Important Tarif Qucetion—Opinion of the Court is Connection with the Imposition of Excess of Duties at the Customs. Before Judge Smalley. EB. F. Davidson vs. H. A. Smythe,—This was another of the legion of litigation questions arising om the eqnatraction given to the various tariff acts, and to the “regulations” of the Treasury Department intended to be explanatory of the same, but whieh, from the rich crop of suits that have sprung up im consequence, and which have occupied the Circuit Court for two terms, bave evidently made confusion worse confounded. The plaintift secks to recover $10,000 in gold on an ginal tion of wool from Buenos Ayres, made in May, 1 ee baying ‘As the case was stated by * pala counsel, Mr, Siduey Webster, it prec, Go laintif in the latter part of 1864, being at the time “4 Europe, ordered an importation’ of wool from Buonos Ayres, the price not to exceed twelve cents a und. The order was received in due course by plaintiff's brokers ip Buenos Ayres, and 326 bales were forwarded in the following May to plain- | tifl’s order im New York. On this importation there was Six cents a pound duty levied, and on the liquidation of the eniry tor this alleged excess plaintif protested in the usual form, and appealed against the exaction of the Collector to the Secretary of the Treasury. The plaintift’s ground of pepeest and appeal being bused on ihe tariff act of 1861, which provides that on unwashed wool valued at le3 than twelve cents there shall be imposed a dutyof three cents a pound, and if valned at more than twelve cents and under twenty-four cents there shall be levied a duty of six cents, The wool on its arrival was appraised by the appraisers at the Custom House, who Teported it to be worth more than twelve cents, this valuation being in excess of and contrary to the Invoice value. Upon this report the addition of three cents a pound to the three cents allowed by law if the article were worth a lees sum than twelve cents was added, making the ex brought to revover, is ess which the action was The testimony of, the piainti® and astom House clerk, with the production of the in- ice, as to the actual value, and of the entry as liqui- dated by him, according to the excess of duty appraised by th appraiser. fully sustained the claim. riney, United States District Attorney, for the defence, concluded that the appraisers’ report was final and conclusive as to the dutiable value of the wool im question; that in the absence of any fraud or incapacity t of the appraisers, neither of which was it would be impossibie, under previous rulings of the Court, to g0 behind the question of the appraise- ment, and that therefore all the tostinony as to the value of the wool in Buenos Ayres and ail tho testimovy as to the cost of the article here was whclly irrelevant and in- admissible, It was clear also that the plaintiff! bad not applied for a reappraisement of the wool, which he was bound to do to sustain him in the action. ‘The Court said that the rights and equity of the case were very clearly with the defendants. There was no doubt at all that the government had $10,000 of the plaintiff's money which it bad no earthly right to, and which in equity and good conscience it was boun to restore without instituting suit to revover through the courts, The evidence shows, and the officers themselves show, that the wool in question was worth only three cents as a dutiable article. The defence is purely technical, which. I must say I rogret a great government like ours should ever make, is not creditable to the government to embarrass merchants in this way; tosay to them, “The merchandise that I have taken by a etrong’ arm, a $10,000 of yours plaintiff, which I have myself will gs availing myself of the “echnicalities ot the law so to keep it and withhold it from Py ‘The court must deal with the law as it finds it, e courts do not make the law nor do they execute it; the courte only administer it as they find it Tho law offl- cers of the government—the United States District Attor- ney in this case--are bound to defend these cases arising under these acts, and the courts are bound to adjudicate on them; but it is clear that a great wrong is done in compelling the collectors to bear the brunt of these ac- tions. I will direct a verdict for the plaintiff in the case on the facts, and if counsel desire it I will hear argu- Ment on the points of law hereafter. Verdict accordingly for the plaintiff, SUPREME COURT—CIRCUIT—PART 3. The Pawnee Agency Libel Case—The Testi- mony Clesed—The Case Submitted te the Ter Before Jadgo E. D. Smith, Henry W. De Puy ve.
