Chmrge to the Grand Jary—The net she Coecealed Weapons Acts Discussed. Before Judge Russel. The January term of thié court commenced ‘yester- flay, his Honor, Judge Russel presiding. Assistant Dis- trict Attorney Hutchings will conduct the prosecution. Tho first bas! nese in order was the empanelling of the Grand Jury. Mr. Stephen Hyatt was chosen by the Coart to act as foreman, The City (judge then charged the Grand Jury as fol-, low: GuNTLEM?@® or THE GRaxD Jury—The accountability which deviaives upon you Isa great one, ‘The relntions you bear t') the administration of criminal justice can- not be too- highly estimated, In some instances your action upo a misdemeanor, which comprebend all crimi- nal otienc #s below the degree of feiony, may-be neces- wary to tthe arrangement of partiea accused of those crimes, Aud your obligation to the community cannot be beiter cischarged than by attending to the particulars of the cr.th wiiich has beew adrainistered to your fore- man ab 4 to which you kaye ail bound yoursolf to con- form. ~fow are to take care that the guilty do not escape, sad to see that the innocent do not suffer. You are tobe merciful, but resolute in meeting the responsibiitties whieh attwch to you. You can at all times if go inciined appeal to the court for aid and legal direction, and you wii! find it ready to answer your demands upon it. Judge Russel then proceeded to instruct the jury upon the law reiating to the several grades of ofeuces that would be presented to them, ‘The court would desire to instruct the jury to investi gate ollcuces against the provisions of the act of 14th Of April, 1369, by which the sale of intoxicating liquors ‘was rogulated in the city of New York, known by the title of the Excise law, and to indict all offenders @gainst that law. The validity of that act lad been established by the highest court in the United States, and must be obeyed aud ite provisions enforced as jong Gs it remained om the statute book. The injustice of Tegisiating on such @ subject for a portion of the State Of passing moral laws wuich apply to only a portion of our citizens and our terriiory, would seem to be obvious to every mund. It is difficult to understand why the poople of this great city require to be more restrained “in the use of intoxicating liquors than those of other cities in our State. If this law is demanded for this city it is demanded for the whol Biate. Vice is the same everywhere, If thera i greater amount of it in tuis city than im any other sin- gle locality in the State, it ts because of the greater Bumber of human beings congregated here. Mucn has Deen saidand written as to the beneiits of this law, but it bus nog been and is not supported by my experience ‘aga criminal magistrate and judge. He had the honor of ascat in the present Constitutional Convention of this State, and he suggested in that assembly that a pro- ‘Vision suouid be inserted in aay constitution that might be framed by that body forbidding the enactment of laws for particular localities without aifecting every part of the State. Such legislation proceeds upon the idea that one part of.the state ie leas virtuous than another, Which the Legislature bave to and doassume. The Probability is that this Excise law would not bave been sed had it boen extended to the whole Siate; and it unquestionable that bad such been ite character it ‘would nobbave been and wouid not now be resisied as it has boon and is. i have felt constrained to say wis much, as the Legislature which 18 soon to commence is eutiied to Lave the testimony of this court (so far as am concerned), derived from observation of the workings of this law as to its wisdom or efficacy, Ov the question of Venement and Jodging Houses in. this.city and Brooklyn all would admit the humanity and” propricty of the legislation of laat ses- sion, Icia said’ that baif « million of the population are huddied together in those tevement heuses, and fore thau twenty-five thousand human beings are crowded into cellars, The act of last session reaches those two evils and prescribes the duty and (he mode of Ventilating such preimises and proviting proper means ‘of escape in caso of fire, Sanitary measures and pre- Cautions are also urged oy this enactment, Tn illustra- fou of what be stated in reference to this act he would refer to a recent occurrence whlch involved the Jose of the lives of & number of human beings im one of those tenement howes in this city. In reference to use of concealed weapons, Judge Russel reviewed the practice of carrying and ‘using deadly weapons at ©onsiderable ieagib, and concluded by saying :—“What- ever tho future may have tn store in reference to this Matier, (bere can be no ground of complaint if those ‘who wear deadiy weapons about their persons are ad- Mouished in season by the course of our courts and Juries of the liability attaching to their use’ On the Bavject of railroad and other accidents the Judge thus expressed bimself:--‘'Jt ought to be watter of con- Eratulation that Lowever frequent the accidents in our city they are wot of that frightiul or appalling kind which Bre happoning in other places and directions; steam- Woot burnings, railroad disasters and boiler explosions come to us with the issue of every day's press, Not many days eince the community were ahocked by the report of some fifty human beiogs traveiling in a rail- Toad car beng precipitated down a bigh embankment, the car Ored oy the overturning of the stove, aud alinost every one Lape: im the fiamos, It would seem as thoy there must fault or negtigence somewhere. Monpay, Jan, 6—6 P, M. ‘Tho gol’ market was strong and excited all day, aod the oxtreme range was from 134% to 13534, with the clesing transactions prior to the aiijournment of the Doard at 135%, following which sales were made at 18534, the latest quotation being 13534 813534, There ‘was's very active borrowing demand for coin, and, not- withstanding the large floating supply, loans wore made without interest and at 1-64 per cent per diem in favor Of the lender, after rates varying from one to six per ‘cent had been paid for carrying, The volume of busi- ness Was unusually large, and the gross clearings amounted to $83,890,000, the gold balances to $2,223,625 and the currency balances to $3,039,198, The impors Of apecie at the port last weok aggregated $189,550, Tho total amount of gold certificates tasued by tne Sud- ‘Treasury up to Saturday evening is $242,733,660, of which $208,578,000 have ‘deem redeomed, leaving $34,155,660 ‘outstanding. ‘There was apparently no special eause forthe advence, bet the matural reaction from extreme depression was Simulated by purchases %® cever “short” ‘contracts, aud the market is still largely oversold, white, in ylew of the finapcial situa- tion and the prospects of the country, the premium ie -by 00 means high. ‘The stock market has beon, on the whole, strong, although @ break in Rock Island, which earried it tem- porarily below 5, caused an unseitled fosting to prevail ebout noon, but this was soon succeeded by a return of ‘Confidence and a complete recovery of prices, The ‘de- cline in quosi#on was caused by a report, which proved true, thatan injunction had been issued by Judge Cardozo, of the Supreme Court, oh the application of Mesere. Fisk & Belden, stock brokers, restraining the directors of the Chicago and Rock Island Railway Company from allow- ing any portion of tno $4,900,000 of the now ewck to be trausferred on the books and from parting with any of tne procecds of the sale of the mew stock. The defendants.are to show cause on the 18th inst. why the jnjunction should not be continued until judgment ig rendered in the action, The discreditable stock-job- bing manner in whioh the stook referred to was issued calis for investigation on the part of the stockholders and a full explanation from the directors, and it is to be hoped that the latter, and Mr. David Dows and Mr. Tracy in particular, wilt not shrink from their duty in this particular. The following is the text of the injunc- tion retorred Supreme Court,—James Fisk, Jr., William Belden and Willtam B, Bradford vs. the hicugo, Rock tsland and -Pacific Railroad Company, John F. Tracy, Charlies W. Durant, Thomas P, Sturges, David Dows, David Craw- ford, Jt., Thomas C. Durant, Francis H. Tows, Oliver Chariick, Robert A, Forsyth, Ebenezer Cook, and N, B. Curtis and Clark Durant, -It appearing to my satisfac- thon by the aftidavits of Willem elden and Tames Fisk, Jr, that sufficient. grounds for an injunction bec 1 do hereby order that the defeudants. above named and ch of them refrain from allowing a transier upon the books of ‘the Chicago,,Rock Island and Pacific Railroad Company of any sbares or instruments purporting to be certificates of shares in the fapita) stock of Bald company, issued im excess of the ninety-two thousand shares of the said stock created at the organization of the sald company, and from partiag with any of the proceeds of the certificates purporting to represent new stock. of the said company in excess of the ninety-two thousand shares originally isaued, and from paying out any money of the said company for or ‘on account of the said now issue cf sock until the de- cision of the motion to continue tb # jajunction, And jet the defendants show cause at a special term of this court’ to be beld at chambers in the City Bali, in the city of New York, on Monday, the 13th of ‘January, 1868, why this injunction should not be con- tinued until judgment is rendered in this action. ALBERT CARDOZO, J. 6 C. New Yorr, Jan. 6, 1868, The bull element is decidedly in the ascendant on the Stock Exchange and the tendency of prices is upward, Speculation for a rise is stimulated by the abundance of money and the prospect of still greater ease, and while all the principal stock houses and leading pro- fessional operators are on the bull side of the market the bears aro epmparatively few snd inactive, Tho source of the strength of the market for railway shares ig to be found in the large earnings of the railways during the past year, the average having been equal to more than ® hundred and seventy dol- lars per mile greater than in 1803, @ convincing proof that the stagnation which pravailed in trado did not extend to them. Now that it is accepted as almost certain that there will be no further contrac- ton of the currency, coufidence in values of all kinds is growing, and the sooner the Senate takes conclusive action upon this subject by passing the House anil-con- traction bill the better for the country at large. The supply of capital offering on call is abundant at six and seven percent, with most of tbe transactions at the lower rate, while first class commercial paper, of which the supply 1s hmited, passes at 7 a 8 per c The action of the Board of Brokers on Satur- day respecting Messrs, Lockwood & Co, to which we referred yesterday, bas excited con- rable comment im tho street, aug the proceeding of the board is regarded as not only extremely arbitrary, but illegal. As we ex- plained, Mr, Williston B, Lockwood, a member of the open board, was admitted a member of his father’s firm on the ist of the present month, and the board have de- clared the seats of Mr. le Grand Lockwood and Mr. Van Buskirk forfeited in consequence, on the ground that the firm in taking a member of the open board into partner- ship violated the sixtieth rule of tho assoviation, which reads as foliows:—‘‘Amy member of this board uniting with aay other organization where stocks, bonds, &c,, are dealt in, or who ehall visit the rooms where such deal- ing are had, shall ceage to be a member of this board.”” Herein, it will be observed, nothing whatever js said) against & member of the board entering into partuersbip with a member of any other op, yet the board has proceodod just as if there had Leena and expelied a firm that reflected credit upon the association, Probably if Messrs, Lockwood & Co. valued their connection with the regular board they would legaily resist the action of the board; but agit is the board itself will be the only Joser by the course it has pursued, which savors too much of old fogyiwm and injustice either to command respect or to insure ultimate success, The statement of the associated banks of thie city for the week ending on Saturday last 1s identical in ery respect with the Mgures alroady published in this colume, the Joans showing an increase of $4,879,015, the specie of $1,752,045, the legal tender noies of $1,453,269 and the deposits of $8,257,505, while the cir- culation bas decreased $9, The totais of the present and last previous statements are as follows:— 483) i203, 674 today’s business as followe:— Total receipts. shoes, 716 foo payments, $4,490,405 000 Baance....... 07,169,103 s5x000 SALES AT TWE NEW YORK STOCK EXCHANGE. 6—10:15 A.
