Several officers of his command had arrived at Matamoros, who confirmed the capture of eight bun- ‘red prisoners of Olvaras’ command, and about four hundred others, with the convoy, were sent to Camargo. The convoy was also taken to Camargo under double guard, with orders, under General Escobedo, not to allow ‘auything to be touched, Two Mexican imperialist regi- ments changed sides in the fight. Another despatch from Brownsville, Texas, is con- @rmatory of the above. It says:—A train of two hun- @red and fifty wagons, with valuable merchandise, was started by General Mejia from Matamoros for Monterey, guarded by nearly two thousand imperial troops, under Genera Olvaras. Plaintiffs and defendants now sought to put in certain amendments and have them made a part of the ruling of the Court. Counsel for Holt addressed the Court, and condemned the conduct of the Excise Commissioners in very strong language. He said that they were a lawless, ‘partisan and political board, dispensing political doctrines and not the law of the state of New York. He would advise the citizens to oppose the proceedings of the Excise Cum- missioners in this matier by every legitimate means in their power. It was also stated by another counsel that he had been applied to by some persons to take out injunctions a‘net the Excise Commissioners, but that he advised them not to do #0, out of respect to the decision of the Court, which ho believed would cover all those cases. ‘The Lederkranz Club, a private club which met under lock and key, had been broken into by the police. Quarantine, 8. I., June 25, 1806. MEETING AT STAPLETON. The Anti-Quarantine Committee met yesterday, at half- past four P. M., at Giesser’s Hotel, at Stapleton, 8 1., and adjourned, subject to the call of the Cnair, without any business, owing to the fact that their action was to have been based ov the decision of Judgo Barnard in the injunction case; and that being deferred they are awaiting the ultimate disposal of the case be- fore taking any further steps. APPLICATION FOR AN INJUNCTION AGAINST THE QUARANTINE COMMISSIONERS. A special term of the Supreme Cuurt of the Second Judicial District (K: county) was commenced yester. day in the new Court House of Brooklyn, before Judge Barnard. The case of Henry H. Seguine and others against Jackson 8. Schultz aud the Metropoli- tan Board of Health was called. A temporary injunction was obtained two weeks ago against the defendants, the Quarantine Commissioners and the Com- miasiouers of och age restraining them from making use of Seguine’s Point, Staten Island, for the purposes of landing or ‘¢ from infected ships, and yesterday was set down for hearing the arguments ef counsel on both sides. James T. Hrady, A. W. Wi- nant and Tompkins Westervelt appeared as counsel for the Legg bens Mr. C. Tracy for the Board of Health, The suit is nt by Heury H. Seguine, Abraham J, ‘Wood, Cornelius Androvette and Ephraim Johnson. The sero Sc affidavits sworn in the case occu- Pred a consi le time. AFFIDAVIT OF MR. SEGUINR, The affidavit of Mr. H. H. Seguine is very long. He states that he is the owner of house and landed property to the value of $80,000 in the ne ghborbood of the dis- trict taken ion of by the defendants for quarantine Purposes ; it the defendants have commenced to pre- pare buildings for the reception and care of pationts, persons, clothing and bagyage to be deposited there from vessels now under quarantine at the Quarentine anchor- age, in the lower bay, infected with cholera and other quarantinable d seases, and from the floating hospital ships now at said anchorage, and from other vessels now ‘used or occupied for the reception, detention and care of such patients, persons, clothing and baggage, and from other vessels that may hereafter arrive at the port of New York infected with cholera or other rte quarantinable diseases; and that the defendants threaten to use the place in question, and are using it for the aforesaid purpose. Deponent says he believes such use and o-cupation is wholly un- justifiable and unlawiul and contrary to the statutes ia- Vended for the establishment and regulation of quaran- tine; that within a vircuit of two from Seguino’s Point there is a population of at least one thousaud in- babitant that within a@ circuit of four miles from Seguine’s Point there are soveral thriving vill that railway cars, carrying several car loads of passengers, pass daily within a mile of segune’s Port, aud thot if the defendants carry out théir intention the ? as of deponent and the other plain of all persons in the vicinity, will be Péricusly in. jured nd depreciated in valine, » the m ket value thereof greatly diminished, if not destroyed, and that the vaiue of the doponent's property and the value of the property of the other plaintitts an't of the persons residing in the vicinity would b» less ned and depreciated at least one-third. In conclusion Mr. Seguine states that the establishment of the quarantine frou a Seguine’s Point would greatly endanger the fives and heaith of said pop ‘lation, of deponent, said plantifs and their families and the residents of the whicie ot Richmond county, and very likely lead to the intro duction of pestilence and dangerous jriectious disease; and that it would seriously interfere with the means of those who are engaged at the locality in dispute la tne planting and marketing of oysters. This affidavit was supported by others from A. J. Wood, A. Latourette, Dr. Solomon Andrews, Dr. Elgar and Dr, E. W. Hubbard. An affidavit by the Pres dent of the Emigration Committee was read, to the effect thai the intention of the Commission was not te bring sick Pp fsons or their clothing or baggage to the shore no matter with what disease they mighi be affected. They deny every allegation of the plaintilis. William ¢. Anderson, a physteian ai tine Commission, was to the et! with Oificer had’ power to son shore, and that this would not tend to spread the disease @inong the inbabitanis, Cyrus W. Curtis testified to the same effect, Counsel then read the affidavit of Jackson 8, Schultz, President of the Board of Health, embodying the main points of the defence. After referring to the efforts that had been made to procure a suitabie site for a quarantine station at Sandy Barren Isiand or Coney Tsland, Mr. Schultz shows what has been done in relation to Se. guine’s Pol and states that buildings have hired there and money to the amount of $5,000 laid out on them to render them suitable for the purpose required. He says that the same will be wholly lost if the iujor on herein is maintained, Deponent further says that it ts not the intention to place on sad land or in Fnid bulidings, or in any of them, any person sick with any contagious, infectious or quarantinabie, or any other disease, nor any persons, who there is good reason to suppose have any such disease, but only to place there such persons as have arrived upon vessels where clolern has prevailed, to keep them under observation for su length of time as medical men may advise i aeury Proper for the purpose of ascertaining if they have disease about them, and thus to prevent the introduction cholera into the community. He adds that If persous Docome sick alter landing they will be at once removed to the floating hospital, and that it is not intended to continue the use of such premises, even for such purposes, longer than till next fall He denies the allecavion made in the affidavit of Mr. Seguine; asserts that the establishment of the station in question would neither endanger the health of the inbabitanis nor lessen the value of thelr property, and adds that Mr. Secuine calied on him and offered. to sell to the Board of Health the property owned by him for the purpose required by the rd. Deponent believes he would not have done so had it been probable that the use of said premises, or any premises, would bave been injurious to the health ot the inbabitants, That the only premises proposed to be erected other than those already there are barracks for the police, and that if the premises are not permitted to be used as proposed no other proper place can be pro- cured, and that the well persons must be either kept on or turned loose on the community. affidavits of Honry W.
