with the bag in nis possession. e forthwith, took the prisoner to the Tombs, before Alderman Coman, the sitting magis- tate, ‘The prisoner, who gave his name as Patrick Riley, was committed to answer in default of $1,000 bail. ARREST OF AN ACTRESS—THE LARCENY OF A PIANO CHARGED.—Before Justice Dodge, at the Jeffer- 80n Market Police Court yesterday, appeared Horace Waters, piano dealer, Broadway, accompaniea by detective Crowley, of the Twenty-ninth precinct, trick and device of a piano of the value of $300, and asserts that on the 2d of January, 1867, the accused came to his place, leased a plano ‘at the regu- lar monthly rental of seven dollars, that the instrument was sent to her residence at No. 330 Fulton street, Brooklyn, and payments amounting in all to ninety-four dollars made upon it; that the accused, after the last payment, left the city and sold the piano. The lady e ed a plea of not guilty, and through her counsel, Jonn Wait- ra: asked and obtained an examination. lengthy cross-examination followed, during hich Mr. Waters admitted that Mrs. Roberts had made several payments after he had learned that she had disposed of the instrument. The contract between the parcies to the transaction dated Janu- ary 2, 1866, was put in as evidence and counsel claimed the benetit of the statute of limitation as over three years had elapsed since the commission of the alleged offence. Mr. Waters swore that the entry on the date of the contract, “January 2, pa was a clericn! error that should read “Janu- 2, 1867," and counsel’s objections were over- ‘As the complaint charges that the 10 Was: leased with the intent to defraua compi: it, and the evidence shows that nearly $100 was paid as rent, it is very questionable whether the Grand Jury will indict. VELOCIPEDE NOTES, Two great improvements will be perfected this week in velocipedes, and both are just the improve- ments that bid fair to make the velocipede a ma- chine of everyday utility, doing away with the jarring sensation when riding over rough pavements, and the second is a device that trebles the speed with less than the ordinary power and one-fourth the velocity of treadle move- ment. TERMINATION OF AN INQUEST.—The Coroner's in- quest commenced on Friday, touching the death of an unknown youth who was killed by a New Haven train, the particulars of which appeared in yester- day’s HERALD, was resumed yesterday afternoon.
