Thomas Horton and John Halloran testived that on the evening of the 6th of August they met the deceased and Kirby at the corner of Atlantic and Columbia streets, and that after parting with them they went down Forman street aflerthom, though notbon the same side of the street. Their evidence in reference to the fight agreed with that of Kirby. Patrick Fleming testified that he witnessed the fight on the 6th ot August hetween prisoner, Kirby and deceased, and gave an acconnt of the affair agreeing with that o! the last three witnesses, Jobn Graves, bartender, testified that be witnessed the shooting of McGuann by the prisoner, and aw the pris- oner take aim at MeGuann before he fired.
