THE BUTLER GOLD CASE. eee Q@Maavit of General Butler in Fall—Let~ ters of Counsel, dic. COURT OF COMMON PLEAS—SPECIAL TERM, Before Judge Cardozo. » Samuel Smith and Andrew Smith ve, Benjamin F. Bul- ter.—We published exclusively yesterday a sketch of the fatost developments in this interesting case, but having Ginco procured the full affidavit of General Butler, we lay & before our readers, thus enabling the defendant to give ‘is own statement in his own language. The affidavit is 5 follows:— City and County of New York, as. :—Benjamin F. Butler, tho dofendant in the above action, being Orst duly sworn, doth depose and say as follows:—That he 18a citizen of the Stato of M jusetts, residing in the city of Lowell; that on or about the 16th day of May, in the year 1861, he ‘was duly commissioned by the President of the United siatee Ao major general in the service of the United Btates, and tinm: thereupon entered upon the dis- urge of the duties assigned to him; that afterwards, and the 23d of February, 1862, by’ order of George B. McClellan, Major General commanding the armies of the ‘United states, ‘a new military department, to be called he Deparment of the Gulf, compnsing all the coast of ‘the Gulf States west of Pensacola harbor, and so much of said States as may be occupied ‘by the forces of the United States, was constituted, and the command thereof, together with the command of the land forces to So-operate with the navy in the contemplated attack ‘upon and reduction of New Orleans, was assigned to this deponent. That on the Ist day of May, 1862, this de- Bonent, ax Major General commanding the forces of the Inited' States, took possession, by capture, of New Or- Jeans as surrendered to the forces and authority of the United States, the said city and State of Louisiana then Being in a state of rebellion famation of the President, against the governm United States, That on or about the 19th of May, 1862, ‘while acting in his aforesaid capacity of Major General, Baving received information, which this deponent then ‘Delieved and still believes to be true, that Samuel Smith Co., the plaintiffs in this action, were traitors, and ‘oankers acting for and in behalf of the Confedorate States then in rebellion, and that they had in their Possrssion, secretly deposited, a large amount of fpecic which had been fraudulently taken pos- Session of by one Guirot, Director of the United Slates Mint at New Orleans, immediately after the ordi- Bance of secession had been passed by the Legislature of the Stato of Louisiana, and held by him for the use and Deneit of said rebellions Confederate States as their agent. And that when, by the joint operations of the land and naval forces of the United States, said city was about to come into the possession and under the control of the United States, said Guirot had placed said amount in gold in tho hands of the plaintiils, in order that the amie might be concealed by them for the use and bene- fit of the Confederate States; and that. in pursuance of such agreement, the plaiutif—s had hidden the same «pe- cie within the Space between the brick walls of their banking house, HE ARRESTETH YE BANKERS. This deponent, acting under and by virtue of his au- thority as aforesaid, ordered the arrest of the members said firm of Samuel Smith & Co., and by examination excerta ned that they had in thelr possession alarge of which was hidden as aforesaid, the sum of $59, Buch seizure being reported to this doponent, he caused the same specie to. be secured to the use of the govern- ment. And this deponent further says that thereupon the piaintiff applied to this deponent to have a commis- Gion appointed to determine the question whether there ‘was probable cause of holding the gold so taken to the ‘use of the United States. Whereupon a commission was agreed upon between the plaintiffs and this deponent to decide upon that question, consisting of William New- ton Mercer, Eaq., President of the Bank of Louisiana, Gelected by the plaintifts; Hon. Thomas J. , of New Orieans, counsellor at law, mutually agreed upon, end Brigadier : , of the United States Volunteers, then Acting Mayor of New Orleans, @elected by this deponent. Upon a full hearing before this commission, at which these plaintills appeared by counsel, ananimously determined by th rn mission that all specie or other property seized beyond the $50,000 in gold should be released, and that with regard to such surplus there is no cause ‘for further de- tention. With regard 10 the $50,000, the commission thinks there is ground for detention until the proper Washington be heard from. In compliance, E of July, 1862, with the sug jon of ‘the Commission, this deponent immediately reported all the facts and circumstances of this seizure, together with the report of the Commission, containing their testimony, upon which they acted, to the houor- blo the Secretary of the Treasury at Washington, and ‘feaked instructions as to the disposition of said fifty thou- and dollars in gold, this deponent having returned to the plaintif the sum’of $9,549 25, which was found by the Commission to beloug to them. And said deponont further says that faid sum has ever since been hold by ‘him at all times ready to be turned over and delivered at the order of the govergment; and that since he returud, after being relieved from his command in the Depart. ment of the Gulf, this deponent has had and kept in bis ands, in Massachusetts, this amount in gold, or in gold copuitcaten, ready to answer any such order or the claim these plantifis, or other just claim upon him. That while thus holding this money, awaiting the orders of the ernment, A suit Was commenced against deponent by ith & the plaintiffs, to collect the amount of $50,000 in gold, for that amount taken by deponont'as aforesaid, and an attachment issued on the 28th day of October, 1864, out of this court; that deponent was per- ‘sonally served with process on’ or about the th day of November, at the city of New York; that upon being threatened with this suit, this deponent made applica. ion to the War Departmcat that he might be permitted to pay over the sum of $50,000 in gold to the United Btatos, and that the government should assume the bar- dea and conduct of the defence of this suit. The War Department declined to interfere while the event of the euit should be determined, and then to to take such ‘@ction as should seem meet thereupon; that this de t defended said suit, and retained said money, so Gubjest to the order of the government, #0 lon ‘as he remained in the service of the Unit States under his commission and paid the ex- wes of the defence from his own means. And efter the resignation of bis commission, and he became ‘a private citizen, he made a further ation to the ernment for indemnification in this behalf, to whieh received no reply, although he waited a loyg time, to Th. more than sixty days, therefor.
