Before Judge Dowling. This was an action brought by Mr. Nathaniel EF, Sheldon, of this city, against Mr. Frederick A. Howe, of Crawford, New York, as agent of the Tionesta Oil and Lumber Company, Tionceta, Forest county, Pa, for false representations, &c. It appears from the statement of the complainant that he employed Mr. Howe as his agent to purchase one sixteenth part of a tract of land, @ituated as above, and he alleges that Mr. Howe made representations regarding the property, which, on his (the complainant) visiting the locality, proved to be in- correct, and, therefore, the cause of the present action. The counsel for complainant was Mr. John Sedgewick, and Messrs, John H. Stewart, John Van Voorhis and 1. ©. Bliss appearing on bel of the defendant. The testi- mony of Mr. Sheldon was taken. ‘The defendant's counsel complained of the manner in ie the arrest of their client had been brought about. lowe had been induced by fictitious telegrams to Rochester, New York, and on his arrival there was proses arrested and hurried off to New York without fn opportunity for seeing counsel.
