Bird ¢ @., Appellants, vs. the steamboat Joeephine, her tackle, @c.—This'was'an appeal from an order made by Mr. Sestice Barnard, on the 7th day of June, 1867, vacat- ing a warrant of attachment issued against the steam- ‘boat Josephine, to enforce a lien fited by the appellants -underthe ‘provisions of an act of the Legislature en- titled “an ect to provide for the collection of demands againat ships and vessels,’ passed April 24, 1862, for supplies consisting of meats, &c., furnished for the use of the.crow of that vessel. The order was made sub- stantially upoa the ground that the officer issuing the warrant ‘bad not jnrisdiction therefor, the .provisions of the statute referred to conferring such ers being 1n contravention of the constitation of the United States, and of the act of Congress vesting jurisdiction in admiralty cases, especially in the courts of admiraity-ot the United States. Builer, charged with burglary in the third degree, pleaded guilty, They effected an entrance to the promises of John Brooka, 116 Cherry street, on the night of the 29th of Octotier, when $500 worth of coats and pantaloons were stolen. McKatght aud Wilson were each sentenced to the stave prison for four years and six mont! James Smith, charged with stealing, on the 4th fostant, $50 in fractional currency from Edward MeDonald, pleaded guilty. Sent to the State prison for four years. Joseph Pullen — guilty toan attempt at grand larceny. having been charged with stealing $54 worth of miscellaneous articies trom George King on the 1st insiant.
