THE ORIGINAL COMPLAINT, ew YORK. Péer R. Strong, plaintif, vs. Mary E. Strong, defend- ont,—Peter R. ‘aiong, the plaintiff in this action, com- plains of Strong, the defendant herein, and shows to this Court:—-That at the city of New York, on the 16th day of May, 1853, he, the said plaintiff, was duly and lawfully married to the said defendant Mary E. Strong, then Mary E. Stevens. That at the time of auch marrage the said plaintiff and said defendant were, and ever since have been, and now are inhabitants and residents of the State of New York, and that the faaid defendant now resides within the city of New York. That after such and until the discovery of the adul- tery of the defendant hereinafter mentioned, the said plaintiff and defendant cohabited together as man and wite, and had issue of the said marriage three children, ‘viz: one born in the month ot Aprig in the year 1854; another born in August, 1869, both female children, ant mow living; the third born October 28, 1860, and who died on the second day of January, 1862, That the said defendant, disregarding the solemnity of her marriage ‘vows, hath, at various times and places, since the mar- riage of tho puniitr with her, as aforesaid, committed adultery with one Edward N. Strong and they had froquent carnal connection together, but on what par- ‘ticular days of such months respectively, other than said 9th day of April, or how often during the said months respectively such adultery was comiitted, this plaintiff is ignorant and cannot more fully or particularly state. That such adultery was committed at and within ‘the town of Newtown, in the county of Queens and State of Now York, whero ‘the said plaintiff and the said de- fendant and the said Edward N. then resided, That in and during the months of January, February, May and June, and the first twenty days of October, in the year 1861, and on divers and several days in each of such months, the said defendant did commit adultery with the said Edward N., and that they had frequent carnal con- Rection with each other, but of the particular days in uch months, or incither of them, on which such adul- . tery was committed, the pain ie ignorant, and cannot more fully or particu the same. After the roll call of the jurors and the restoration of quiet the Judge called the case, and Mr. Cram, on behalf of the plaintiff, rose to = the proceedings. He traced othe early family connections of ghis client and his subse- quent marr.age in 1963 with the defendant. Mr. eng ‘was the son who, under the instructions of the pater will, cared for the mansion in which his aged mother re- and where the children of the family were wont to assemble and dwell when so inclined. He had taken his wife to this house, which was situated in Newtown, Lor island, and while there in 1857 his brother, Edw: N. Strong, bad become a widower, and took up his residence with them. This Edward had been inconsolable for the loss of his wife, and had sought refuge in religious acts, He had built a Sunday school and had joined the Church. ‘The couns@l proposed to show tw the jury by the evidence that this brother had commenced a criminal itercourse with the wife of the plaintiff in the spring of 1860; that this intimacy was continued until its discovery, just os to the 5th of January, 1862, Tho said Edward bad meantime Joined the army, but in the holidays of 1861 came home on leave of ‘absence, and was again, it is alleged, guilty of adultery with the defendant at the house No. 50 East Twenty-first street, to which the plaintiff had in the meantime removed. Three chil- ‘dren had been born to the marriage—Mary, Alice and Edith. She was with child at this time, but it was never born alive. It had pleased the Almighty to take the youngest, Edith, on the 2dof January, 1862. The mothor, Milled with grief, ” for she was human, was lamenting over the death of her child, On the evening of the 6th of January, while the husband and the wife were seated in the communion of the family circle, the defendant had deen listening to a paragraph of the Bible, which told with such weight upon her conscience and feelings that she fell at the feet of her husband and confessed her sin. [Objection was made at this point by counsel for the de- fence to the introduction of the evidence of the plaintiff, who, in the present case, could not bea witness. The Judge decided that the advocate had a right to open the case as he thought proper. The husband, continued Mr. Cram, had not desired to make his domestic shame public to the world. He removed with his wife to Islip, Long Island, where he hoped to bury it from the eyes of mankind. It would be shown at the proper time that his wife had made a written confession ‘of her guilt to him, that he had not forgiven her, and that since the discovery of her sin he had not cobanie with her further than to occupy the same house. guilt had been made known successively to her father, mother, brother and sisters, and he charged them now with aseisting in secreting her and the children from the reach of the injured husband. So far as he could ascertain the defence rested their case on charges Drought against the plaintiff, supported by the affidavite - ~ men whose characters would appear afterwards. arch, 1862, the plaintiff had rented his mother’s tease situated at No. 104 Waverley place, to a man named Vernon Potter, a huckster in Washington Marke and it was with this ‘Mr. Potter’s wife he was charges with adultery. Mra. Pottere-Mrs. Electa M. Potter was a practitioner of medicine, who had associated with herself a Mra Walsh, and with whom she organized the ‘Metropolitan Medical Society for the Care and Cure of the Sick Families of Absent Sol- diers ;” ‘‘and I see,” said the counsel, holding the pros- tus of the society in his hand, ‘“it is endorsed by the ion. Henry J. Raymond and a number of clergymen.’ The brother of the defendant had now come in to crush the plaintiff, and for bis purpose had found appropriate tools. A certain lady had died during the performance of an abortion which was to have been first charged against Mrs. Potter, who was then, if convicted, to be pardot that she might criminate and condemo Mr. Strong. To assist thi plan a certain Masses and his wife wero made use of, who, accordiug to the state- ment of the former and a letter said to io in the handwriting of John Austin Stevons, were supported in comparative affluence at Earle’s joe’ Hotel by the fonlly relations a@ @he defendant. Complicity in the abortion and its attendant murder were to be proved by the evidence of these parties and by Mra. Walsh, whose husband was a wack doctor and vender of patent medicines in Bangor, Me. The case had come to trial in October last, bat the plaintiff had- been acquitted of the charge.
