Little Rabe, Cheyenne chie of the Dog Killers, is still on the war path, and it is supposed that it was some of his band that attacked General Maroy's train on the 26:h ult. at Pawnee Fork. The family of Little Rabe, the Cheyenne chief of the Dog Killers, | were massacred at Sand creck 4 Colonei Chivington with many other women and children, but he says be does not go to war for that, but because of the burning of the Cheyenne camp’ by our troops last spring. If tho election had : NEW YORK HERALD, SATURDAY. OCTOBER 5 1867. THE COURTS. SUPREME COURT—CHARD=2S. | The Butehers and the Board of Mentih— | Charaem of Corruption Avainst the Pres!- deat of the Boara, Before Judge Clore. Joseph Fantzen et al, vs, The Metropolitan Bozrd of Health, and John A, Kennedy, Superintendent, &>.—Tuis case came before the court on application for a perma- Ront injunction, enjoining the defendants from in any manner enforcing the order probibiting the slaughtering Of cattle south of Forticth street, the plvinti(ts belag butchers and having their slaughtor house located at avenue A and Fifteenth street. The complaint set forth Substantially that tue obnoxious order had been enforced jainst plaintifts, o the irremediable detriment of their business, and was unconstituuonal and void; and that the lagiaetive action creating the ordinance conferring such discretion upon the defendants was in direas viola- tion of the constitution. The complaint further charged corraption against some of the members of the Board of Health, and the alfidavite annexed thereto made alluge- ona of a similar nature, The pininuits’ affidavit stated that at an interview betweon Wm. Lalor and others and Jackson 8. Schultz and others it was discussed as‘to the j location to be determined upon in which the business of slaughtering catile might be carried ou, and that said Jackson 8, Schult id that he was interested im a large slavgiter house’ in the vicinity of 105th street, ay which the butchors might got accommodation, Seven persons swore that ihe business as conducted by plaintiffs was not a nuisance. The affidavit of William Lalor, treasurer of the Butchers’ Hide and Meliung Association, set forth (Bat Jacksoa 5. Schultz is large dealer in hides, &c., and has been Open and n: in his hostility to the association, which is regarded by hita and other hide doaters as in- nical to their interests; that Schulz declared ip the presence of deponent and others that utended to revolutionize the business of butchering, and deponent believed it was his intent to destroy said association, Whose business was located at Fatth street and First avenue; and that in Juno, 1868, at @ meeting of the butchers aud Board of Health, schultz said, in the course of a violent barangne, “Gentlemen, !t makes no difference whether you are a nuissnes or net; you are vilonsive, and you nave got to go beyond the city uyntts,’? or wortls to that effect. ‘due case came up for armament on the question Whether there were any evsentiaity new features in the’ action nat involved in the cases of Shusman and Valea- tine, vow pending before the General Term, Mr. Shatter Giauned that the case under consideration diferea in several respects, ag Collows:—The eases above meu- tioned asked for relief from a threarened enforcemont of tho alleged despotic aud unconstitutional order, whorees io the present case the order had been carried iate elect; secondly, that ne proof of the premises boing & bulsance had been taken by the Bord; that no adjucit ention bad been granted upon the question before the detendants and no notice served. Mr. Eaton, on bebsit of the defendants, claimed that jo tho cases now pending before the General Term every t and essential question involved in tue prosont ase Was covered, inciuding the constitutionality of the Board, its mode of action, its legal powers, &c, In re- fering tan allusion made by plainuif’s’ counsel that Uis cienta were Frenchmen, aod had sougbt ia their adoption of America ag their home the immunliies de- nied them in France, defendants’ counsel stated that in the city of Paris there bad not been a private siaugiter house since the time of the frst Napoleon, and that the slaughtering was wholly conducted in public abattoira, find it was no reason that plaintiffs should enjoy immu- nity from restrictions in America which had been proved highly bonoticial in their native country. The ailidavis of Jackson 3. Schultz denied substantially the a!lega- tions made retleceing upon bim persovally, and the aili- it of the secretary of the slaughter house at 10510 street denied that Mr, Sctultz was io any manner per- soually or pecuntarily interested in that establishment, Mr. Eason then proceeded at considerable length to vin- dicate the reputation of the defendants, and empbati- caily donied the asporsions made regarding the President come off two weeks ago we would bave had them by ten thousand, But they have got scared, and thoy are drumming im every bole and corner to brig oui their men, and they have possession, avd that’s a grei ‘This means that on this “fuss about Johnson’ t pabitcans will probably carry the State, Tho vote will light trom all the present indications; but as the radi- cal jeadera aro “ecared,” they will no doubt waich and briny up their reserves on election day ag the case may, seem to require, “Oid Thad Stevens’’ is reported to bo sicadily mond- ing, avd “Old Buck,” they say, begins tobe cheerful over the pro<pect of a restoration of the Bourbons, But as bis notions betong 10 4 past generation, they are hardly worth discussing.
