ADDITIONAL PARTICULARS—A CURIOUS SCENE IN coURT. [From the New Orleans Lt aesig Dec, 19.) The elopement, or rather private marriage case, mentioned in the last edition of the Zimes, came up before Recorder Becker Friday. The (cea pr a youth of perhaps twenty, 13 charged in the afidavit with having on the 22d of November last made oath before Gcorge W. Sadler, a justice of the peace, that the daughter of prosccutrix, — lady of about seventeen years of age, had attained her majority, and that m consequence of such affidavit the said Justice Sadler issued a marriage Mcense permitung the celebration of the napttals of the young lady and a spn of the accused, Colonel Len yey, who appeared as counsel for the defence, contended the impossibility of any one other than a mother being competent to testify to theage of man or Woman, and tn consequence nid the decisions of the Supreme Court were to the effect that owing to the very Pel beer no perjury could exist in cases of this character. Perjury con- sisted in wilful, false swearing, for the ae purpose of deceiving. There could not possibly be deceit in this, as the Justice knew as well as any one the accused could not, under any ctre ces, of his own knowledge testify to the young jady’s exact age. It was coutended by the court that the per- jury did not consist in falsely swearing to what he could not know, but im testifying he did kuow what it was certain he didn’t.
