a 3 TRIALS. AT POLICE HEADQUARTERS. ee ee a asd se Case from the Fifteenth —— mara. © Dangers Arising from a Mistake tm Mdenth,—* Without Provo- zen Severcly Clabben ~ ‘Micers Breakell cation—Tall Swearing—©. spun ae end Smith Fall in with a se Cl Hey Npvel Mode of Wartar sate ¢ (rine taxa ~ Finally Vanq ished by a Lack Sa obint, &e, A somewhat remarkable case, showing the dangers Mable to apise from a mistake iD identity, was wg ova Board of Police Commissioners yesterday, i400 eae Phelan, a very respectable appearing Young man, rewid. Sag at 26 Fifth strect, with bis parents, was the com- plainaut, and officer Weinhold, of the Fifteenth precinct, the defendant. Mr. Phelan stated that be went out of hie house about half-past ten o'clock in the evening, at the request of his father, to engage @ carriage fora young indy, who was to leave the house at an early hour the following morning. As he proceeded up Lafayette place officer Weinhold came bebigd him, seized him by ‘the collar, and, after exclaiming *Pve got you,” struck "him with bis club across the shoulder, He turned to ex- plain to the officer, that he had arrested the wrong man; but Before he could do so the latter struck him on the head and felled him to tae ground, He was then taken to the station house and locked up over nigitl, and the next morning brought before Justice Dodge, who discharged him at once, and reprimanded the officer for clubbing the complainant. Citizea Thomas H. Chambers stated that he saw the clubbing, and was so far satisted that the young man wrongfully accused that he went with him to the jon house, and subsequently to his father’s residence and informed tbe elder Phelan of bis son’s misfor- It was folly proven by several witnesses that the Young man had vot been ous of the house the entire eveni j) half-past ten o'clock, and that he had not ‘Deen absent haif dn hour before bis father was made ac aquainten with we fact of his arrest. “ilicce Weinkold, a stout German, Weighing ever two hundred pounes and standing about six feet in height, swas culled onto make sowe defence for his actions. “He sstatod that he was patro!ling his post on Lafayette place ‘on the night in question and saw complainant aslecp in ap area Way, that he shook blm up and told him he must not sieep there, complainant replying that he would sleep where he damned pleased; that he (Weinhold) told bim to go off or be would arrest him, complainant reply img in the most abusive and profane language, and even threatening him with persona! vio! e; that he then gave cbase for him, never taking his eyes of! him or in any manner losing sight of bim, that he finally overtook hm, and that upon his attempting to mak complainant caught poki of lim and he str. his club acrogs the shoulder; that complainant still re- sisted, and endeavored to wrench bis club away, when he strack him with it on te bead-and then wok him to the Bla!.on house, In support of this story the officer ‘prod Louis Werner, of 119 St. Mark's piace, who stated that he was passing through Lafayette place,.and saw the officer and complainant talking together, complainant using profane and disrespectiul la age; that he beard the officer tel) him to go home, complainant refusing to do so Ciuzen Werner further stated that he saw complarmant when he started to run from the officer, that he followed them both, and never lost mghtof either of them, aud was certain complainant was the man. President Acton requested the witness to look at complainant again, ana sce if be was not mistaken. He did so, and still asserted that complainant was the identical man. It was shown by other witnesses that a man about the size of com plainant, but Cressed in light clothes, was on the offic ‘eat on the night of the arrest and that it wi ran away. The theory established by all u was, that the officer saw a inan whom he beli picious character; that he gave chase to him, lost sight ‘of hiro for a moment, and that he happened to turn a sharp corner and jump into some secure place at about the time that citizen Phelan was quietly proceeding in a the arrest him with ced citizen similar direction to the one the officer supposed the vogue had taken; he being about the same size as the der, and the officer being doubtless excited, he was misiaken {or the other man barshly used, ‘The fault committed by the officer was in clubbing the young man without affording him any opportunity for explana- tion. In fact, be should not have used the club in the manner be did, wpon a rog’e even, and President Acton so anformed him,’ Notwithslanding tbe showing that ihe young man could not by any poreibility have been the ove pursed by the olticer, yet the and bis witness, citizen Werner, could pot be so convin. ced, Hon. Jobn McKeon appeared for the complainant. and there were @ large number of the you friends in court, inclading tis father and mother MeKeon remarked that if policemen were w club cits zens 10 any such ma asthi, then nove of ur were safe, and be did not think such men as Weinbold should be allowed to carry tu) President Acton said the Board would see 40 it that \itizens were protected as far ‘as possible from all euch owtrages. With regard ‘Yo her being disabled fo as vw be noable to appear m court, officer Breakel| said he could show py ail the witnesses present that the woman had beon in several fights since the time of the beating. Here 4 man named Movahan stepped vp and on being eworn said the woman was in a tight only two days ago, aod that be was present and saw ber beat some women. Wo sooner had be said this than the women witnesses al) broke out in chorus that they also bad seen the woman on the occasion referred to, and knew her to have been im three or four fights ence the alleged clubbing. The manner in which the witnesses gave their evidence om most ludicrous. The officers evidently thought they had not themselves acted just right in the premises Breakell said be was a new man on the force, and when he called Smith supposed the superior experience of the latter would heip bim out, but, end he, wouldn't give wecent for Smith in a scrape.’ Smith desired to inform the Commirsioncre that be had a similar opipion relative to Breakel!, and that be would not cive three cente for him, President Acton med them that the public erpected them to be rth a thousand dollars a year nob.
