Duff and James E. Hayes.—Ttis case came before the court ona motion to set aside the order of Justice Leonard. A short time since Judge Clerke granted an injunction ‘against the defendants restraiuing Duff from leasing the Olympic theatre to Hayes, and enjoining the lat‘er from taking n of the same, on the ground of collusion between Duff, who is also a receiver of the propery, aud Hayes, wno is Duif's son in-law, the plainti® claiming that Duff had leased or was adout to lease the premises to Hayes at $15,000 per annum, the necessary rupairs of the theatre to be made by the estate, while other ible parties were willing to give $ 000 per year for the batiding, and bear tne expense ot necessary repairs themselves.
